you [redacted] find a detailed description of the events of the project as outlined by our foreman, Ryan [redacted] During the course of the work, rock was encountered immediately below the foundation which necessitated demolition in order to accomplish the pile installationMr [redacted] was informed of the additional required work and advised that he would think about itOn Monday, August 10, 2015, Mr [redacted] advised our foreman, Ryan, that he was cancelling the contract, and asked them to backfill the excavations and replace items as they were before our arrivalThis was done per his requestMr [redacted] also advised Ryan to prepare an invoice for the work completed and he would issue payment for same Ryan contacted our office and advised of the situation with Mr [redacted] The amount invoiced to Mr [redacted] represents our standard rate for daily work activity per crewThis amount was $2,Mr [redacted] issued payment for this amount There were many unusual situations that occurred with our crew during our limited time on this projectVehicle breakdowns and traffic accidents involving workers are not typicalHowever, they did have an impact on timing during the first portion of this project As we had not breeched the contract, when Mr [redacted] cancelled the contract, we could have moved to enforce the entire amount of the contractHowever, this is not the way our company operatesAlthough we had more than one days involvement on the project, we only billed for one dayHad we not been on the [redacted] project we could have had our personnel on other projects and could have produced substantial additional revenue for our firmWith this in mind, I believe the amount in which Mr [redacted] was charged was reasonable, particularly in light of the fact that it was Mr [redacted] wishes to terminate the contractFurthermore, if Mr [redacted] was dissatisfied with the amount charged, the time to have discussed the amount was the day our crew replaced all work lunch Andrew call me and told me that there was a bunch of rock that was going to need to be removed to install the piersI let him know I would be there after lunch to take a look and discuss the situation with the homeowner At around 12:Andrew called me and told me that the truck would not startI went and picked them up on the other side of Springfield and went to the [redacted] home I took a look at what was going on and went to discuss it with Mr [redacted] I spoke with him about Power Lift's rock demo pricing and he said he was going to think about itI spoke with Darryl [redacted] the Estimator for this project and we discussed the rock issue By this time it was approximately 4pm and I asked if it would be ok to come back early in the morningMr [redacted] said that would be ok We did not arrive as early as I had hoped Jessie and I arrived right around 8am My workers had been in a car wreck that night and I was at the hospital most of the nightI woke up lateI had Jessie with me as he did not go to the hospital at the time of the wreck Andrew had cuts on his face and could not see out of one eye, (see pictures attached) Mr [redacted] our previous project, had decided he wanted to add a little more work and we still had a little of the previous work to finish upI had left there a little after noon on Friday and had not been able to returnBeing shorthanded from the injuries from the wreck, I was not able to work on both projects on SaturdayI did not tell Mr [redacted] we would be back at 4:00pm on SaturdayI told him that if it wasn't too late on Saturday when we completed the prior project that we would come back and work, but that I would call him either way to let him know what was going on I do not remember the exact time I called Mr [redacted] but I do not believe it was 8:30pm I called to let him know we would be back on Sunday morning and he told me they would be in Church and he did not want us there if they was not there On Monday we arrived at 7:45amAt around 11am, Mr [redacted] (the prior project homeowner) called to tell me he was home, (he had been out of town) and if I need to collect the check on that job, I needed to come now because he was on his way out of town againI left to go collect on the prior projectI told Andrew and Jessie to continue working and wait for me to get back to go to lunchI returned to the [redacted] job at around 12:to pick them up for lunchI had to go under the house to get them, because they were still working and digging under the houseWe left for lunch around 1pm We didn't leave for lunch until 1pm and we took an hour lunch, returning to the job at 2pm I never received a phone call from Mr [redacted] I am not sure why Darryl did not answer Andrew told me Mr [redacted] asked why we took such a long lunch, Andrew told him we always take an hour for lunch Andrew called to tell me Mr [redacted] wanted to talk to meI had left the job site to go to the bank to deposit the check I had picked up earlierI told Andrew I was turning around and would be back there shortly I never received a call from Mr [redacted] Mr [redacted] asked me why we were gone so long for lunchI told him we normally take an hour lunchHe thought that Andrew and Jessie had left with me at 11am when I went to collect on the prior job, because they turned off the welder when I left and went under the home diggingHe thought they had left with meI let him know that they were still there during that time working and that I had ran to collect on the prior job and came back and picked them up for lunch at 1pmHe then told me he did not want us to finish the job Mr [redacted] asked us to fill in the holes and repair the liner in the crawl space and to give him a [redacted] for the work we had doneI went to my truck to call the office and let them know what was going on We backfilled the holes and replaced the liner in the crawl space and loaded everything back on the trailer [redacted] called me and told me to letter, I out lined the work of said company and the fact I was dissatisifed with their workSaid company has a copy of that complaintIn that letter, out lined the situation, how it was handled, and the various reasons we were dissatisified The reason for my original letter was the fact that nothing was completedThe young men that were assigned to us said they had dug of the holes assignedThis typical daily rate, of which Mr [redacted] was only charged for one day Mr [redacted] chose to cancel the contract and we did as he askedMr [redacted] certainly had other avenues than cancelling the Gentlemen:
