Please accept the following response to the above listed complaintThe undersigned, as Chapter trustee for Cornerstone Homes, Inc., is effectively the CEO of the company and fully authorized to act on its behalf Cornerstone Homes, Inc(hereinafter "Cornerstone") currently manages well over
single family residences throughout central New YorkDespite the high volume of properties under our control, and the hundreds of tenants that we work with, we would like to first note that this is only the second Revdex.com complaint we have received in over three years.The tenants' demand to be repaid almost all rents paid since they took occupancy has absolutely no basis in fact or lawCornerstone cannot and will not make any offer to compromise this frivolous claim.The tenants took possession of the property on or about March 15, They agreed to pay rent in the amount of $per month, plus an additional $per month for one dog.Upon taking possession, they reported that a water line had burstIt was immediately repaired.Following the water line repair, the tenants resided in the property, without issue, for six monthsThen, on September 12, 2016, the tenants sent an email complaining of various repairsthat they claimed needed to be doneA repairman was promptly sent to the house, and therepairs were completedThe tenants continued to live in the house without issue.On October 17, 2016, the tenant sent an email to Cornerstone, complaining about the quality of some the recent repairsCornerstone issued a credit of $to the tenant, and senta repairman back out to resolve the issues(In hindsight, the issuance of a credit was probably a mistakeDoing so apparently led the tenants to believe that with every complaint, Cornerstone would simply give them money.)On November 8, 2016, the tenant called the Cornerstone office and complained that the repairman was smoking marijuana on the back deck while making the repairs in OctoberThe repairman advised that he was merely smoking a hand rolled cigaretteThe repairman has been working for Cornerstone for many years, and we have never had any complaints of this nature from any other tenant.On December 2, 2016, the tenant called, complained about the repairs again and demanded another creditCornerstone rejected that demand, but agreed to send its Field Manager to the property to inspect for any deficiencies.On December 6, 2016, the Cornerstone Field Manager, together with two service technicians went to the propertyHe identified some issues that needed to be repaired and directed that they be promptly completedAs specifically noted by the tenant, " the work crew who was here to repair was amazingThe work was done correctly, they were professional and clean."Cornerstone's PositionThe subject property is a bedroom, bath home, with approximately square feet of living spaceThe lease signed by the tenants is in the name of husband and wife onlyNo other tenants are identifiedThe lease includes a monthly fee for one dog, and also provides that no additional tenants may occupy the premises without the knowledge of the landlord.When the Cornerstone Field Manager came to inspect the property, he discovered that there were adults, children and large dogs living in the propertyThe tenants were unhappy to hear that they were in violation of the lease because they only claimed to have one dog, and were only paying a rental charge for one dog.Based upon the terms of the lease, Cornerstone could have sought to have the tenants evictedIn the alternative, Cornerstone could have raise their rent by at least $per month to account for the two additional undisclosed dogsDespite having these options, Cornerstone elected to allow the tenants to remain in the premises and did not seek to raise the rentSince itwas the tenants that were in clear violation of the terms of the lease, we believe they should be grateful that Cornerstone was so accommodating.Despite the kindness extended to the tenants by Cornerstone, on December 12, 2016, the tenants called Cornerstone and demanded another creditUpon learning that Cornerstone wouldnot be extending any more credit, the tenants filed a complaint with the Revdex.com.The tenants' complaint in this matter is a bold attempt to have Cornerstone simply give them money for no reason whatsoeverIf the tenants truly believe that they are entitled to recover anything at all, we would suggest that an action in small claims court would be their best recourseIn that event, Cornerstone will very likely bring a cross-complaint, seeking to recover the additional rent that would be owed due to the undisclosed dogs kept by the tenant.There has never been a breach of the warranty of habitability, as proven by the fact that the tenants remained in occupancyNotably, the tenants now state that they wish to remain int he propertyAll they want is money for no reason at all.Cornerstone Homes, Incworks tirelessly to provide decent housing at an affordable cost,to all who need itCornerstone makes every effort to keep every house in good and habitable condition, and responds promptly to every request for serviceCornerstone was, and continues to be, responsive to the needs of our tenantsMoreover, Cornerstone displayed compassion and understanding toward the tenants, even when we learned that the tenants were less than honest about housing people and dogs in such a small houseIn response, the tenants now simply demand that we give them back all of their rent.Under the circumstances, Cornerstone Homes, Inccannot and will not agree to return any additional money to the tenantsWe trust the foregoing However I would like the company to know that we at no time had 7 people living here.  We had two family members staying with us for about a week.  So at no time was there 7 people staying.  As for the 3 dogs we must have misunderstood the 25.00 animal fee and appreciate that rent was not raised. Two of these dogs are emotional support animals for myself and my son.  At this time I would like to just move forward.  I,  [redacted] was diagnosed with Stage IV colon cancer this month.  I do not wish to continue a fight as the repairs have been done and important right now is my health any my children.
