There is no reasonable and or legal  proof that your machines can not simply do this damage. A simple assumption based on the experience of the employee is null and has no bearing when it comes to personal property damage, and that is factual/ legal information. Second, the argument that the car is dirty upon arrival and scratched can not be seen at that instance is also not feasible. I am happy to get the vehicle equally as dirty, drive it by the cameras again and we will clearly see the scratches. The estimate to fix is upwards of $2300 dollars, this amount of body damaged is not simply unnoticeable from a camera pointing directly at my vehicle 15 ft or so away. This I have visual proof of, the fact that the damage did not exist.
To resolve the situation I will gladly accept some sort of settlement that works mutually. I am willing to come up with a resolution. litigation is a possibility for me and I have already taken the step to file if we do not get this resolved. The general manager is aware of the situation and has my info.

Currently trying to come to an agreement regarding this. I do not believe this damage happened in the wash tunnel. I did try to explain that when all of the cloth is on a set rpm (60) it is not feasible for a solid scratch to be put along side his vehicle. Everything rotates in the tunnel. It is all...

on a single hydraulic unit. On video, the tunnel does shut off while his vehicle is in the tunnel, but so does the conveyor. His truck is not moving through the tunnel when the equipment is off. 
These types of things don't happen in this line of business. Unfortunately, when a vehicle comes in covered in dirt, scratches aren't visible. That is why these scratches do not show up on our cameras. We have washed over 2 million cars through this tunnel and have had one other scratch claim. This was due to the new cloth not being prepped properly before being put into service. Those scratches were all 1 to 2 inches long and traveled the length of both sides of the car. Clearly resembling the path and rotation of our equipment. That was repaired through a buff and detail. The cloth we are using now has been is service for over a year.
I have him getting a quote from another shop and seeing if it can be repaired through a detail shop. I am trying to be accommodating to this claim. I do believe that Mr. [redacted] really believes this happened here and is not trying to scam us. I will try to work with him to come to a reasonable resolution.
