In February of 2020, I placed my name on the list to purchase a lamb from this farm. We exchanged messages through the Spring. I expressed interest in a bred ewe and offered a good faith deposit without being asked. The deposit would be applied to the purchase price of $550. I signed a sales receipt, not a contract, and paid 50$ more than I was asked to in the form of a deposit. I was given a choice of two ewes that were to be bred in September, 2020. The farm asked be to choose, but stated in writing "NO RUSH." In August, after doing much research, I contacted the farm to communicate that I had chosen one of the two, understanding that she would still be bred in September. In response, I was told the ewe I chose had been sold to someone else. Since she was sold out from under me, I asked for my deposit to be returned. The farm refused, stating that deposits are non-refundable, as stated in my contract. I never signed a contract, just a sales receipt. Further, there are no terms of sale listed on this receipt. The farm stated that I could apply the deposit to the purchase of another animal next year. I replied that I am not comfortable doing business with a farm with such questionable ethics. They have scammed me and took advantage of me.

After *** decided she would stop communications with me, she had her mother message me. As you can see by the file, it states she will have $50 returned to her.(Money order for $50 was mailed on 8/15/2020). She also could have a full refund returned if another customer wants this ewe. Here is the picture of the invoice, too. Which states...“I have not yet decided which ewe but will let you know once I do.” "You will have option of which ram to choose."I decided the better breed character ewe. The nicer of the 2 I offered, even though she purchased a bred ewe of MY choice. Which it states on the receipt she has. She got the invoice before she agreed and mailed out a check. I only had on the invoice $100 but she paid $150. I have returned $50 to her. She is stating she made a good faith deposit... she would have been asked for a none-refundable deposit anyway to hold any animal here on the farm, like all my other customers. She also claims the deposit would be applied to a purchase price of $550. Which you can see on the receipt could be $550 to $700. Our Sales Receipt has our terms of sales in it. A much more detailed terms of sale is located on our website. Its stated under the sheep tab for everyone to see before purchasing from us. APRIL 22,2020 was the last communication with her. Until August 5, 2020. It should not take someone 4 months to get back to get back to me with what animal they want. I choose the best one. If she could afford the higher price sheep, she should have told me and I might have been able to work out a better price. But I would be worried about the care of the animal if she couldn't afford it, how could she afford the health and care it needs. ANY responsible breeder will ask for a none-refundable deposit to secure their animals health and care. If a person backs out of an animal they intended to purchase, that animal is now costing their current owner more feed and health needs till they can find a new home for it. That none-refundable deposit pays for some of that unforeseen expense.

I am refusing the response from the business based on the following:-No one is authorized to communicate on my behalf other than the Revdex.com. I did not authorize or ask anyone to communicate with the business other than the Revdex.com on my behalf. -Communication from me ceased with the business after I contacted the Revdex.com for help.-In referring to the facts, no indication was ever made from the seller that the deposit was non-refundable on the receipt or in the *** messages.-No offer was made to me to refund the whole deposit if the other buyer refused the ewe.-There are numerous conflicts in the *** messages from the seller, ie. "NO RUSH" on deciding which ewe (knowing she could not be bred until September). -Seller chose not to contact me when another person expressed interest in buying the ewe I wanted. She proceeded with the sale to someone in *** (see messages). I learned of this only after contacting the seller, knowing the sheep would be bred in September. -Many hours were put into researching the pedigrees, which were initially posted wrong on the business website (see messages), which played a part in deciding which ewe I wanted. This decision was not made hastily. -Seller never offered to return part or all of the deposit in any *** messages to me (see original attachments). -Please review to the initial copy of the *** messages which illustrate a timeline and chain of events between the seller and myself. -There was never a contract, simply a sales receipt.

- You may not have authorize or ask anyone to communicate to us but they did anyway. The only way they would have known anything was from you. They also threatened us, our business, and our animals. -In reference to "Many hours were put into researching the pedigrees, which were initially posted wrong on the business website (see messages), which played a part in deciding which ewe I wanted. This decision was not made hastily."If that where true, it would have been a very easy decision based on pedigree, photos, and information on breed character on my website. Also, these means she was on my website a lot, indication she would have saw the 'terms of sale' on ever page she clicked on. My website also keeps track of the hours and times, each time someone new or recurring person is on it and each page they click on. I would be more that happy to print that off if need be.-I was unable to contact the customer after she blocked me. There was no way of contacting her.-''No Rush'' - Does not mean 4 months later. The sales receipt shows we had choice in the end.-There are numerous conflicts in the *** messages from the buyer, ie. "September" I never said when the ewe would be breed besides stating ''FALL'' . According to the latest message, the buyer said. '' I was told the *** tripwas next year. I knew that the ewe wouldn't be bred until fall and I wish you would've checked with me". I expected this customer to come to pick up her ewe late fall. ''I'm not opposed to travel- but also curios about the transporter''. I did give her the information about the transporter too which I have nothing to do with. I was unaware of her plans since that was her responsibility to make travel arrangements. Next she went and said. ''If you think the transporter will come to *** in September''. ''In my notes it says no trip to *** this year but next. Transporter coming in September.''By what she said above that she would have wanted me to deliver on our trip next year. At that point the ewe would have already lambed here. I don't know what she was thinking but then goes and asked if I think a transporter will come to her in September than her notes saying I said there was.''Seller never offered to return part or all of the deposit in any *** messages to me (see original attachments).'' Because I could not contact her. She has got her $50 back by USPS money order.''There was never a contract, simply a sales receipt.'' By signing the receipt you mailed back to me, means you agree to the terms of sale.
