Dear Sir or Madam: I am in receipt of your letter dated October 23, regarding the above referenced consumer complaintPlease be advised that I did not receive this letter until Thursday, October 29, because it was forwarded to the Tempe storeThis incident occurred at the Phoenix storeCowtown Boots Phoenix prides ourselves on customer service and prohibits discrimination against its customers on the bases of race, color, national origin, age, disability, sex, gender identity, religion, reprisal, and where applicable, political beliefs, marital status, familial or parental status, or sexual orientation Although I appreciate the complaints presented by Mr[redacted], the incident details are not accurately representedOn the date of this incident, Mr[redacted] entered the store along with another customer and a dogUpon entering, [redacted], Cowtown Boots Phoenix’s store manager, informed Mr[redacted] that dogs were not allowed inside the storeAt that time, Mr[redacted] in turn informed Mr[redacted] that the dog was a service dog ??" the customers proceeded into the store without any further commentary from Mr[redacted]The customers proceeded towards the boot department - the boot department is located in the rear of the storeWithin a few minutes of their arrival to the boot department, [redacted], an employee of Cowtown Boots, approached Mr[redacted] to offer assistance, as required by Cowtown BootsIt was as Mr[redacted] approached the customers to offer assistance that the service dog lunged and growled at Mr[redacted], who was in fear of his safety, then left the customers and went to the apparel area, calling the front of the store and requesting Mr[redacted]’s assistanceMr[redacted] informed Mr[redacted] of the incident that had just occurred with the service dogIt was only at this time that Mr[redacted] approached the customers and kindly asked that they take the dog out of the store In his complaint, Mr[redacted] vaguely provided the exclusions for service animals, as provided by the ADAWithin the ADA exclusions is the remedy to request a service dog to be removed from the premises when disruptiveMoreover, pursuant to Arizona Revised Statutes Section 11-1024(B)(1): It is not discriminatory to exclude a service animal from a public place if one or more of the following apply: 1.? ? ? ? ? ?
