we are disputing the charges and the lack of information provided at the time of service.On April 6, 2015 at our home on [redacted]., [redacted], MA we had an oil leak from an external tank in our back yard. After the fire department and Dept of Environment Protection (DEP) arrived, we contacted Corporate Environmental Advisors (CEA) as we were advised by the DEP representative that we needed someone (an LSP) to conduct the initial emergency response. We paid $250 up front and signed a paper indicating that services provided could cost up to $1000. We have now received a bill for $750. We are disputing this amount owed because 1.) We question the services provided and 2.) we were never informed what we were paying for and the rate at which we were being charged. We were clearly at a disadvantage being completely ignorant of the type of services being rendered. The only written information provided was a sheet of paper my wife signed with no itemization of services. It seems that a professional in their position ought to have provided minimal information of what we were being charged for. The total amount of time spent on site was not more than 3 hours. At a later point in time, CEA gave us a written proposal to actually clean the spill which we did not accept. That proposal in no way should have affected any charges for services performed on 4/6/15. The following represents a list of specific concerns we have regarding the Invoice #XXXXX1. we were charged for their travel time. We were not informed of this.2. Technician #1 billed for application of "Speedy Dri and 5" sausage." According to Fire department report, the fire department applied the Speedy Dry and three 8' booms. CEA is charging us 4 hours at $50/hr for this. They are also charging us for these materials for total of $240. 3. Charges associated with the "Senior Geologist" include:a. "Correspondence with LSP" - what does this entail?b. "Prepare field auth. Form"- what form?c. "advise owner"- really?d. "correspondence with LSP"- what does this mean? They were here for 2-3hours. There was no "correspondence" that are aware of e. "collect soil sample for disposal analysis"- we are unaware of CEA taking any soil samples and performing any analysis.f. "Prepare lab chain of custody"- again, no work beyond the 2-3 hours on site was performed to our knowledge.g. "coordinate soil disposal analysis"- not clear what this refers to. h. There are a number of charges within the invoice that we are not questioning such as the time of the LSP and other charges. Note that the form that we signed on 4/6 only states that they will "conduct initial emergency response fuel oil spill stabilization." The cost of cleaning this spill up is expensive and our home owners insurance will not pay for any of it. We simply do not want to pay more than is reasonable for what was actually done. If we were informed of these charges in any specific way, we could have made informed decisions. Thank you for any help in communicating with CEA and hopefully to significantly reduce these charges.Desired Settlementwe are expecting that the invoice be reduced by at least half.Business Response On June 15, 2015 Corporate Environmental Advisors, Inc. (CEA) received a complaint that had been submitted to the Revdex.com (Revdex.com) regarding CEA's invoice for emergency response activities performed at the[redacted] property in [redacted] in April 2015. We offer the following background and information for your consideration.On April 6, 2015 a neighbor noticed fuel oil on the ground and called the Fire Department who discovered that an above ground oil tank behind the garage located on the property had leaked an unknown quantity of fuel oil onto the ground surface. The [redacted] Fire Department notified the Massachusetts Department of Environmental Protection (MassDEP) of the release and a MassDEP representative inspected the release area. The MassDEP representative concluded that the quantity of the release was likely greater than 10 gallons, that Immediate Response Action (IRA) activities were necessary and advised the property owner of their obligation to hire a qualified cleanup contractor and Licensed Site Professional to perform and oversee the IRA activities. MassDEP provided you with a list of several qualified cleanup contractors. The property owner authorized CEA to perform "initial emergency response fuel oil spill stabilization activities" on a time and materials basis for a not-to-exceed amount of $1,000 without further approval. A retainer in the amount of $250 was provided with the executed agreement.On Monday, April 6th CEA was directed by MassDEP and the property owner to perform the following release stabilization activities:a) Place oil sorbent granular media (clay absorbents) into the oil tank to soak up remaining oil and prevent additional oil from being released.b) Place oil sorbent granular media under the oil supply line and filter to wick up and adsorb oil on the ground surface.c) Place oil sorbent booms along the down slope side of the release to adsorb and prevent further migration of the release. d) Cover the oil tank and release area with polyethylene sheeting to prevent casual contact with oil contaminated surficial soil and to shield the release area from water induced infiltration and migration.As directed, CEA personnel performed the release stabilization activities listed above. In anticipation of future soil excavation activities and to allow live-loading of excavated soil into trucks, a representative sample of oil impacted soil was collected for chemical testing of petroleum hydrocarbons. Subsequently CEA issued invoice XXXXX dated June 2, 2015 for the initial emergency response fuel oil spill stabilization activities performed. The time and material charges associated with the release stabilization activities totaled $1,510.00 however only $1,000 worth of services were invoiced since the maximum authorized amount was $1,000. The materials included on the invoice were in addition to the materials used by the [redacted] Fire Department. As is customary practice in the industry, travel time was included. The invoice has already been discounted by $510. As a good will gesture, we are prepared to further reduce the invoice amount from $1,000 to $843.75 by reducing or eliminating charges for travel time and non-field time. This represents a 45% reduction in the time and materials charges for the services provided.
