The contract terms were 50% up front, with two follinstallations of 25% payments
After getting the original estimate (50% paid was roughly $9,000), we decided to also remodel the bathroom*** quoted the price (verbally) as $5,for the bathroom, all includedHe had also missed a
number of items from the original estimate and these were also billed with the bathroom (page 3)He gave me the cost needed to pay half of the second invoice via phoneI went to the bank that day and got the check to pay half of the second invoice plus 25% of the original invoice ($7700)
I gave payment, but received the second invoice after the factI did not note that his invoice for the bathroom stated it was our responsibility to buy the tile, but that was not what was verbally stated / and a point of contention
Please forgive the hand written notes on the attachments, they were meant to illustrate to *** that 75% of the line items were not in fact complete, and that he did owe us back money for bathroom materials
I have also uploaded the terms for continued employment that we proposed after discovering the defective wall (sent ** July 2014)The terms were essentially asking that the wall be fixed, that items he told us verbally were included in the estimate be added explicitly, and that he put itemized costs for each item, with the material allowances he assigned so that we could be reimbursed for items where we paid for materialsHe has been non-responsive except for when I informed him that we were going to have his trailer towed if he did not respond to our termsHe retrieved his tools / trailer, but never responded to the terms we put forth

Review: [redacted] Creative Construction, Inc in **) took $16,700 in payment for the renovation of my basement, which should have constituted 75% of the work contracted. Once I noted a defect in a wall that was constructed, [redacted] disappeared with my money, without completing work. The wall was framed and finished, though it shifts when the slightest amount of weight is put on it. Walls are *not* supposed to move.There is no way that this shifting would not have been noted as the drywall went up, yet the wall was finished anyway, which I believe is fraudulent.I also gave [redacted] notice upon receiving his estimate for our bathroom that though he had included a standard toilet in the pricing, that I desired a toilet with skirting. He said this would be no problem. I measured and rough-in at 10.75 inches and told him that I was going to special order a 10 rough-in toilet. He promised me that he could fit a 12 with an offset flange. [redacted] somehow, with the 12 toilet in the basement, forgot to put the offset flange in as he did the tile work. In fact, he said he didnt even know it had to go in with the tile! Then he further stated that he didnt know how to install the toilet if it wasnt standard. Mind you, this toilet had been sitting in the basement for a month at this point.I was left with an unfinished bathroom: tub / shower not reglazed / completed, no toilet, no sink.I was left with a barely-finished basement, with defective walls / paint, no laundry facilities.[redacted] cut corners at every turn:- he hired (undocumented?) workers to complete most of the work. In the process of building out the furring strips, he broke the waterline to my washer and dryer. I have been without in-home laundry for months.- he promised me during his assessment that he would appropriately level the basement floor. No such work was done before he began laying tile (which was left 90% incomplete).- he promised that rigid foam insulation would be applied, but went to apply fiberglass, which I specifically asked *not* be used, as it was not appropriate for the basement application.- he refused to cut the drywall away from the floor, so as to prevent wicking in case of a flood, though this was also promised during his assessment. The maintained that the drywall was water proof. [redacted] does not understand the difference between water resistant and water proof.Desired Settlement: We offered [redacted] to settle this matter, by fixing the defective wall, removing the debris generated (which we've paid for, as it was included in the completed work), and asked he rework his estimates to itemize the materials for the bathroom. The estimate for the bathroom was supposed to include all materials, yet we paid for everything. [redacted] was supposed to present samples for our choosing, but presented only two (cheap) tile samples, and nothing more.[redacted] rejected our offer.
