To whom it may concern:I'm in receipt of your letter dated July 29, Mr*** asked me to meet him on Memorial Day because it was absolutely urgent that he have a protective order filed the following day due to circumstances he was experiencing at the timeI asked him to meet me at the local
coffee shop to briefly discuss his issues so I wouldn't have to drive all the way downtown to the office for a consultationMr*** decided at that time on Memorial Day that he wanted to retain me immediatelyMr*** read the Retainer Agreement and acknowledged the retainer agreementHe stated he wanted to pay by credit cardI informed Mr***, I could accept credit card but I would have to charge a transaction fee of 3.5% because it was the fee Square, the credit card reader, charged for running a credit card via my phoneHe didn't object and stated he was fine with the feeMr*** voluntarily handed me his card to run on my phoneI ran the card for the agreed amountMr*** agreed to the original amount, voluntarily handed me his credit card to process and did not in any manner object to the agreed amountIt wasn't unfair when he agreed to the terms so I don't understand how it's unfair now.I preformed the necessary work early the next morning since it was urgent to file the documents as soon as possible to protect Mr***'s propertyAt approximately 10:a.m., right before I was about to file the documents, Mr*** called to cancel the retainer agreement and employment agreement for no cause givenI informed Mr*** he could pick up a cashier's check for the amount at my office.Mr*** then proceeded to file an Unauthorized Debit Claim with his credit card company in spite of the fact that he voluntarily agreed to the amount charged on his card, voluntarily handed me his card, and allowed me to run his credit card for the agreed amountThe credit card company unilaterally withdrew the entire amount from my bank accountI'm no longer in possession of any funds of Mr***.The issue Mr*** is now having with his funds are due to his own conductThe funds are now in dispute and his credit card company will hold those funds until the dispute is resolvedI haven't talked to his credit card companyI don't know what they plan on doing with the fundsI have no idea where they are in the dispute processHowever, I have nothing to do with what's going on after Mr. *** unilaterally breached his contract with our firm and filed a fraudulent Unauthorized Debt Claim with his credit card company.I've helped hundreds of people all across Texas and I've never had any issues with anyone related to legal representationMr*** has continued to slander my character and profession for no apparent reason other than because of the situation he's been put in because of his own conduct.
