Creative Pool Designs, *** *** *** and *** *** *** representing *** *** and their employees / subcontractors have tried to help Mr*** with his problems Unfortunately, no one is able to make him happy He wants to dictate to each exactly what they / their company is to do to satisfy himHe fails to recognize or accept that if he had certain specifications on items such as the fire pit, he should have made those clear prior to accepting the proposal and signing the contract The plaster was handled correctly and he has refused to get the help he needs CPD balanced the water on startup / turnover but is not a service company that continues to handle the water chemistry -- there are companies that specialize in doing that -- we have continually suggested he hire one to assist him in keeping his water chemistry correct He has continued to ignore us and *** *** *** As for the fire pit, it was built exactly like all the ones our subcontractors have built in the past. As a matter of fact, some companies do not include any air lines or drains in their fire pits We have made every effort to adjust the pit to accommodate his requests but we are not going to rebuild what he now has decided he wants. None of our subcontractors wish to return to his project due to his unreasonable demands and racist comments. First, I’ve included the definition of pointing (CPD referenced in email below to masonry work) in case you’ve never heard of this term.

It's been a really long day but I did want to get back to you all regarding the fire pit since I said I would. The “grout line will be pointed” and fire clay will be put on the interior wall. Javier will also check the air line to be sure the flooding didn't clog it. Javier and Jim took some pictures when they were there. I will get them and forward tomorrow if time allows. If not, it will be Monday.
I asked that CPD be on location while the fire brick was installed and the repair “pointing” of the grout/mortar was taking place The recently applied firemortar cement/clay/grout is already flaking on top and no fire has been started since the so called attempt to repair. They also failed to wash off the excess mortar/grout that are on the nearby stones. Lack of supervision over the CPD subs has been one of the biggest issues throughout this entire project. You can see by the pictures no “pointing” was performed. They removed some of the grout, but never added any back (except for the very small amount of the wrong grout color seen in the pictures). My only guess is that they brought the wrong color grout and left the job unfinished. Why else would they leave these huge cracks after they were sent there to specifically “point” the grout lines. After chipping out the grout and not filling, the cracks are worse now than before and I would hope that CPD wouldn’t except this low level performance from their subs if witnessed personally for themselves.
The reason for having to “point” the grout lines was due to high heat exposed to the grout and stone while not having the proper fire protection (fire bricks) installed in the pit originally. It you remember back I reported that the fire bricks stayed on my back porch for weeks and then disappeared and never were installed. I also sent CPD a basic instructional web site on how to build a fire pit successfully. I’ve attached below, please have a look. They got the drain part of the fire pit correct by upgrading the pipe from PVC to steel (you never use PVC inches away from a flame), but failed to install air vents or leave out stones so that the fire could receive the proper amount of oxygen to burn, and not just smoke and smolder as it has since the beginning. As stated very clear in the previous response, the drain line (not an air flow vent) is going a foot or more underground, it then 90’s and goes many feet away and will not allow air flow into the fire pit. CPD stated that they handled the fire pit issues correctly and consider it closed. This issue is not closed and the pictures attached will obviously show it.
Pictures are worth a 1,000 words, but actually seeing for yourself is always the best business practice. Wish I had a picture of my wife’s expression while she was admiring the last attempt to repair the grout.

Plaster:
I sent an email 6 days ago (below) requesting assistance from CPD regarding the plaster acid bath. The streaks are still visible and have been since before the pool was turned over. I have yet to receive a response on the email sent on 7/20, but really not surprised. I doubt that anyone would consider this length of response time or lack thereof Better Business. This will also remain open.

Good morning
I’m about 36 hours into the acid wash and the pH has climbed on its on to the bottom of scale as per my testing kit (~6.8). At this rate of climb, I estimate the pH to be somewhere near 7 or maybe higher this afternoon. The pool is real cloudy as you would expect while removing a lot of the calcium. As experienced during the first acid bath, most all of the plaster has improved drastically, but the streaks along the steps and the most obvious white splotch in the hot tub appear to look the same. It’s very cloudy as stated and hard to really tell, but they are still visible under the cloudy water.
[redacted]’s guidance given for the acid bath only covers the basic first steps. What are the next steps that I need to take? Let sit and continue to brush? Turn filter pump on once pH is at a safe level to run through the heater, etc? Dump more acid? Please advise…Thanks for the help
These two issues will remain open.

Review: Breach of contract. Project not completed on time nor in a professional manner.

Contract signed 03-23-2013 with deposit. I questioned the completion date of 10-03-2013 on contract and was given verbal promise that pool completion would be by Memorial Day Weekend (Approx 05-30-2013). Construction was not completed by 05-30-2013. Was given verbal promise completion date of 07-04-2013. Pool not completed by that date. Was given a verbal completion date of 08-30-2013, again pool was not completed. Contractor was paid always in a timely manner. Contractor failed to show up to perform duties as he stated would be done. Contractor failed to use funds for what they were intended. Contractor failed to use verbally agreed upon parts. Contractor failed to provide receipts. Contractor failed to conduct product research prior to providing his bid and then asked for additional funds. Contractor failed to comply and honor his verbal agreements for completion dates multiple times. Contractor failed to complete pool construction by signed contract date. Contractor failed to provide a professional workman like manner. Contractor failed to provide adequate amount of materials. I had to personally pay hired sub-contractor to ensure he would come to my site to perform his services. Contractor failed clean up worksite after each job. Contractor did not comply with his verbal dates and promises. Desired Settlement: $5,000.00 We are seeking for not having the correct equipment we verbally agreed to. For not having the project completed in a timely, professional manner. For the additional funds we had to pay because the contractor acknowledged that he did no research on the products we requested at the bid prior to the signed contract. For the funds we had to personally and directly pay the sub-contractor to guarantee he would arrive at the job site to complete his service.
