Craig Creek Builders

Contract signed on the 14th of March 2020 with James Kyle Caldwell of Craig Creek Builders LLC for the replacement of vinyl siding and metal trim at *** with a start date of week of March 15th, 2020 and a completion date of week of March 29, 2020. As of June 9th, 2020 the contracted work was only 25 percent complete. Letters were sent dated June 9th, June 3rd and May 11th to little effect. On June 26, 2020, after consulting with a lawyer, I sent a letter to Mr. Caldwell advising him of his material breach of contract and declaring the contract null and void as a result. In the letter I asked that Mr. Caldwell remove his ladders,
pump jacks and miscellaneous remaining equipment from my property. As of September 21st, Mr. Caldwell has failed to remove his equipment. This my reason for complaint. I would like Mr. Caldwell to remove his equipment. I have exchanged text messages with Mr. Caldwell. He has given me more than one date on which he said he would come and remove his equipment, but he does not follow through.
According to contract I paid Mr. Caldwell a $2500 downpayment. Reimbursed him $335.91 for plywood and housewrap that was not part of the job and on May 6th advanced him $600 on the $2500 due under contract at 50% completion of the job. Total amount of contract was $7500. Total amount paid Mr. Caldwell is $3100 plus the reimbursement for plywood and housewrap.

I am not looking to recover any money despite having to purchase materials and finish the work left incompleteby Mr. Caldwell. I do, however, want him to remove the ladders, walk boards, pump jacks and other miscellaneous equipment and materials that continue to encumber my property.
