I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
When I approached the fueling dock the fuel types were not visible from my vantage point. I asked for diesel fuel and was given a nozzle from a pump that was from a gasoline pump. The owner of the marina never admitted any fault nor even offered an apology for the mistake. I never said it was intentional but the attitude was unprofessional and this is not a business I would ever recommend to anyone.

Crazy Horse Marina only dispenses one type of fuel, 91 Octane non-ethanol marine fuel.  Our fuel dispensers are clearly labeled in accordance with Section 59.1-167.1 of the code of Virginia.
On 9/21/2014 a sailing vessel approached the fuel dock at Crazy Horse Marina and moored.  A marina...

dock hand assisted the vessel in mooring and asked “You need gas?”  which is a standard greeting.  The occupant of the sailing vessel replied “yes”.  Dock hand then asked “cash or credit”, which the occupant of the vessel replied “credit”.  The dock hand told him he could swipe the card for him and hand him the nozzle since the fuel fill was located in the ck pit of the sailing vessel.  The dock hand then went to assist another vessel approaching the dock.  Once the occupant of the sailing vessel was through filling the tank the dock attendant said, “My friend has a big sailboat like this but his is a diesel”, which is how the error was discovered.
Upon being notified of the situation the manager contacted a local mechanic who made a service call to the dock on a Sunday, pumped out the contaminated fuel, cleaned the fuel system and disposed of the contaminated fuel.  The tank was then fueled with 10 gallons of off road diesel which the marina had on hand for use in landscaping equipment.
The manager did deny reimbursement of the charges to pump the tank, to say the marina did not help with the charges are ridiculous based on the fact that had the mechanic not had a relationship with the marina the charges would have been much greater than the disputed $125 for a non –scheduled Sunday service call and disposal of contaminated fuel.  The dock hand, whom had no reason to lie, animatedly states that the customer never asked for diesel and the customer did pump the gasoline himself.

Review: Asked for diesel fuel at dock, was given nozzle on boat that dispensed gasoline. After the error was discovered fuel tank had to be pumped. Asked for reimbursement of charges to pump fuel tank and was denied. The owner said it was my responsibilty to know what fuel type was being dispensed. I told him I had asked for diesel but he said he did not hear me. He replaced the fuel I had purchased with diesel but would not help with the charges to remove all the fuel from the tank.Desired Settlement: Reimburse half of the cost to pump the tank. $125.00
