I paid $3600 to this company in order to contract their services to cancel a Timeshare contract. They referred my case to KMS Group. After about nine months, KMS transferred my case to Orlando Ventures. It has been almost eighteen months since the initial contact and my contract has not been canceled. My fees are adding up as the annual maintenance fees were due and I could not afford to pay. I am 89 years old, on a limited income and unable to travel. When I contact Orlando Ventures they state that they cannot refund the money since it was not paid to them and they are still working on my case. I just want my money back. I do not want to continue with this contract.

We appreciate the additional time allowing us to look further into the status of this account. We understand the contact made concerning this account has been by the client's daughter, and that she has since had an opportunity to speak with a representative of the transfer company to confirm that the account is indeed being processed and its status. We understand that the major factor that slowed the processing of this account was the shutdown of Covid-19, making it difficult for the necessary exchange of communication and documents between the involved offices. For further confirmation of the details surrounding this account, we plan to reach out to the client for an opportunity to speak with her daughter.

In January of this year my wife and I entered a contract with this company. We paid them $8012.00 for an RCI member ship and the promise to end our membership in our present timeshare agreement. All of this money was paid up front by a credit card they put in for using our names and on another card that we owned. As of this date nothing has been done, they have not stopped the timeshare payments or the maintenance fees. They have not gotten the other companies to payback the fees they charged us before this, which was also part of the agreement. They got us involved with another company who was supposed to do most of the collections part of this contract. now both companies are not responding to my calls, at least three of them each. Since I seem to be locked out by these companies I felt I needed to put in this complaint to see if I could at least get them to call me.

I finally got a call back from them, I think it was because I put in the complaint, and we resolved the problem. I could leave it going for now if we can't find it or if we need to go through the resolution before taking it out.

To whom it may concern. On 3/12/2020 my wife and I met with representatives of Creative Consults LLC. They agreed to assist us in our attempt to get rid of our timeshare and all obligations attached to to it . We were assured,by them that this would happen. The following day they asked for a check in the amount of $2514.00 to start the process. A day later we received a letter asking for proof tat the maintenance fees were current. That alerted us to contact Island Links Resort. they told us that we were no longer the owners of the timeshare. Thus, the services of Creative Consults LLC were never needed. We requested a refund of our money. After many attempts to contact Mr. C, who is in charge of refunds, went unanswered. Since these services were not needed, please return the $2514.00 to us.

In response to these allegations, the client was made aware that they were purchasing inventory, and that the transfer of their existing ownership was a separate part of their sales agreement. (See attachment.) Additionally, client was repeatedly made aware of the necessity of full disclosure concerning the status of their existing timeshare ownership. Customer adamantly insisted that their transfer had not yet been done. They also reviewed the contractual agreement with a representative, and were given their own copies for their records. Furthermore, the fee for the transfer, or the process to "get rid of [the] timeshare", was waived. The purchase made was for inventory, and cannot be refunded. However, as a customer service gesture, client was offered a partial refund. It was refused.

We need to clarify a few points. In 2018 we hired *** to get us out of our timeshare. They promised they would return our money if the were unable to get this transfer done. After working with their lawyer, we thought we had a buyer. We had a quick claim deed with the buyers name. The buyer refused to pay the transfer fees, so we were back to square one. In the meantime, we received a letter from the secret service saying they had raided *** and our name was among the records they confiscated and we would be part of a civil suit to get our money back. The case was turned over to the secret service part of HHS in Washington D.C. We turned over all our records to them and waited for an answer. The answer never came so we hired Creative Consults LLC not knowing, of course that the transfer fees had been paid and we no longer owned the timeshare. In the meantime, we had already sent money to Creative Consults LLC. We found out that we didn't own the timeshare when we asked to verify that maintenance fees were current. I ***led Island Links Resort in Hilton Head S.C. to send us proof that the fees were current. This is when we found out our timeshare was transferred to the *** buyer. We notified Creative Consults LLC that we no longer owned the timeshare and requested our money back as we no longer needed their services. After many ***ls we were told they would not refund our money, but they would give us $200.00 so hoping we would go away. We refused their offer because it was less then 10% the $2514.00 we paid them. We feel this money belongs to us because the did nothing to earn it. Thank you for your effort in this matter.

With regard to the fact that the client no longer owns the pre-existing timeshare in question, the client was never charged any fee whatsoever for the service of exiting a timeshare. The fee paid to Creative Consults LLC was ONLY for the purchase of the travel/ vacation inventory that we offer our clients. These are two separate services, and therefore two separate fees. Again, the only fee paid to Creative Consults LLC in the amount of $2,514 was for the purchase of travel/ vacation inventory. Reflected in notes of previously attached document by clients. Additionally, the partial refund that was offered was not contractually obligated, but was in fact a customer service gesture. Thank you very much for your consideration.

Per your reply, we did not realize we were buying a vacation club. We were their to get out of our timeshare. We told them we were not interested in a vacation club, because of our health. My wife or I connot walk without aid. We feel this was done without our understanding. The only time a vacation club was mentioned was when we were about to leave that it would cost $200.00 for the year. We could cancel after the first year. We were never told it would cost $2514

Hello,

Attached you will find copies of real materials that consultants used when consulting owners with existing vacation products/ portfolio. These were uploaded in no particular order, but a few key things you can see about the process from these are: 1. Learning about the owners' existing vacation portfolio/ habits; 2. Sharing the transitions that have taken place in the industry; 3. The introduction of a new product, the product we offer, its benefits/ features and it how compares to what an owner may already have.

Also, with consideration to our recent conversation, regarding the question if the client was ever at any point aware that they were purchasing a vacation product in addition to being introduced to the option to pursue cancellation or transfer of their existing ownership with our partnering company, I offer the previously uploaded contract signed by the clients detailing that they were purchasing a vacation product.

Again, as previously discussed, our main focus has shifted from clientele who are owners of existing vacation programs/ products to non-owners without little to no real vacation plan in place. We seek to help people have better vacations for a better price. We are no longer involved with transfers/ cancellations.

Per your request this e-mail is telling you what we remember from our meeting in Polaris at the Red Lobster; We received a phone ***l from the company listed above about getting us out of our time share, After being told there was no obligation on our part and we would get our money back if they were not able to get us out of the timeshare. We agreed to meet with them at The Red Lobsters in Polaris. At this meeting 99.9% of the time was telling us how they would get us out and 0.1% of the time was talking about their vacation club. We were told this club was mandatory and it would cost $99 dollars a year and we would be able to cancel the second year. AT no time we were told there was a three day cancellation clause. We were very busy after the meeting and did not view the paper work until the three days had passed. My wife and I both have back ,hip, and leg problems and are unable to travel long distances. If we had known that this was a bait and switch scam, we would never have signed the contract. We would appreciate and help you can give us to get all or some of our $2514 back. Thank You

Excellent company committed to honesty & integrity! This company gives amazing education on how the timeshare industry works, and provides real solutions on how to vacation in a financially effective way! Highly recommend!

[If you do not say why you are rejecting the company's response, Revdex.com must close your complaint.]

Complaint: 14176186

I am rejecting this response because they did not try to contact me. They had my home number and my home address. They are lying. Because I refuse to pay the amount they are asking to try to get rid of my timeshare.

They claimed they could eliminate owners timeshare interest for a fee, if not, they refund in full the entire fee paid.

I did not feel that I had to pay to get rid of my timeshare, that been paid for. I could not use the timeshare any more because of my health problems with my back and heart problems.

Regards

This company promised they could get me out of my Timeshare contract. I was invited out to learn more about their services over dinner. Al C, who is the Manager of Operations advised me of their services and said I had to pay the full $2800 tonight to secure help. He said that a representative from his organization would contact me the following business day. I never received a call from them that week. I called them numerous times and no one answered their phone. Their contract states that customers are only allowed 3 days to cancel contract. Well I spent my 3 days trying to contact a company that never called me after I paid them $2800. By the time someone finally called me back it was from a 3rd party company named Advocause. The representatives name is Keli C she told me she was out of the office sick for 2 weeks because she had the flu and bronchitis. She said their is not anyone that’s trained to do her job if she is out of the office. Also, she said she thought she sent me paperwork to get my process started but but had problems with the internet server. To this date I have not received any other calls from the company to get me out my Timeshare.

At the sales presentation, I was told by the sales person that the purchase price for the product I was purchasing included the 1st year annual fee. It's listed on the contract as if it is included in the price. After purchase, I received a bill to pay the entire annual fee plus additional fee that I was not told right away for a total of $449 right away or be charged a late fee. After calling the company, I was shown something on the right side of the page that checked off something about being billed. That appears to have been a deceptive sales practice. Why list the $360 annual fee right under the purchase price, then have some deceptive check mark that's not explained until after the purchase.

Mr ***, per your follow up call with our management team, we are confident that it has been both established and agreed upon by both parties that in no way were any intentional deceptive tactics involved concerning your first maintenance fee responsibility. This obligation is indicated on your initial purchase proposal review prior to contract signing after presentation is concluded with a consultant, which is also respectfully marked to be billed. This purchase proposal review also points out that the agreement is a written agreement and not a verbal agreement. This contract is also in the possession of the client at all times before and after closing and could not be altered by our staff as all copies are identical. Integrity and honesty is foundational here at Creative Consults LLc as we seek strict adherence to these standards at all times where our consultants and staff are concerned. Per your conversation with management although unusual and unlikely that first year Maintenance fee is not known, in an effort to demonstrate a needed customer service gesture to you as a valued client, we have offered a one time credit for the first year maintenance fee obligation. Thank you for pointing out what has clearly been a misunderstanding. We seek to improve communication and excellence to insure clarity concerning this issue in the future.
