HelloMy name is [redacted] and I am the owner of Cortez Auto SalesI am emailing you in regards to the letter you sent me on May 9, in regards to complaint ID ? The customer in question, [redacted] did come to my place of business and expressed her concerns, however I explained to her again that when purchasing a used vehicle from my lot, that they are as-isI have attached multiple forms to this email, including copies of the contract that she signed that also states this? When she came onto my property, she had a very hostile demeanor despite my effort to explain to her that the vehicle was sold as-isShe mentioned that there were multiple recalls on the vehicleI then tried to tell her again that used vehicles are sold as is and that this should have been taken into consideration prior to purchasing the vehicleI have had a couple of customers in the past who also had issues with their vehicles, but they understood that they were sold and made arrangements to fix them? In the one month that this vehicle was in her possession, she managed to put 3,miles on the vehicleAs with any vehicle, this can create wears and tearsIf a vehicle is not cared for properly, including a brand new one, issues may ariseMs [redacted] did state that she would be contacting legal counsel, but I have yet to hear from themShe told me she would no longer be making payments on the vehicle, despite signing the contract stating that she would? Due to not receiving any payments and her account now being past due, I sent her repossession paperwork via certified mail to the address she provided to me on the contractThe letter was then mailed back to me and was unable to be deliveredIf she did have a change of address, she failed to provide me with the updated one? I understand that Ms [redacted] would like her $down payment on the vehicle refunded, however I am unable to do soWhen she purchased the vehicle on March 24, she was made fully aware that the vehicle was being sold as-isShe had the right to inspect the vehicle and test drive it prior to making the purchaseIt is not my fault if she was unhappy with the purchaseThere was also a contract cancellation option offered to her at the time of purchase, however she declined this option? As a resolution to her issues with the vehicle, I have decided not to move forward with legal actions but as stated previously I will not be able to refund the down paymentThe vehicle is currently on my lot and in my possession so she will no longer need to make these future payments, despite being $past dueNormally I send customers who are in arrears to collections, however I will not be doing that with Ms [redacted] .? ? I am rejecting this response because: he did not sell me a safe running vehicleI did not write down the mileage when I left the car at the lot however I know I did not put over miles on the vehicle in the days that I had itFrom the tenth of April to the 17th I couldn't drive the car due to the oil leaking so badHe also stated that I test drove the car yes I did however when I asked why the car smelt as it was over heating he told me it was do to it sitting so long and also told me the car was in good running conditioni signed one document and remembered I want to know why the ABS light was on and why the ac did not work he stated it was to late, I had signed one paper and the car was sold as isHe never once offered me any type of recall Information nor did he offer a vehicle history ReportHe allowed me to drive off the lot with no type of dealer plates or license plates only the sales paper in the passenger side of the front window and due to not have a plate as required by the law I was pulled over twice with in a week and had my the car searched I did do proper maintained on the vehicle if I hadn't than how was I able to know of the issues with the oil and also the fact that there of the five lug nuts on the front driver side tire were strippedWhich left me two lug nuts on that side of the vehicleI went to the car lot the week of the 10th of April he told me to bring the vehicle in and he would have it looked at and fixed cause as he stated he wants to help me seeing I was a single mother and needed the vehicleThat's why I took the car to the lot on Monday April 17th Yes I was upset but only after I asked him what was going to happen with the car he denied that he had just told me to bring it in to have the issues resolvedAnd when I asked him if he was aware that the vehicle had at least ten safety recalls and he told me he wasn't aware cause it is not his personal vehicleI took offense due to the fact he is selling vehicle that could put someone's family I dangerAnd at that moment the family was mineHe than told me I got it as isThan I told him I would contact a lawyer and let him know how I will proceedYes I don't deny I have not paid the payment in which my first payment was due on 4/15/but I did not pay cause I felt why should I pay for a vehicle that is not runningAnd had turned it in two days after the payment was dueWhen I called the following week to check status I was told he was not in the office when I did reach him he hung up on meAll I want is what is only rightThree days of driving the car the check engine light came onI didn't know my rights as far as buying a car off a used car lotI have had to pay others for gas to get my children back and forth to schoolAnd my employer had called me to inform me that there was work and I was needed and couldn't even take the work due to not having a carI do not want to get another vehicle off his lot seeing he has a bad way of doing businessWhat I do need is to be able to put the money that I gave him down on another vehicleI'm a single mother of three I do not receive child support nor do I received cash aid from the governmentThis has made it hard on me to provide for my familyAnd it does not bother him at allHe was aware that the car was sold and was not in a condition to be soldIt's not right that he can do this and get away with it
