*** *** ?rst inquired with us about a female chocolate lab puppy on12/8/in which we responded that we did not have any chocolate females available at that timeWe then mentioned to her that we did have a chocolate girl currently [at that time) being bred and that if the breeding took we would have puppies whelping in FebruaryShe responded stating that that would be better timing and asked if we could please let her know if the breeding took, we responded to her by telling her to just keep in touch with us and once pregnancy was confirmed we would start a waiting list, she thanked us and we never heard anything from her until we decided to follow up with her on Ianuary 13, Z018.At that time we told her that we just wanted to touch base with her to see if she was still interested in a puppy from us and she responded by saying, "yes l am if you remember l want a chocolate female"We took this response as semi rude and arrogant but blew it off that maybe we were just being a bit harsh, and responded respectfully stating "yes, l do remember, I just wanted to touch base with you reallyshe then said “ok let me know” to which we responded “l am con?dent enough at this point that we can start a waiting list for our upcoming chocolate litter and wanted to see if you would like to place a deposit to hold your place in lineWe would require a $deposit to get on the waiting list", (in this message it was making her aware that we would be STARTING a waiting list for the litter which implied that she would be first in line for a puppy]She asked when we were expecting the litter and we told her that the litter was due mid FebruaryShe asked how she could get us a deposit and we directed her to our website to fill out our waiting list form and let her know that once we received that we would respond with info on sending the depositShe then let us know that she sent the form and we responded stating that we received the form and were responding from there at that time.On January 15, 2018, *** *** let us know that she sent the deposit and read our policy on our website (in which she should have also read when she filled out the waiting list form on January 13, 2018, in which states "by sumitting this form you recognize that: A "non-refundable" fee of $will be required in order to be placed on the puppy waiting listThis deposit is to ensure us that you are seriously interested in a puppy and understand the responsibility that comes with owning a puppyThis fee will be deducted from the total purchase price of each puppy..." the form and policy can be seen here *** At that time, we told her that we would let her know when we received her deposit.Then on January 26, after receiving, depositing and sending out a copy of the waiting list form as well as our initial puppy letter (in which gives some general guidelines on how we usually conduct our operations, which is by no means a contract as it is not a signed document), we realized that we had forgotten to send her a message when we received the checkWe immediately sent her a message stating, "So sorry l completely forgot to let you know when we got your deposityou should have received (or should soon] some paperwork for your records..." within minutes we received a response stating, “That's fine l saw that you cashed my check and did get the paperwork Thank youll”The litter was born on Sunday, February 11, 2018, and out of habit we usually do not notify any customers on the waiting list of puppies until they are close to week old just to be sure mom and puppies are all doing well and appear to be healthyOur main concern during the crucial ?rst week of life is our puppies and their mothers and we tend to focus on them rather than customers at that timeWith this being said, the week to come after puppies were born became a very emotional and busy timeOn Top of a new litter of puppies, in the morning of Tuesday, February 13, we received a call that my grandfather who was in hospice care at a local nursing home would not be with us much longer! We spent that day as well as the next at his bedside until he passed away on February The next several days were spent with family preparing for the funeral and spending time with my father who was obviously extremely upset(I would like to include the link to my grandfathers obituary so that you may see that this situation is true and accurate to the time frameDuring this time we did have a few customers reach out to us about the litter and we sent a brief response stating that puppies were horn but we were dealing with the loss of a family member and every customer that reached out was compassionate and understanding and just asked that we reached out when we were able to*** *** was not inclusive with these customers so we did not contact her at that time. With everything going on and not hearing from *** *** we completely overlooked not making contact with her*** *** then finally reached out to us via email on March 5, 2018, stating, “l had made a deposit on a chocolate female litter to he born in FebruaryOn your website it says they will be available in Aprill wanted to know where l stand on the waiting list", we immediately responded stating, “Brenda, l am so sorrywe have been so busy that l completely forgot to message you! Pups are actually weeks oldThey were born on 2/and we have femalesYou are first in lineWe will start allowing visitors for them next weekendPlease let me know if you have any other questions and again l am so sorry for not reaching out to you”Once we received and responded to that message we realized that she had only paid the initial waiting list deposit and that the additional $that we ask for once one is guaranteed a puppy was never paid so another message was sent to her stating, “We will also need the next portion of the deposit {$200} ASAPThanks", She completely ignored this request and responded rudely asking “When exactly canI see the pups and why now are they no longer listed as current litters on your website?” to which we responded stating, "We allow visitors at weeks oldThey are no longer listed there because all the puppies have been soldThe pups will he weeks old this weekend” and got a response saying, “So I can see them this weekend", we followed up with the response, “Sure can :) just let us know when you would like to come and we will schedule a time”We never received a response to this email, which was sent on Thursday, March 8, until we received a lengthy email with much disrespect in which she started off by addressing the email to a person named “Dave?? (which led us to believe that she was working with a different breeder as well) the evening of Saturday, March 10, 2018, in which she expressed concern with the "contract" and made it very clear that there was a major trust issue, but she never said when she wanted to come for a visitWe responded to her email by respectfully clearing some things up for her and at that time made her aware that my grandfather had passed away just after the litter was born and things were just very hectic in the month of February for our familyIt was at this time that she made it clear that she did not want to purchase a puppy from us and requested a refund of her $depositWe responded explaining to her that when she ?lled out our waiting list form on our website she agreed to the terms and conditions, in which states that the deposit is non-refundableThe reason that we (as well as most breeders} have a non-refundable deposit is due to the fact that we have to remove a puppy from the market and in most cases turn potential customers away as we do not have a puppy available for them only to have a customer who has already placed a deposit back out, and this is exactly what has happened in this case in which has resulted in us having a puppy from this litter still available due to this customers actions.We are unsure of anything further to mention here, other than the fact that we have many, many happy customers who we have placed our puppies with over the past years of breeding and several of which have come back to us for a second pupWe also have many customers who have our puppies who were sent to us via word of mouth and recommendations of other customersAlthough we do not have a testimonials page on our website we have several customers who comment on our *** posts, share their thoughts and pictures on our *** page and have told us that they would be more than happy to supply a good reference to anyone requesting previous experience of other customers.If you have any further questions or concerns on this matter we are more that willing to speak with youAlso we would like to request a follow up as to how this escalates from this point! I am rejecting this response because:This breeder Don S*** has lied continually throughout this process I can provide all correspondence between usHe told me he would not sell me a puppy and I was fine with that based on his ethics This needs to be resolved simply because as I stated before there was No contractOnly his word that he would not refund the moneyI can provide all documentation from him if needed but the bottom line is there was no signed contract and therefore I deserve my deposit back as soon as possible.
