august 19th 2016 myself and my crew came to the site to pull weeds and fix what was destroyed by water when it rained and raise where it needed to be raised. we noticed that a company had driven through her yard and destroyed it. looked like an alley way through her yard. no where in the contract...

with them did it state that we were going to flag off yard or fix other peoples mistakes or screw ups. we did let them know that we did not say we would flag it off or fix other peoples mistakes but that we would be fixing ours and what needed to be fixed due to rain run off from the house. contract was not signed until july 20th 2016. so already halfway through the summer. final grade was at 6 inches like stated in contract, except in spots where you could clearly tell was driven over. also no one verbally stated we would flag their property. nor were we out there 6 different times. we have only been there 2 times. we have it all marked down on paperwork stating when, where, what time and what was done and what dates. [redacted] I stated that we fix what we destroy or mess up on our dime not yours, but to fix another companies problem needs to be paid for by you or the company who wrecked it. [redacted] we are running a legit business. [redacted] we tried to come up with a solution to meet  in the middle to only be talked down to [redacted]. contract states a $500 cancelation fee that the customer knew about. as well the fact that [redacted] are refusing to pay for equipment rental, labour, and materials as they are saying by-law they don't have to pay for it. [redacted] a bill sent out for the equipment charges,labour charges,material charges,and cancellation charges. [redacted] will have to pay now $6112.25 by the end of the due date of further actions will be taken to collect the balance.

The customers yard failed rough grade so they were put at the bottom of a very long list and they were notified about the list of people we had to do. This customer [redacted] [redacted] wanted my crew to start their yard even known they did not have a rough grade certificate and...

as well as customer kept on trying to change price on contract upon signing. Customer was sent an invoice on nov.9 for the stated amount which are all legit charges as the cancellation fee was mentioned to this customer upon signing contract. Which they agreed to. There was no threats made towards this customer and as well the companies policy is if you don't pay it does go to collections and possibly lien on house. As well customer changed design of yard after signing contract which is an additional charge for all those materials. [redacted] We have all receipts for all material for this property. I believe this customers I believe this issue may go furtherr but I am willing to work with these customers on their owing bill if they want.

He even phoned the city while he was at our house to check our rough grade certificate but the the city told him that we have to check with our builder. [redacted] he promised us that he will do our deck right away thinking that this is possible even though we still don’t have the rough grade certificate. May 25, 2016 - He and his crew brought lumber on our yard, left there for more than a week and took them away on June 6 without building the deck. We really thought it is possible to have the deck built without the certificate because he promised us that upon signing the contract. We didn’t have a lot of knowledge about landscaping and codes that’s why were asking him a lot of questions before signing the contract. [redacted]  As for the price, we negotiated the price with him before signing the contract but we didn’t change anything after signing. We talked about the price and the work that needs to be done and agreed on it upon signing the contract. Those information were on the contract. We didn’t changed anything. Cody was the one who made changes on the contract. [redacted] he told me that he will subcontract some of the work that needs to be done. He wrote the word “subbed out” besides some of the items on the contract. He informed me about it and agreed as long as the job will be completed. For the cancellation fee, there was no communication about the cancellation fee and this is not stated on the contract. I have the signed contract with me to prove it. And the invoice that he sent me, it is ridiculously priced. He needs to explain it. What is the equipment charge, quantity 2 for $960? What equipments they were? When we signed the contract, he knows that he will be needing equipments to do his job.  Any equipment he needs to finish the job is already part of the contract price that we signed. Additional topsoil? On the contract, he said he will do the final grade using topsoil and road crush but nothing stated that we need to pay anything extra. He guaranteed the final grade approval and I have text message and email to back it up. For the road crush, quantity 10 for $75 each? What he meant by that? 10 yard of road crush? We didn’t even see that road crush. And the weed pulling, quantity 8 for $1080? [redacted] When we signed the contract, he said he will take care of everything. Nothing is on the contract that we have to pay extra.  [redacted] We did approach him once while he was on one of our neighbour’s yard and talk to him with respect. He was not answering our phone calls and text messages. We just would like to know when he will start working on our yard as our landscaping was already overdue and we will loose our landscaping deposit which he’s fully aware of. Whenever we are asking him when he’s coming to finish the job, he will accuse us of being rude and demanding. I think, as a customer of his, we have the right to know his plan for our yard as he already have our money. He already got 50% of the contract price. When they were doing our final grade, [redacted]. He’s the one who’s intimidating us by saying that he’s gonna put lien on our house. [redacted] This company needs to give us our refund. I am only asking him to return what is due for us which is the difference of $5000 and the reasonable price of the final grade (according to his invoice final grade is $1800). I think what we are asking is reasonable. I could have ask him to return the whole deposit because he did not complete what’s on the contract. I repeat, we don’t owe him anything. He owe us money, [redacted].  [redacted]
