*** was fine, showing no signs of anything wrong when you put him on your trailer. The driver did say that the horse we picked up was soaking wet with sweat when he came off of your trailer. You signed the acceptance form when you took ***. If he has a capped hock, he did it in your trailer not ours. Our trailer is lined and padded all around. If you had not agreed to take him the last time we talked, I certainly would not have wasted a good horse, not to mention the expense of shipping him to you. The horse that was delivered down there on the same trip did not have any problems, and was in the same trailer with *** the entire trip. He is fine. I think you let *** overheat in your trailer and caused all of this trouble. If he capped his hock, he probably did so in an act of desperation to get out and save himself. He always was a quiet and gentle hauler for us. You can get a horse overheated and cause sickness and brain stroke in less than a few minutes. (Just like a lack of oxygen.) If he refuses to load, this is probably why. He always loaded and unloaded fine for us, as he did for you the day you picked him up. We hate that this happened for you (but mostly for the poor horse, because he was a good one), but none of it was anything to do with anything we had control over
Just because I can, and that I try to help people (although I do not recommend you be a horse owner), I might and I stress the term MIGHT (as I’m not saying I will), but MIGHT give you another horse provided you handle all of the shipping and hauling and cost of the vet check, blood work, coggins, and health certificate. IF I give you another horse, it will not be as a trade for ***. If he has had a heat stroke, he will no longer be of any use to us.

To Whom It May Concern:
This is a response on behalf of *** Farms in reference
to the complaint received by *** ** *** (Revdex.com Case # ***).
Our relationship with Ms*** began back in May of
2015. Ms*** purchased a gelding
that we had for sale named *** *** (***) on May 6, 2015. We received the wire transfer of $on May
6, 2015. This was for the purchase of
*** ***, as well as the cost of delivery from ***, *** to North
*** ***, *** (approximately miles, one way). Once the wire transfer was receive, I emailed
Ms*** a copy of the purchase agreement.
She signed the agreement, scanned it, and emailed it back to me later on
the 6th. We delivered *** *** to Ms*** at *** *** *** in *** *** ***, ***, per her
request, on May 14, 2015. She signed the
form stating that she received the horse that she purchased from *** Farms.
On May 28, 2015, we received an email from Ms***
stating that she was not completely satisfied with *** ***. On this particular date, we were all out of
town due to a death in the family. Once
back to the office on Monday morning, June 1st, I responded to her
email and apologized for the delay. I
told her that I would pass her concerns along to Mr***. Later the same day, I sent her another email
to let her know that I had passed her concerns along to Mr***. He asked me to let her know that we wouldn’t
have any problem honoring the agreement and replacing *** *** with another
horse. He asked me to let her know that
if she saw anything on our website that interested her, to please give him a
call.
On June 2nd, I received an email from Ms***
changing the criteria that she wished to have in a horse due to her mounted
patrol unit ‘folding.’ I emailed her on
June 3rd, and told her that I had passed her email along to Mr
***, and he asked me to let her know that he would be working on finding her a
horse that suited her criteria.
On June 4th, I received an email from Ms
***. She asked us to hold off on
finding a repl***ment for *** ***.
She said that she had a friend that would like to work with him, and that
her husband didn’t want her to give up on *** ***, yet. I emailed her on the 5th, and told
her that would be fine with us, and asked her to keep us updated on how things
were going.
On June 20th, I received an email from Ms
***. She said that she had decided
that *** *** was not going to work out.
I responded to her on Monday the 22nd, and told her that Mr
*** would be in touch soon. She also
sent a separate email on the 20th inquiring about a horse that we
had named ***. I responded to this one
on the 22nd as well to let her know that *** had already been
sold.
I received an email from Ms*** on June 23rd
inquiring about several of our horses.
Several of the horses that she inquired about were already sold. However, Mr*** asked me to let her know
that she thought that three of the horses that she mentioned may work for her,
and asked me to find out which one of the three she liked the best. I sent this email on the 24th. She responded the same day, and stated that
she like *** the best.
Between all of the written correspondence, she had several
phone conversations with Mr***, as well.
She agreed that she would like to exchange *** *** for ***. I emailed her on June 29th to let
her know that we could deliver ***, and pick up *** *** on Thursday,
July 2nd. I wanted to make
sure that she had the proper paperwork in order for us to be able to pick up
*** ***, and transport him back to ***.
She let me know that she had the paperwork ready for the transport. Via emails, we agreed to meet at the same
pl*** to make the exchange as the first delivery (*** *** *** ** ***
*** ***, ***). I emailed her the
morning of July 2nd to let her know that *** was on his way to
*** *** ***.
Our transporter met Ms*** at *** *** *** the
evening of the 2nd. He picked
up *** *** (who was soaking wet with sweat when he unloaded off of Ms
***’s trailer), and delivered *** to Ms***. She signed the form receiving ***. He was delivered with a good coggins, vet
check, and a health certificate (as all of our horses are). I have included a copy of the vet check that
was performed on June 29th by *** *** *** *** stating that
*** was sound and healthy.
Just as a side note, we delivered another horse on the same trip
as *** to ***, ***. He rode in
the trailer with *** the entire trip and was delivered after him. He was healthy, with no health problems. He is still healthy, and has not displayed
any signs of sickness
I received an email from Ms*** on July 15th
stating her dissatisfaction with ***.
I have included this email, along with all of the other email
correspondence. I passed her email
along to Mr*** the very same day. He
tried to reach her by phone, but was unable to reach her. He asked me to send her a response on July 16th,
which I have also included.
Ms*** contacted the *** Department of Agriculture,
who in turn sent an inspector to our farm.
They found no problems. It is a
very unfortunate circumstance. However,
as with any live animals, anything can happen at any time. When we delivered ***, he was healthy was
not displaying any signs of any problems.
After Ms*** took possession of ***, we can only speculate what
happened. From what she says, it sounds
as if he got too hot in a trailer, which can happen very quickly (especially in
the summer in southern ***).
Although Ms*** said that her vet said that *** had a heat
stroke, Mr*** still told her that he may be willing to give her another
horse, although we wouldn’t be obligated to.
If *** has had a heat stroke, he would no longer be of sound
mind. We have done everything that we
ever told her that we would do, and even offered to talk with her about giving
her another horseWe hate that it happened, and never want to have
dissatisfied customers, and we hope that you can see that we have tried to do
what we can to make the situation right, within reason. Please feel free to go to the testimonials

Good afternoon.  I
apologize for the delay in my response to the rebuttal.  I just realized it was made this
morning.  I have spoken with Mr. [redacted] in
regards to the rebuttal sent by [redacted]. 
Mr. [redacted] said he was never rude or condescending to her.  He is sorry if she feels that way, but doesn’t
understand why she would purchase the first horse from someone that is rude and
condescending. 
In reference to the horses being misrepresented on our
website, we strive to list the horses and represent them as honestly and faithfully
as we can.  All we know for certain about
each horse is what we experience with them. 
We try to do video on every horse that we sell.  However, we stay very busy, and sometimes we
don’t have the chance.  We wish that we
had a video of [redacted], as we had of [redacted] (the first horse she purchased
and traded back to us) as he was a good horse. 
We have offered horse more than four horses on trade, including a
gelding named [redacted], who also has video on our website. 
In reference to the amount of time that [redacted] was on the trailer,
he left our barn the morning of July 3rd and was delivered to her
later the same day.  He was taken to the
vet on June 29th for the coggins and vet check.  On July 1st, we got the health
certificate for travel on him.  However,
he didn’t leave our barn until July 3rd.  She was actually the first delivery on the
trip. 
In reference to the ‘speculated’ heat stroke that she
mentions, she is the one that stated in her email on 7/15/15 that he was “extremely
sick with pleural pneumonia (contagious), heat stroke.”  She was the one that mentioned this, and has
since backed off of her story.  It keeps
changing.  Now, she claims he has
shipping fever.  As for what her vet
speculated, that is between her and her vet. 
[redacted] never told Ms. [redacted] that [redacted] had a cold.  It is possible that the hauler may have told
her that, but he shouldn’t have because we didn’t.  The inspecting agent from the [redacted]
Department of Agriculture that inspected our animals, because of her complaint,
found nothing wrong.  Mr. [redacted] did speak
with her that afternoon via phone, and after a few minutes, she said she decided
she wanted to go ahead and keep [redacted]. 
We have no way to prove it, because it was a phone conversation.  However, we do not have reason or time to
make this up. 
In reference to the horse having thrush, he showed no signs
of it with us prior to her taking possession of him.  Neither did the inspecting veterinarian find
signs of it when the vet check was performed four days prior.  Any horse can be said to have some level of
thrush at some point.  However, it seems
as if it was as severe as she states, that it would have been noticed by the
inspecting vet. 
As far as her calling us an Internet Scammer, that is
defamation, and if she doesn’t correct it speedily, then we will pursue legal
remedies to do so. 
In reference to trouble loading, we never had any trouble
loading or unloading [redacted].  He would
always walk into the trailer, and back out as he should.  In reference to the gash on his forehead,
this is new.  We haven’t heard of this
until this rebuttal; something else added to the story.  He didn’t have a gash at the time we
delivered him.  If he does now, he did it
in her trailer or in her barn.  In
reference to her statement regarding her trainer’s opinion, [redacted] said he didn’t
realize that her trainer used to own the horse. 
(I am sorry, but we are getting ill with this whole situation and lady.)
Again, in reference to us offering her horses with no
videos, the first horse that she purchased had video, and we offered her a
gelding named [redacted] on our website that has video, as well as others. 
In reference to her calling two days prior to tell us that she
didn’t want the horse, that never happened. 
Why would we spend the money to have a new coggins, vet check, and
health certificate done on him and have him transported all the way to her, if
she didn’t want him.  That is
foolish.  We would have preferred to keep
him, make video of him, and sell him for more money.  We are not hoping that anyone is stupid.  We did the transport for the exchange at no
charge to her.  We bore all of the
expense.  Normally, if a customer wishes
to exchange a horse, they are responsible to pay for the transport.  However, to try to appease Ms. [redacted], we
didn’t charge her. 
In reference to her spending $8,000, everyone was set free
by the 13th amendment and can spend their money how they choose.  We wish that we would have never heard from
her, as all of the trouble and aggravation that we have been through with her
is not worth $8,000. 
As far as her claims to him being underweight and dangerous,
he was definitely not that way when he left our care.  We didn’t have any issues with him and he was
in good health and good physical shape. 
As far as the hauler, ‘making her’ sign the acceptance for,
we are not sure how that can even be possible, it is foolish.  We just cannot understand why should would
have taken the horse to begin with if all of her claims are true (sick,
underweight, dangerous, hard loader, thrush, unsound, bitten and kicked up,
bitten and kicked up, lame, emaciated,  etc), why did she agree to take the horse and
put him on her trailer and take him to her home.  She could have refused to take the horse and
sign the form.  The hauler didn’t MAKE
her sign anything.  In reference to the
hauler RUNNING to his truck, we have never seen him run anywhere.  (Too many miles behind the wheel and too many
honey buns.) If in fact he did, we wish she would have gotten a video of it.  As far as her husband locking her in the trailer,
we are sorry about that. 
Again, in reference to her claiming that we lie and scam
people, that is defamation, and if she continues, she will hear from our
attorney. 
In reference to her claims to our testimonials page being
fake, that is completely false.  Every
single testimonial on that page is 100% real, and we have proof to back up each
one (including permission to use the testimonials and pictures on our
website.)  We do not use the last names
of our customers for their privacy.  We
do not want them getting multiple phone calls per day from just anyone that is
looking at our website.  That ought to be
self-explanatory.  We have never changed
addresses or phone numbers.  We do not
know where in the world she got that from. 
In reference to her claim of us not selling horses in state,
we sell as many or maybe more horses, in [redacted] as we do in other states.  I just scanned over the testimonials page of
our website, and it appears as if we have testimonials listed from about 19
different people in [redacted] who have purchased from us.  We get it right more than we get it
wrong.  We try not to even do business
with people like Ms. [redacted].  We can
usually detect them up front, but every once in a while we are fooled. 
Again, she mentioned the heat stroke, and says, now that he
didn’t have one. Once again, her story changed. 
You can make a horse seriously ill in a minute or two of being in a hot
trailer.  It doesn’t take long.  If he really is ok, as she is now claiming,
[redacted] said that he doesn’t mind exchanging [redacted] for another horse.  If he has, in fact, had a heat stroke, as she
initially claimed, we are still willing to give her another horse that
hopefully she could get along with. 
However, we do not give refunds, as is stated in the purchase agreement
signed by Ms. [redacted].  We are willing to
do anything that we ever agreed to do. 
Mr. [redacted] attempted to contact the Revdex.com (Columbus office) to
speak with someone regarding this case. 
He didn’t receive an answer.  I
referred to your website, and see that you are only open until 3 PM.  Mr. [redacted] asked that I get whoever is handling
this complaint to give him a call. You can reach him at [redacted].  He said that hopefully, he can shed a little
more light on the situation for you.
