Mrand Mrs [redacted] leased a vehicle from us with NMAC, we did agree to give the customers back $2,as a contingency of the contractI have explained to Mrand Mrs [redacted] in detail on that processNMAC must first fund their dealPart of the delay is due to obtaining a form from Lenders and Members during the holiday's, NMAC requires that prior to funding and it must be an originalAfter obtaining the form and fedex'ing it to NMAC, they rejected the contract and stated that the customers credit tier required a double security deposit, which was unknown to us at the timeOur system is not set up to properly do a lease that required a double security depositAfter back and forth phone calls with our software company we got it figured out and we had to resign the customerWe paid for the customers security deposit in its entirety along with the aquision fee and the customers first payment as stated on the contract the sum of $1,As of today 01/22/NMAC has not funded the dealIt is expected to fund todayAs soon as it funds we will issue the customer a check for $as agreedI have on multiple occasions offed the customer to return the vehicle and I would cancel the contract id they felt they were not receiving a good deal When Mr [redacted] came into the dealership I was on a conference call and was unable to visit with himI have attempted to return his calls several times, he will not answer my callsI have since spoken with Mrs [redacted] and all issues have been rectifiedIt was explained to Mrs [redacted] that the reason their current lease wasn't grounded on 12/16/is because their deal is a marginal credit approval and if NMAC rejects their loan for any reason they would not get the agreed upon $2,cash back which was to be used to pay the reaming balance owed on said lease Attached is the contract with that shows the customer is responsible to pay $1,which included to first monthly payment and the double security depositThey did not pay we paid for them as part of the agreed upon negationsYou will also find a copy of the we-owe that clearly stated we will also give them a check for $2,(WHEN THE DEAL FUNDS)We will NOT pay or give anything else than we already had, as Mr [redacted] has requested on several emails My offer is still on the table that I will allow them to bring back the vehicle until NMAC funds

Mrs [redacted] purchased a Nissan Murano with vin# [redacted] on January The vehicle was a certified pre-owned vehicle that passed the certified inspection at the time of saleMrs [redacted] reached out to me the first time in mid-February and complained about and stated she discovered that the vehicle had wheel locks and accused us of misrepresenting the vehicle because we failed to disclose the vehicle had wheel locksI apologized and offered to pay or send the customer a key for the wheel locksShe opted for me to send the keyShe texted me a picture and we sent what we thought was the correct key based on the pictureWhen she received the key she called and stated it was wrongI again apologized and explained to her that it would be much easier if she would purchase a key their so that we know its correct and send me the receipt and I would reimburse I did not have communication with her until she called in July and demanded me to pay for roughly $worth of tires, this demand came after the stated that we are liars and thefts and sell bad cars and that she was going to send letters and complaints to any and every one she can I apologized that this USED vehicle has given her a few issues that; that is never our intentIt does us no good to sell a vehicle with known problemsHowever she purchased a used vehicle months ago and then threatens and demands me to pay for any and all repairs someone and/or other dealerships are upselling for profitIs something I am unwilling to do that I have fulfilled everything we were contractually obligated to doShe asked if I would pay for ½ of her tiresI told her that *if she purchased the tires from me so that I do not have inflated profit built inShe than stated that she would not do that and stated her offer was off the table and I need to send her a check for $1,for all repairs and if I didn’t she would file a complaint with NissanShe was unaware that I was aware she filed a complaint with Nissan the previous dayI told her that I would not be threatened or blackmailedI apologized that she had those issues and I did remind her that she drives excessive miles and the vehicle was usedAnd I would not just pay for issues any time she feels I shouldShe then hung up on me Attached is the service recordsRO # [redacted] (2) pages that is when we performed the initial UCI (used car inspection) pre-sale bill was $RO # [redacted] cost $additional repairs found after the UCI RO# [redacted] 2nd key $we paid as per the CPO program Certified fee of $ We spent a total of $1,for reconditioning and certifying The We-Owe—What we agreed to fix or do as part of the sales Signed by the customer Buyers Guide—selling the vehicle as is Signed by the customer CAR FAX signed by the customer The deal analysis showing we actually lost $selling her the vehicle due to the vehicle being over days old in inventory You will find we are transparent as possible and our intent is to always do what’s right, but at the end of the day we are a business and we cannot just arbitrary pay for un expected issues on used vehicles months after the customer purchases I might have considered something else if the customer would not have tried to black mail me from the beginning of the conversationI am sincerely sorry that she had issues but it is a used vehicle and we were transport in every part of this transaction and based on the documents signed by her and us we have fulfilled every contractually obligation Her comments About us being unethical and un-disclosing is wrong as per all the evidence attached Long in the short she is mad and upset that she has had unexpected repairs on a used vehicle so soon after purchasingI don’t blame her however, vindictive behavior for us not good willing issues is absurdHer attempt on black mailing could be construed as harassment

service department for this issue beforeHe stated that he had not but he has called and our response has been we can not diagnose vehicles over the phone that he would need to bring it in for serviceHis wife *** *** came in for the first time on 09/01/and did not get with service, she got with the Finance ManagerShe was informed that their was a service contract on their vehicle and he was unsure if it would cover that particular problemShe stated she would talk to her husband and figure out a time to schedule it with serviceHe husband called the store and asked for meI spoke to him and explained to him that he purchased this vehicle months ago and if he has had this problem why hasn't he brought it in earlier.He wants us to pay for the repair in its entirety, or else he would "*** ** ***"I told him that he had a few options1.) bring it in to service and lets see if the warranty would cover the repair. If not I would extend the repair at dealer cost customer expense. 2.) he could call his insurance and file a claim and see if it is a repair they will cover.3.) he could bring the vehicle in and we can look at what we can do to trade him out of the vehicle. As of today 09/the customer still has not had the vehicle in our service department for his issue After his threats which were recordedI called the police and gave them the recordingThey told me that if he came up to the store with any further threats that; that shows intent and to call them and they would have him arrestedI have attached a portion of the recorded phone conversation yesterday that was forwarded to the police.I have also attached the We-Owe on what we agreed to fix as a contingency of sales.We can not arbitrarily pay for any and all issues on vehicles purchased months agoIf this had been a pre-existing issues I am sure we would have heard about this within the first days of purchase, which we did notThis is simply someone attempting to get something for free

I am rejecting this response because: Yeah I told him that because of the blatant disregard of my sons health and that he isn't going to fix for free they should have several phone records of us calling about this issue as well as Chevy I'm not simply wanting it fixd for free or trying to get fixed for freeThat's fine don't fix it and back the integrity of your products you are selling when my son gets Ill or or hospitalized I will drag everyone involved through a law suit I don't care what was recorded or filled with the police what gives you the right to put my sons Life in dangerAnd if you don't have record of calls that just means you and your employees aren't doing their job properlyEvery time we have called our options were to drop off the vehicle without loaner car how are my kids a fiance supposed to go to appointments or grocery shopping by law if you keep car for repairs more than a day you have to provide a loaner vehicleThe attached is both front floor boards of my vehicle has been cleaned numerous times in the time we've had the vehicle because when we call we get answers like you need to call chevyYou need to call your insurance Bing the car to us but there is a long wait and we don't have a vehicle to give youyou did not inspect the vehicle properly in the first place but yet it's your coustomers problem to foot the bill to fixYou could have told me that and offered to lower price of vehicle but no you want to wah your hands of it because you already have your moneyI will never buy from your establishment again and I will tell everyone I know kind of people and service you provide

Our system is not set up to properly do a lease that required a double security deposit. After back and forth phone calls with our software company we got it figured out and we had to resign the customer. We paid for the customers security deposit in its entirety along with the aquision fee and the customers first payment as stated on the contract the sum of $1,946.30. As of today 01/22/2018 NMAC has not funded the deal. It is expected to fund today. As soon as it funds we will issue the customer a check for $2000.00 as agreed. I am rejecting this response because:  description is inaccurate as Nissan changed the paperwork without my approval.  BOA did approve both names o Monday but as submitted by Nissan it appeared fraudulent to them them.  The sales person was contacted but did not inform mr [redacted].  I have witnesses.
