I cancelled my account with the business but they continue to charge for it.I cancelled my account in 2012 but have charges from them in 2014.Desired SettlementRefunds from business for all money ever charged past May 2012

Water temperature for our water therapy classes is too cold and water is not circulating. It is cloudy and smells like chlorine. Many times we have complained to [redacted], [redacted] about ho cold the water is. They say it's 82 deg. We all stand and shiver and then suffer for days after our exercises because of the cold water. We have many complaints filed with [redacted] but they can't do anything. One day the chlorine level was 3.2 and we were told "it's ok and to go ahead and use it". Very cloudy and unclean water with aerators at bottom of pool not operating.Hot tub aerators not operating just a tub of hot water. Many of us are handicapped and can't get into except by banging on a side door for someone to let us in and we can't get to the bathroom without banging on the door for someone to open it for us. The water temperature is a regular complaints from nearly everyone that attends. It is miserably cold. Also the handicapped chair's battery is not kept charged to get the ones of us that have to use it. I was stuck in the pool for over an hour one day while the the manager, [redacted], went to try to charge it enough to get me out. I was of cold and jerking that I hurt my back because of the water temp. They got a backup battery and failed to charge it last time we had problems.I have contacted the health department about all the mold and algae, chlorine levels and aerators not working to little avail so far.Desired SettlementThey claim to have so many thousands of customers but they can't take care of the pool and the needs of us.Every time something is mentioned, which is daily I have been told they are working on it.I can initiate a class action law suit with all the others but this is not the way I want it settled.I just want a warm, clean and safe pool to swim in.Business Response 1-5-2015TO: Revdex.comFROM: [redacted], GM and Owner [redacted]RE: Complaint # [redacted]We regret that the complainant perceives her complaints as being unimportant to us. We have been trying and are willing, within our capabilities, to meet her needs.1. We regret that our indoor pool temperature is uncomfortable for her. We do not claim to operate, nor is it our intent, to have or operate a therapy pool. Therapy pools are heated to warmer temperatures that meet medicinal needs of certain clients. Those warm temperatures (which exceed recreational pool standards) are not legal and are not in the best interest of our clients, who join our facility to meet their fitness needs. [redacted], the physical therapy company that rents space in our pool, of which the complainant is a client, provides physical therapy in our indoor pool with the understanding that the temperature is for fitness and recreational uses (maintained around 84 degrees) and is not a therapy pool.2. The complainant's perception of comfort is of concern. However, we keep the pool temperature where it meets the needs of the majority of our pool users. There is no law nor health department rules that regulate low ranges for recreational and fitness pool temperatures. Both Courts Plus staff and [redacted] staff have advised the complainant of this.3. The complainant is perhaps unaware that there are no aerators on our pool bottom. Our closed water circuit functions to all Health Department requirements. Our pool is safely sand filtered, maintained clear, chlorinated, monitored, adjusted, and kept well within the health department specifications.4. Note: the chlorine level she quoted (3.2) is within the health department guidelines. The complainant alleges no action on her behalf by the [redacted]. Following her complaint to them, they immediately inspected our records and tested the water. Courts Plus passed inspection with all things being compliant. Perhaps the complainant disagreed with the Health Department's conclusion, which we also hold (the pool is safe, clean, and running according to guidelines); because it did not validate her opinion.5. Further, there are no aerators in our hot tub. Water circulates in closed water circuits. There are two circuits. One is for heating and chlorination. The other simply moves the water at a higher rate. Hot tubs require a lot of daily maintenance and water changes. These special precautions require the club to close the hot tub for cleaning on a regular basis. It is never allowed to run without proper chlorination and PH stability.6. The pool handicap lift battery would not always maintain a functional charge during our 24 hour duty periods. Upon the complainant's recommendation, we ordered another battery and now rotate those batteries. They are inspected and kept charged at all times. 7. The door the complainant choses to come through is actually not our handicapped entrance. To try and help the complainant, the staff has asked her to call in advance so we may better assist her. She used the appropriate handicapped door for a long time so she does have knowledge of its location8. No mold or algae was evident upon inspection of the pool area. Nor has mold been previously noted.9. Regular tests and function checks well in excess of health department minimums are recorded and logged. These records are reviewed on a regular basis by not only our staff; but too, the [redacted]. As previously noted, our pool water was tested and records reviewed by Courts Plus Staff and the Health Department again after the complainant's complaint and we met all pool and hot tub standards.Respectfully submitted,[redacted]General Manager/Partner[redacted]Consumer Response The handicapped door they are referring to is several inches from the side walk to the entrance. My wheelchair cannot get up that high. Prior management told me to go to side door and call office or bang on door to get someone to let me in.[redacted] never mentioned the inaccessibility to the dressing area and bathroom. The side door needs to be made handicapped accessible. Even with a key I couldn't get in either doors. It is a shame they cannot accommodate reasonable entry to the pool as it is the only one in town that we can use for lap swimming and therapy.

At the above mentioned business they refused to return cash not used on a secondary membership. While along not providing serviceOn February 28 2013 I bought and paid for a one year membership and a secondary service called V.I.P. which was a trainer assistance program. The last two months I have not used the secondary service but used the primary. I was told my trainer was not allowed to do the training I requested. So I no longer used the service all the written material does not state no refunds or all money paid is forfeit. So when I went into the offices today about returning my money I was asked firstly if I was going to re-new I stated no and then I was told flatly I was to not receive any return and that the hundreds of dollars is no longer mine. Desired SettlementAll I want is my money returned for the unused portion of the V.I.P membership. I don't want anything other then that. Business Response [redacted]'s request for a refund of two months of prepaid VIP services was mistakenly refused at the club when he requested it; on review and following receipt of this complaint from Revdex.com we gladly refunded the two months owed, in full (VIP personal training $50.00/mo. x 2 months= $100.00).His check was mailed regular mail on 2-25-2014.Respectfully,[redacted]General Manager
