CounterTop
Sales & Mrs [redacted] entered into contract on 05/13/2015 for
Granite countertops.
Mrs
[redacted] changed colors no less than five times. I took her and her
daughter to [redacted] and went over all the colors again and she
decided she had to have Colonial Cream. We made her...

sign off on the
stone selection.

 She
came to our shop and went over the stone and showed the stone cutter
where each piece of the counter would come out of each slab.
She
is a seamstress and wanted certain colors of the stone in certain
places, which we did . I even used extra stone from another job to
try to please her, which she did not pay for. We did everything she
asked for and that was agreed to in the contract.
Then
she added full height backsplash, which we did.
We
did not ask to be paid until she was happy with the job.
She
then paid for the job and we were done. (7/10/2015)
About
two weeks later she came into the shop and told me she did not like
the color.
She
wanted us to take the job all apart get other slabs that have more
gold in them and change the colors. This is not something that
qualifies as a warranty issue. What she is talking about is starting
over with a new color.
A
Granite install is like a jigsaw puzzle that you glue together, you
can’t take it apart without breaking it apart. I
told her how much it would cost and she told me she was not going to
pay anything.
When
someone buys a counter top, it is made to fit only the kitchen it is
made for.
It
is not a returnable item. You cannot return a counter top because you
decide you dislike the color you picked after it is installed. This
is why we have our customers go through our detailed process, as well
as sign off on the color you want for your countertop. ( See approval
form)
The
customer also signs a form that explains the faults of Granite so the
customer understands that Granite is not perfect. Granite has flaws
and that you accept these flaws or chose another stone.
Mrs
[redacted] never asked to cancel this service. Our contract explains how
to cancel the contract and the time line that it needs to be done in.
Once
we start fabrication of the stone for the kitchen, the customer is
responsible for paying for the job. She came in several times to see
how the job was going and was excited to get it done.
Frankly,
I'm puzzled. I went to see the job after the install, took pictures
and talked with the customer and she was very happy. Mrs [redacted] came
to our shop to pay the final bill.
I
called Mrs [redacted] up today ,09/24/15 and went over to her house. She
was mean and yelled at me the whole time I was there. I went to see
the drywall problems she has. I didn't find any and she couldn't show
me any. Same old story. This job is beautiful.
One
of the conditions in our contract states “We accept no
responsibility for drywall, wood or wood trim, tile or wall paper
damage”, We have wall spackle on the truck and try to touch up as
much as we can. In this case there is not any damage she could show
me.
She
told me that we scraped up the wall when we pulled out the old
countertop, Yes that happens almost on every job, Removing old
countertops can be difficult when the drywall and trim boards are
installed after the countertops where installed. This is very common
in Condos and apartments, but we hid that when we put in the full
hight splash, so the scrapes were covered up with the granite we
installed.
The
only thing that she could show me was where the drywall was not
square with the bar countertop. The same thing we have tried to get
her to let us fix before.(see picture)

The
drywall forces the granite out of square at the bottom.
This
was discussed at the time of install ,we wanted to cut out the
drywall to make the wall square and she said no.
So
the granite was installed with the seam wider at the bottom than at
the top.. That is the way she wanted this piece of granite
installed, she would not let us cut the drywall.
Mrs
[redacted] said that we would not show up for appointments, this is not
true. She would call and want us to come out and fix that seam, But
will not let us do what is needed to fix the seam.
We
have been back three times, its the same thing every time. If she
won't let us cut the drywall out of the way. I can't fix the problem.
She wants us to replace the stone, that will make it look even more
out of line. Besides, we don't have any of that stone available that
would match that color.
The
picture I am sending you shows where the three different pieces of
granite come together. This picture is blown up so the seam looks
bigger than it is. At the bottom its about 3/8 of an inch wide.
This
seam is in a place in the kitchen that to see it you have to go over
and stand in the exact right spot to see this seam. If you didn't
know it was there you wont see it.
Replacing
the piece of stone wont fix the problem, cutting the drywall will
make that seam line smaller. That seam has to be there. If she wont
let us cut the drywall ,nothing will change.
This
Job is very nice. Her contract has been fulfilled. This job is
beautiful, Go see it if she will let you.Mrs. [redacted]’s credit card company pulled money out of our account and
asked us what was going on with this job. We sent this letter in
response back to them and asked them if they had seen this job. Two
weeks later hey responded with the return of our money and a thanked
us for our cooperation.
