See PDFDesired SettlementSee PDFBusiness Response Contact Name and Title: [redacted]. [redacted]Contact Phone: XXX-XXXXXXXContact Email: [redacted]@aol.comJuly 15, 2015To Whom It May Concern:I received a call from [redacted] regarding cleaning her windows. I drove to Holland to provide a no cost estimate. Once in the area I was having a difficult time locating the house, [redacted] was not familiar with any of the cross streets. Her son was there and I asked to speak to him, he was better able to describe the location of the house but still unfamiliar with the cross streets. When I went into her house she was the only person I saw. She showed me the windows she wanted cleaned. I told her that I would do the inside and outside of windows that could be done from the inside. I told her I would not do the outside of the windows. The front picture window had a very unusual storm window that I had never seen before, between that and the outside glass it was loaded with heavy cobwebs/spiderwebs, enough to interfere with looking outside. I explained that I would only do the inside of that window. On each side of the picture window there was a smaller up and down window with a storm. I gave her the estimate of $200.00 to clean seven windows and left. [redacted] called a couple of days later and said she would like me to clean the windows. A staff member and I arrived at her house; again she was the only one home. We were having difficulty removing her kitchen window and she said she knew it came out. She ended up calling her daughter to see if she would help but the daughter said she was too tired. I thought she lived nearby in town, only to later find out she lived downstairs. We managed to remove the window. The back room window was extremely dirty and we ended up removing the storm and cleaning the outside of that window. I felt bad for her because she could barely see out of the large picture window so with some manipulation and mechanical work we were able to get the large picture window removed. She said it had never been removed before and was surprised that we were able to do it. She complimented us on how nice the window looked and the fact that she could see outside. I was able to remove the storm window on the right side of the window and clean it, I was afraid the storm window on the left hand side would crack if I removed it, but I cleaned the front of the upper and lower part. We also cleaned the woodwork around each of the windows and the windowsills, which was an extra service. As we were cleaning she explained that her son lived with her and her daughter lived downstairs (I thought it was strange that her daughter would not walk up a flight of stairs to explain how to remove a window.) She explained that money was tight. She said her Grandson lived with her until recently but is currently living with his girlfriend. She said she asked her children to clean the windows but they were always busy. Prior to us leaving she asked if we would clean the storm window in the front and back and the panes of glass the door leading to the porch. As I was cleaning those windows her Grandson came in, he asked her, "Are you paying these people to clean the windows?" and "Why didn't you ask me to clean the windows". Right then I sensed there was going to be trouble. As we were driving away I commented that there were 3 relatives living in her home and no one could help her, I felt as though she was being taken advantage of.The next day her daughter called to say she had stopped payment on the check, without hesitation I told her I would be taking her to Small Claims Court. She said the job was not completed because the outside of the two porch windows were not cleaned. I tried to explain that we did over and above what I told [redacted] would be done. She said it would only have taken a few minutes to finish. She said, "I bet you don't even have a real business." I agreed to make a third trip to Holland to complete the windows that she asked. Prior to going to the home I stopped at the Holland Police Department and explained to an officer what had occurred and just wanted them to be informed in case there were any issues and I left him the address of the house. My assistant and I entered the home, [redacted], was there by herself. We cleaned the bedroom windows and re-cleaned the inside of the window to the left of the picture window. She said she was satisfied. As we were finishing her Grandson walked in. He was argumentative, he said I bet you don't even have a business license and said that he felt like calling the police. I explained that we were already there and offered him the number and gave him the name of the officer I spoke too. [redacted] had the option of calling other companies for estimates. If she thought the price was too high she did not have to hire Creating Solutions, Inc. I think the problem is the family was upset about her spending the money even though they did not want to clean the windows according to [redacted]. We were there for 5 total hours (2.5 hours each) for the first cleaning, 40 minutes for the second cleaning and put at least 48 miles on my vehicle for the 3 trips. If anything I should bill her for an extra $50 dollars for the extra work that was completed. I have been in business for over 10 years, am insured and bonded and have many very satisfied customers. This is the first complain that has ever been submitted to the Revdex.com.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I do not accept the response because she is not being truthful. Initially, when I called she was very thankful for the appointment. She came for an estimate and told me the price of $200. for seven windows. She left 3 windows undone so I pleaded with her to finish those windows of which she refused and became very angry because she had another appointment to go to. She demanded payment and made me very afraid because she had another worker with her and I felt very intimidated. I paid her because she made very nervous and when my daughter came up she called [redacted] on her cell phone to come back and finish but there was no response. My daughter left a message on her phone and did not hear from her until the next morning. We canceled the check in the meantime and finally my daughter talked to her the following morning asking that she please return to finish the job. [redacted] agreed but said she wanted cash and we agreed on Saturday for her to come finish so my daughter could be here to show her. She cancelled a few days later saying she would be there Monday instead, which my daughter would be working so she could not be present. When she came the second time she still did not complete the job and was walking back and forth nervously wanting to get paid, $200 cash plus $7 for her cancelled check. I am asking that she pays me back $50.00 for all the problems she caused and for the cost of having the rest of the windows cleaned. -[redacted]Final Business Response Rebuttal to 07/22/2014 from [redacted]First, I have no reason to not be "Truthful". I went into specific detail about what occurred in my initial response of July 15, 2014. More windows were cleaned than I stated would be done in the initial quote of 7 windows, I clearly explained that I would not clean the outside of the windows that did not flip in, nor would I remove or clean the front window. The woodwork around each window and windowsill was washed, the outside of the window in the rear room was cleaned, the storm windows were removed and cleaned, two storm door windows were cleaned, the inside and outside of the windows in the door were cleaned and most time consuming was the removal of the main window in the living room which required unscrewing of the fixtures and lifting of the heavy glass, all of this was done over and above the initial quote.Second, when her daughter called me, accused me of not even having a real business, and told me she stopped payment on the check I without hesitation said I would then take her to small claims court. I tried to explain to the daughter what I had discussed with Mrs. [redacted]. I told her I would do the other windows even though it was not part of the contract but I wanted $200 cash and the fee for the bounced check that the bank took out of my account.Third, I returned to Mrs. [redacted]'s and cleaned the requested windows. She said she was satisfied with the cleaning. I'm not sure what she meant when she said she wanted "$50.00 back for the problems she caused and for having the rest of the windows cleaned"? I cleaned the windows to her satisfaction.Fourth, I was not "walking back and forth nervously waiting to get paid." I was standing to the right of the chair Mrs. [redacted] was sitting in waiting for her to count the money. Her Grandson came in a few minutes prior. She paid me with bills and asked her Grandson to give her the change off the table. He nodded at me and said, "You get it." So I walked to the kitchen table picked up the change and handed it to Mrs. [redacted]. She proceeded to count it and hand it to me. After some comments from the Grandson, "I don't believe you even have a business license" and "I feel like calling the police." I just wanted to get out of the house.Fifth, I have never gone to the police station before I went to a client's home, but I stopped at the [redacted]. I felt nervous, threatened and intimated. I spoke to a police officer to explain the situation and put the police department's number on speed dial in case there were problems at the home and I needed to reach the police quickly. The problem I see is that Mrs. [redacted] called me for the job; she was the only one there when I gave the estimate then the adult children and grandchild became involved. Mrs. [redacted] knew exactly what I was going to clean and what it was going to cost. I feel the family is attempting to financially exploit me. I did over and above what I agreed to. This ongoing back and forth is costing my business money between telephone calls and letter writing. I gave her a quote, performed over and above what I said and certainly have not been paid adequately for all of this aggravation. [redacted] J. [redacted]
