In response to [redacted] most recent letter, it is apparent that with his recollections of the events, I must response with the truth once again to prevent his misconceptions from resonating[redacted] never furnished me or my workers with a legible copy of his survey [redacted] could not find his plat the day I was there requesting to see it[redacted] found it later and faxed it to me, but it was too blurred to read[redacted] gave me the measurement he could read over the phone, but not enough to go by to locate the corners[redacted] did not leave a copy of the survey the day my workers installed the fence, nor did he furnish us with survey stakes[redacted] was told that without the property pins or a survey that we would install the fence per his contract measurements that he agreed to[redacted] had designated the spot for the right rear corner which was 60’ from the house corner and was advised that without the property stake, we would use that information in lieu of a survey.My workers did not, nor would they ever provide derogatory “information” to anyone about my suitability as a person or contractorI am a very respected and knowledgeable contractor who has decades of experience ho has grown up in this business from childhoodJust ask [redacted] who works for [redacted] ***He came to me for his fence installation and could not be happier with the experience.Never has this sort of thing happened in years.When [redacted] said to me that first day, where the fence got installed was not his problem I should have walked awayEven the day I asked him to put a copy of his survey plat on his front porch so I could come pick it up, after driving hours round trip in the rain, in 5’oclock traffic .he did not leave it on the porch for meEvery aspect of this job was made difficult by his on-cooperation and attitude, bad language and bullishness.I have mailed back a $check to his very kind and understanding wife, who has often acted as a voice of reason during this entire process Hopefully this will also give her some much needed peace

to him that without them we were just guessing and that he needed to either
find them himself before we came to install the fence or have
his property

could not be accurate with the fence placement without itHe said that that
wasn’t his problem and that we were the fence professionals and if we got it
wrong then it was on usI said fence professionals, yes, surveyors, no.I asked him to hold the other end of the tape measure where
he believed his property lines to beI asked him to try and locate the pins
himself in the weeks to come & than if we saw no pins we would take those
measurement that I was putting on the contract and we would use themWhen he
was holding the tape measure in the right rear corner of his property, he said
he didn’t know where his corner was because he saw no pin…He asked what the
measurement was where he was…I told him 60’.Weeks later when he requested installation, my men found
there were no corner survey pins, so my men dug around trying to discover them
in the thick sod with no luck, so they took the measurements from the contract.Months later when the rear developer surveyed his property,
he discovered that ** *** right rear fence corner was 14” over on his property,
as was his sprinkler system** *** was an unpleasant and disagreeable with
his as he was with me and threatened to take him to court before he would move
the fenceThis put the developer in a big bind as he had a buyer and their closing
date was close and would have to be cancelled causing much inconvenience to the
many people involved** *** contacted me to inform me I had to resolve the problem
for free and I told him since he refused to have his property surveyed and
supply us with the property corner pins I requested, that I would move the 138’
of rear fencing but that I would ask him to help out with the expense of the removal
and re-installation (concrete and gas) he refused saying it was my faultHe stalled
the developer until the last moments, so the developer contacted me and said he
would cover the cost of the labor if we would rush out there the next morning
before they were to closing that same morning.*** *** stepped in since her husband was so disagreeable,
and called me and said she would pay the $I wanted to help cover expenses
so the problem could be resolved.Because the situation did not get resolved until the last
minute, there was no time for me to obtain a *** *** ticket which meant that
we had to pull out the fence one trip and had to wait until the next week and
make another trip out there after my ticket cleared to reinstall the fence,
costing me even more money, time and gas.I regret the emotional stress this caused everyone involved
I don’t know how much more direct or forthcoming I could have been with my
recommendationsI even offered a surveyor’s information for ** *** to
contact

After reviewing Ms*** response, It is clear that she missed the point and I reject itThis was about her unwillingness to correct her mistake and charging me for itIt was never about the workmanshipShe is right about one thing, not only should she have walked away, SO should IShe charged $cash for her job and was paid TIMELY and as agreed upon, not by my wife, but by ME! She could have avoided this entire situation by simply righting her wrong, instead she chose the difficult optionAs an FYI, I'm well of the age that my time is better spent dealing with positive solutionsShe should rest assured that I would not recommend her business, not because of the workmanship, but her business practicesHappy New Year

I have reviewed the offer and/or response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Mrs [redacted] detail of events are about as inept as her business practices. At no time did I ever refuse a survey. She had the orginal survey in hand but apparently lacked the skill to read it. My conversation with the developer has absolutely nothing to do with her. Her own sub contracting crew has provided information on her unwillingness to accept responsibility or accountability for her inadequacies. The only resolution I seek from Mrs [redacted] and the only one she is capable of giving, is the refund of the $100 she accepted from my wife. She knew the developer had already agreed to compensate her for a speedier resolution. She is definitely staying true to her unprofessional business practices. I regret the day I saw her.
