When [redacted] and I walked through her yard, she had a drawing showing a pavers pad for parking a car, a paver walkway, a timber wall to retain the pad in the front yard She had a drawing showing a timber wall, a random laid stone area and a concrete pad for on the side of her house *** told me she only had a $6,budget So I worked out how far that would go and told her what $6,would cover (It did not cover the stepping stones walkway and most of the work in the side yard) When we met, I told her that the timbers would not support the pavers properly as they move more and deteriorate and I recommended changing them to Keystone wall I also told her that what she wanted would cost more then $6,and asked her what was her first priority She then said she could go up to $8, I then gave her a bid for $7,990.00, which included excavation, a pavers drive or pad, a pavers walkway, a retaining wall in the front yard, a retaining wall in the side yard, installing some rocks around the existing ditch, grading out the shed pad and preparing it for concrete, and a stepping stones pathway from the front deck steps to the back concrete landing [redacted] approved the bid and said go ahead and do the work In the discussion she said that she would plant her own ground cover and sod where ever she wanted them We then discussed colors she would want in the pavers.Later we sent up a contract delineating the work discussed which had a random paver and color in it which is standard until the client chooses the exact paver they want and she signed it and sent it back I then took up a few paver samples in the color she wanted She chose the paver and color prior to starting the work.Our crew then performed the work Towards the end of the job [redacted] said to the Forman I thought you were pouring a concrete pad and doing a stone patio or stone over most of the side yard Our Forman said that we were only contracted for stepping stones and to prepare for the concrete pad and that you (***) was suppose to lay any grass and ground cover [redacted] then talked to the Vice President of operations (Nate) who they worked out that Cottonwood would lay sod for her for an additional $ [redacted] agreed and the crew finished the work.After the work was complete, the office called to collect the check and [redacted] informed them that she did not have enough money and that she would pay what she could and then send the remained when she received her next pay check.When we did not get the check in the mail as [redacted] promised, the office called to see when we would receive the final payment [redacted] would not answer the phone or return any phone calls The office called for almost WEEKS with NO return phone call and she would not answer the phone.Then [redacted] sent a letter stating similar concerns as she outlined in the complaint So, the office called [redacted] to try and resolve her concerns with NO return calls again.Then Dan drove by ***'s house and knocked on the door to see if he could resolve her concerns She again stated the similar concerns Dan showed her the contract and said the bid and contract is and states it is for a stepping stone walkway from the deck steps to the concrete pad and is not a patio He said it was also only to prepare for the concrete pad [redacted] said that she doesn't know what a stepping stones pathway is She stated that "How am I suppose to know what a stepping stones pathway is?" Dan then said that there's know way that he can know that she doesn't know what a stepping stone is unless she asks or says she doesn't know or asks what it is Dan told her he was sorry she didn't know what stepping stones are and then googled stepping stones and it pulled up similar paths as to what was installed at ***'s house [redacted] said she didn't want to look at what google says the stepping stones are that she wants the whole are to be stone Dan then told her that the stepping stones pathway was only about $of the contract and that an entire stone patio could not be built for that kind of budget [redacted] then showed Dan the drawings she had done and how it showed a stone patio area To resolve ***'s concerns [redacted] and Dan agreed that she would send a check in for $1,instead of the amount owed of $1,on her next pay check She still could not pay her bill at that time.Later after the date in which she agreed to pay the $1,had passed and there was no check received, our office called *** She answered the phone this time and said she had not mailed the check and brought up the stepping stones concern and that she was going to make a complaint to the Revdex.com.If a contractor meets with a customer, verbally says he is going to install a stepping stones walkway and then puts it in writing and the customer signs it indicating she acknowledges what work is going to be done and how much she is going to pay for that work to be done, then the contractor performs the work as described in the contract, then how is that deceitful, dishonest or anything from the way of doing business We had no intention of being dishonest Only tried to do good work and do what we said we would do That is what we did
