April 21, Revdex.com Jefferson St NE Ste A Albuquerque, NM Re: [redacted] Mr [redacted] had contacted us approximately weeks after purChasing their new Volvo on Nov17th of Mr [redacted] had contacted Volvo cars of North America a few weeks after the purchase (the complaint number was provided by him in his original letter to Revdex.com)Mr [redacted] 's concern was that someone in our dealership had promised him that we would make his first payment as he had seen a TV advertisement where Volvo would make his first payment (of up to $500)During our conversation we tried to clarify that no one from this dealership would have said that to him as the TV advertisement clearly states that first payment promotion was on models only (Mr [redacted] purchased a 2014)After further conversation, we informed Mr [redacted] that in order to keep him as a happy customer we (Corley's Volvo) will send him a check out for $(attachment H)At that point Mr [redacted] assured our GM [redacted] the he was satisfiedThe [redacted] s recently purchased a Subaru a few months ago and were concerned that they may owe more money on the Subaru than its trade valueAfter understanding their concern our Sales associate [redacted] proceeded to show them A retired demo XC60: After driving this Volvo thoroughly we proceeded to work numbersThe [redacted] 's knew the miles this vehicle had and also expected to get a great deal as they are going from a Subaru to a Volvo with miles, as they immediately asked us if we can take care of some scratches on the car, which I obliged (attachment B)We proceeded to print a sales proposal which state the miles on the car they are purchasing and which Mr [redacted] signed (attachment D)During the course of working the dollars and payments, MrAnd Mrs [redacted] aired their concern that they would like their trade paid off no matter what, as they knew that they might be "upside down" (meaning owe more on their trade than it is worth)After agreeing to the price of the transaction, Mr [redacted] stated that he would do business that day if I would offer an additional miles of warranty because he understood at that moment that the first miles of warranty had already lapsed and take care of some leather wear on the inside and perform software updatesMr [redacted] asked me to put all that in writing before we proceeded and I obliged (attachment C)A few minutes into completing the initial paperwork Mr [redacted] also wanted me to cover the additional Volvo free service at miles as the last free service Volvo includes would have been at and since Mr [redacted] is taking delivery of the vehicle with that would put him over the marker and so I also agreed to offering him an additional service at cost to him (attachment B)Mrsand Mr [redacted] proceeded to our business office later to sign all the finance documents and in there they signed an odometer statement of the vehicle they are purchasing indicating miles (attachment F)At this point MrsAnd Mr [redacted] had at least occasions (in writing and one visual during the demonstration drive) where the miles were clearly disclosed on the purchased vehicleAs far as the question regarding the status of selling the vehicle as "new or used" on this vehicle, Section 57-16A-line G of NM Motor Vehicle Quality Assurance Act (attachment G) clearly states this car qualifies as a "new car" without any ambiguity or debate and setsclear standardAttachment ELastly Mr [redacted] had indicated some concern with the value of his Volvo and thinks he might be upside downAs we have shown in the paragraph above, that his vehicle is considered a "new" vehicle and if he is in fact upside down it might be from his Subaru trade in against his new Volvo purchase as per attachment C indicates he wanted more money for his trade than what he owed or was worthI believe we have Successfully acknowledged Mr [redacted] 's concerns by providing factsThe last attachment G, (sales exit survey) successfully shows MrsAnd Mr [redacted] were 100% happy and satisfied with the entire experience here at out store the day of their purchaseCustomer Satisfaction is of the utmost concern here at Corley's Albuquerque Lincoln Volvo and we hope that this will fully resolve our customers concernSincerely, [redacted] Dealer Principal [redacted]

I am rejecting this response because: this still does not address the fact that they sold us a used car as a new carHad we know the car was considered used through Volvo corporate we would not have paid so much for the vehicle The vehicle was sold to us under fraudulent termsI would like the car returned as it was sold through trickery and misinformation If the vehicle was in fact considered used by Volvo corporate or any other authority This should have been disclosed to me in writing at the time of purchase In our attempt to resolve our conflict with Corley's Volvo in Albuquerque NM, we called and spoke to corporate over the phone and I was informed that the dealership registered the vehicle as a “used” vehicle through corporate but it was listed and sold to us on our paperwork as a “new” vehicleThe corporate representative informed me that once the warranty is activated the car is then considered used and the warranty was activated in of Feb (We purchased the vehicle in Nov 2014)They were sighting this as why we did not qualify for the promotion "Volvo makes your first payment", which was supposed to be for new cars onlyWhen we spoke to the dealership they stated that the vehicle was still considered new because the vehicle was never registered through the DMVWhich is it? This should be a clear standard and should not be up for debateI obviously would not have paid the price I had paid for it had I known I was buying a used vehicle. I priced up similarly used vehicles and the acceptable price range is 32K-36k and now I am upside down in a vehicle due to their deceptionRegardless of who considers the vehicle used this was not disclosed to us in the paperwork or in person at the dealershipThey fraudulently misrepresented the vehicle as new and did not disclose that the vehicle was considered used through corporateIdeally I would like corporate to take the vehicle back and pay off the balance of the loanI do not wish to drive a brand that does not stand by their product and ignores customer concerns or they can pay us the 7k dollar difference we would have paid if the vehicle was actually sold as usedI have attached a copy of our bill of sale that lists the car as new in the left hand cornerWe were told over the phone that the vehicle was registered as used through corporateI can try to email them and see if they will send me a copy of that but I seriously doubt they will want to release that information to me in light of what is going onI am attaching the corporate number and I give you permission to speak to them on my behalfRegardless the fact is that the vehicle is registered through corporate as used and this should have been disclosed to use prior to our purchaseWe only found out by accident when we were pursuing the other complaintI have attached the number to corporate and well as our previous complaint# and our VIN.Volvo Customer Care = ***Complaint# = ***VIN = ***
