Wayne [redacted] purchased a used year old Bobcat T(skidsteer), 4/25/ The machine was sold with NO WARRANTY but was in good mechanical and cosmetic condition at the time of purchase, as documented in the high resolution pictures and HD video of the machine in full operation which Mr [redacted] viewed before the purchase We shipped the machine to him as promised, see attached Bill of Lading The Twas NOT leaking fluids when we took the pictures and video of it for advertising, when it was moved around our sales yard, nor at the time we shipped it to Mr *** We did reach out to Mr [redacted] regarding his concerns and explained such We offered him the option to bring the machine in for a repair or to trade up towards a newer nicer machine Mr [redacted] never contacted us back, we expect he found the culprit of the leak was something very minor.Copy of the Contract of Sale is attached

[redacted] purchased a used year old New Holland LT185b (skidsteer) with about hours on it on 3/13/Despite the age, it was a very nice loader I was operating it in the video Mr [redacted] saw and I took the pictures of it The machine was sold with NO WARRANTY but was in good mechanical and cosmetic condition at the time of purchase, as documented in the high resolution pictures and HD video of the machine in full operation which Mr [redacted] viewed before the purchase We shipped the machine to him as promised and in the same condition as he viewed in the pictures and video As it was very cold here at the time of purchase the machine was run/idled some to circulate antigel into the fuel system, keep the battery charged, and it was run when we moved the machine from our sales yard to the shop where our loading docks are for ship out It would be reasonable to think the machine had a few hours more on it at delivery than what was advertised, we are talking hours as he noted not or The machine was jobsite ready when it left our yard To think a hour loader that we were running shortly before needs $6k worth of work is absurd, the pictures and video show the machine to be not only fully operational but in nicer than average condition Mr [redacted] was going to come see the machine in person which we encouraged, for some reason he chose not to come inspect before putting down a deposit and making the purchase Before the machine left for delivery to him we had other customers wanting to buy it but Mr [redacted] was first in line with his spot secured by his deposit The Contract of Sale that Mr [redacted] signed is attached, and in part reads twice “items are sold AS-IS, WHERE-IS, with NO warranties, unless stated otherwise in writing” that "all sales are final - No returns, cancellations, or exchanges" and “All sales are final – No returns, cancellations, or exchanges.” and "WARRANTY DISCLAIMER: Any warranty(s) on this product are those made by the manufacturerSeller hereby expressly disclaims all warranties, either expressed or implied, including any implied warranty of merchantability or fitness for a particular purpose or use" and "Seller and Buyer agree that this is the full and complete agreement between the parties for this transaction." Complaint: [redacted] I am rejecting this response because: I was told that machine was touched up, the entire machine has been paintedI could care less about the paint at this pointAfter unloading machine we found that the left hub was leaking a lot of hydraulic fluidI called and spoke with [redacted] on the matter and he said he could not help me unless I had my mechanic look into the hub and see why it was leakingNow that we have had our mechanic do that [redacted] is now informing us that he does not want to help because it is now tore down by our mechanicHe claims and I quote "when it left my yard it was intact and operating"I WAS TOLD BY [redacted] TO HAVE MY MECHANIC DO THIS AN NOW HE IS USING IT AGAINST METhese guys are not ethical at all, they had to know that this was a problem before it left their place of business and they just didn't want to fix itI am now having to send these parts off to Texas and have it rebuilt for a total cost of $3,parts and labor, $2,for rebuild and $labor to my mechanicI even offered to buy another machine and pay the difference and [redacted] said and I quote "I don't want a machine that is tore apart, when it left my place it was together and operating"I have contacted my lawyer and he will be writing a letter to go after this company for fraud due to the salesman [redacted] saying several times and I quote "this is a nice machine ready to work"Not sure what they call ready to work but this machine has been in my mechanics shop since the day I got it, I haven't even been able to use it on a job site yet!!!!! I hope that the Revdex.com takes this very seriously, most companies can't afford to pay this kind of money for a machine that they just boughtI will pursue this to the fullest and I hope that the Revdex.com has my backI want a full refund for this machine it is a lemon and Craig Equipment knew it was when they sold it! Hello, We faxed our response to complaint #*** on 6/2/ I have attached that response and fax confirmation page I have also directly attached the pictures that were faxed with the response for better clarity Pictures and are of the used tracks in question that the
customer purchased and the last two pictures are of what comperable new tracks look like that carry a warranty and were offered to the customerThanks, *** *** ***

As

[redacted] purchased a used 13 year old machine 6 months ago, 3/10/17.  The machine was sold AS-IS with NO WARRANTY but was in good mechanical and cosmetic condition at the time of purchase.  In March of this year we had several similar machines for sale including...

another Takeuchi TL130.  Mr. [redacted] picked this machine of all the options and after inspecting and operating it personally, decided to make the purchase, and made a offer $1500 less than our asking price which we accepted.  He bought what he saw, no more and no less, if there were any manuals with the machine he got them when the machine was delivered, we don't separate any books, manuals, or records from the machines.  The Contract of Sale that Mr. [redacted] signed is attached, and in part reads that "all sales are final - No returns, cancellations, or exchanges" and " Everything sold as is, where is, unless stated in writing" and "WARRANTY DISCLAIMER: Any warranty(s) on this product are those made by the manufacturer. Seller hereby expressly disclaims all warranties, either expressed or implied, including any implied warranty of merchantability or fitness for a particular purpose or use"  and "Seller and Buyer agree that this is the full and complete agreement between the parties for this transaction." A new similar machine cost about $50,000 and typically comes with a 1 year manufacturers warranty.  Reasonably someone should expect to have maintenance and repair cost out of pocket on a machine well over a decade old that is purchased for well under half of what a new machine costs especially being purchased without a warranty.  We wish Mr. [redacted] had not encountered mechanical problems but the issues are not something we could have specifically predicted or prevented.  We have fulfilled our contracted promises and gone the extra mile in giving a significant discount on the machine at the time of purchase.  We cannot offer anything further on this transaction.

I spoke with Mr. [redacted] this morning in effort to make sure that he is fully satisfied with our service and the products he has purchased.  We have made Mr. [redacted] an offer to ensure he is satisfied, we are waiting his response as of 4/2/18.At the time of his original purchase a extreme...

duty brush cutter was recommended to him but he chose a standard duty cutter at a lower price point.  It is unclear today if the cutter he purchased was not up to the task he put it to by design or whether it had/has a potentially warrantable issue causing it not to operate appropriately.  The Terms of Sale Mr [redacted] agreed to in part state "All sales are final - No returns, cancellations, or exchanges", which is why we did not take the cutter back after he used it - clearly we cannot sell it as new to another customer.  Signed contract of sale attached.
