apartment, I warned co-signer of pet damage to the carpet, so they would not be surprised by a bill in the mail. We pro-rate charges of carpet based on install date. Pet damage is not considered normal wear and tear. I have also attached the pet addendum that the resident signed regarding having a pet on the premises. A dog was the only pet registered at the property. The resident was contacted regarding a cat, the tenant said they were babysitting for their mother, the cat was not theirs. Upon arrival for a broken dishwasher the cat was still in the home. When mother was contacted regarding the cat still being there, she stated "they were babysitting the animal for friends", I told her they said it was hers. Per the pet addendum #2 states that "All pets must be registered with the Resident Manager. Anyone harboring a pet without notifying the Manager and paying the required fees will be subject to eviction".
We have had multiple cases of persons in apartment home not registered or "unauthorized occupants" in home. No formal notice through writing had been given only verbal conversations with residents and co-signer.
Per the lease agreement signed by tenants. #3, states "Lessee will be liable to Lessor for a termination of $625.00 (not to exceed 100% of the highest monthly rent during the Rental Agreement term) if : 1) fail to give written notice to vacate as required in section 23 of this rental agreement. 2.) vacate without paying rent in full for the entire Rental Agreement term or renewal period. 3.) vacate at Lessor's demand because of Lessee's default; 0r 4.) are evicted.
The dishwasher was a result of negligence. Per lease see #11. We may require payment when it comes to negligence or mistreatment. Tenants received a brand new dishwasher installed 04/26/2016. The warranty will not cover negligence, part is on order, but payment in full must be made to the office for this repair.

So when asked why we were being evicted why were we told it was due to "complaints" we were never notified of?
And that because an individual that stole a vehicle that walked out of our breezeway that 11 other doors are also located in was a (and I quote) "a huge part of the reason we were being evicted" we have nothing to do with his actions and upon us asking what we were being evicted for it took up until now for you to say it was over the animal specefically, why?
I paid 250 dollars and 15 dollars a month for a pet fee and any pet damages, I dont mind paying to clean the carpet, but paying to replace the carpet when I paid my pet deposit is ridiculous. Not to mention the downstairs neighbor owes you 900+ dollars and is only being told she is not allowed to renew her lease, but we were evicted over something as simple as an animal? I feel like as a landlord, you shouldnt give your residents any different treaent, especially when we have not missed a single payment.

Once again I said that our complaints and issues we're notified of were from months ago. The last complaint we recieced was back in February. If anything since then has arose we HAVE NOT been notified. And if the pet deposit and pet rent is NOT for any pet related damages, you should state that when you go over the lease with your residents before signing being as we were told by your staff that that is exactly what the fees were for. And you still negelcted to respond to the fact that we are being evicted however people that owe you large sums of money outright are just not being allowed to renew their lease, once again I state, that I believe you are not treating all of your reaidents the same.

Tenant states they were never notified of issues or complaints. I have attached documents that went to residents. The notice to vacate per section 12 of the lease states "Default" -" If Lessee defaults in payment of rent or if the Lessee violates any of the convenants herein, or if the Lessor at any time shall deem the conduct of the Lessee or any occupants or the Premises to be objectionable or improper, the Lessor may, as provided by law, give Lessee notice of Lessors intention to terminate this rental Agreement. In such event, the Lessor shall be entitled to regain or retake possession of the premises either with or without legal prosecution." Tenant is stating their pet fee is to cover damages, I have already responded to this and sent in required documentation.

September and as of the 19th when considered for collections had not paid October either. Ledger, payment history has been attached. I have also attached the Final Account Statement in which we do tell people about the collections process. As for the carpet replacement, per the lease "pet fees" are just "Fees". There is no deposit refundable to tenant. 11/01/2016 [redacted] contacted our office asking if she paid the balance in full would it stop the collection process, we agreed but still as of 11/08/2016 have not received a payment. Tenant stated tehre was an issue with online system declining payments. Tenant is still welcome to pay balance with check or money order or possibly try another card. Waiting still to hear back from her as of today 11/08/2016. We will need to resme collection proceedings if the payment is not received.

I had lost a manager at that time and I stepped in to fill in. Residents were coming in and complaining of the lack of parking spots and that most cars don't even move. I tracked the cars that did not move and noticed one that had not moved. I...

asked residents and office staff if they knew who it belonged to. No one knew who it belonged to so I tagged the car and waited 72 hours with no response. I did tow the car. When the resident came back and confronted me, I did explain to him why it was done, and our policy is to let the office know when you leave for extended periods of time, we can then keep any eye on apartment. I did give him $200 off his rent at that time. I am not going to give him the other $200 and it would not help this resident with his ledger, he owes us a lot of money. Always pays late. I handled this to the best of my ability.

In activity from 3/31/14 there were notes that the car had not moved in months. Stuart stated that he could not move car as he did not have license. In other activity also states that the battery was dead and he could not move it. Was seen trying to charge it with outside plug. He did agree to move it occasionally. He had told the office staff that he would be gone for a week. His towing bill was $150.00 + 20.00 per day. This is almost 2 years ago and he has never brought it up since.
