*** *** *** *** hired Cornerstone Masonry LLC to pour a garage floor, basement floor, stoop, stonework on the outside of the home as well as the interior
fireplace.
On 10/25/2013, I discussed with *** ***, my concern about the height of the drain in the garage floor. A standard pitch for concrete is 1/inch per foot. In order to obtain this pitch, the drain would need to be placed at least three inches below the top of the foundation wall to achieve the proper pitch. I informed him that I would not be able to get the result that he wanted with the existing drain height. At this point, I suggested cancelling the scheduled pour to discuss the issue with the general contractor, plumber, and owner to reach a consensus. I informed the homeowner that this would also push back the pour date approximately two weeks. The homeowner did not want to do this so we discussed other options. *** and I discussed pitching the concrete the slight amount that was present or pouring the floor flat and having pitchonly in the immediate proximity of the drain. *** decided to pour the floor flat with pitch only in the immediate proximity of the drain.
On the date of the pour, 10/26/2013, I reconfirmed with *** (and he agreed) that this was the manner he wanted his concrete floor poured. The homeowner first alerted me to the concerns about their concrete on 1/12/2014. Up until 1/12/I had done other work on their house and *** never mentioned his concerns.
On 1/17/2014, once all work was completed on the house, *** stated that I should take money off the bill for stonework, for the concrete in the basement and the garage. I reminded *** that the work on the garage and the basement was done to his specifications. I reminded him I did not recommend pouring either floor in the manner he had requestedI asked *** what he felt was fair and he suggested taking $off my bill. I agreed to the price adjustment.
On 1/17/2014, I provided *** with the final bill. On 2/2/*** indicated that he had some patching he wanted completedThe patching was completed on 2/3/2014.
On 2/10/he complained again that the concrete in the garage was not to his liking and he wanted me to stand behind my work. I stated that the concrete in the garage was poured to his specifications. I should not be held responsible if he is not happy with his decision.
I also performed the following items for the homeowner which would have been considered extra by any contractor. However, I did not bill *** and *** for these additional services:
$Stone fill
$Pour step in garage, plan showed a wooden landing
$Reform front stoop due to a change from the plan at the homeowner’s request
$Sealing garage floor
$Heated concrete charges of $per yard for yards
$sqftstone difference from the numbers the homeowner provided to the actual sqfootage
$Savings from calling various suppliers to obtain the lowest stone price rather than going through the stone company they had selected the product from as I was able to obtain the stone at a less expensive cost.
$Grading around the house
In addition to the above, I drove to Manitowoc to pick up the hearth so the job could be finished sooner.
The homeowner was not charged for my time or gas for doing this. This allowed the homeowner to have the flooring completed without delay
Since the homeowner had not paid me for the work that had been performed, supplier called regarding payment, as my bills are always paid on time and not past due. When I explained that the homeowner had not made their payment yet and I had concerns about getting paid for the work, they indicated they could put a lien on the house for the material. They contacted the homeowner and informed them that if payment was not made, they would place a lien on the property for the materials. The lien was not in process of being placed on their property as my supplier stated they never sent out any notices of reserving rights to place a lien. At this point, I would be willing to offer an additional $settlement. However, Cornerstone Masonry’s attorney has recommend that *** and *** *** sign a confidentiality agreement and a release of liability as a condition of the settlement

The homeowners were well aware there would not be a resolution by going through Revdex.com as the homeowners are not willing and have not been willing to settle unless the full amount of money plus additional costs are received to have the garage floor ripped out and redone The homeowners wanted to use Revdex.com as a means to notify other individuals of the the poor work that was done by Cornerstone Masonry and how the owner took no responsibility for his actions His work is going to cause structural damage to the house in the near future The homeowners wanted to prevent others from having to go through the strenuous time consuming small claims process to recoup there money The homeowners also wanted others to be aware of Cornerstone Masonry not paying there bills on time so they are not having to deal with a possible lien going on there property Again Cornerstone Masonry did not pay his bill for concrete materials The bill was due on November 31st and Cornerstone Masonry did not pay the pill until February 4th Therefore a lien was in the process of going on our house due to irresponsibly of the companies owner *** *** The homeowners have proof that Cornerstone Masonry's bills were not paid and proof that the homeowners paid Cornerstone Masonry in full for all materials and labor for that specific job as well as all others

Based on the response from the homeowners we will not be able to come to an agreement that would be satisfactory for both parties.  The homeowners have a very different recollection of the conversations and what was said/agreed upon.  Every time I have offered to reconcile they have increased their demands to a point I cannot accommodate.
