I had a contract with this company that governed my assigned judgment to them, that clearly states that it can be cancelled by either party in writing, l was told if this happens l would get my judgment back and that they are to take only 40% of collected money after assignment. On 1/26/20 l sent them a cancelation letter and when they received it they where very rude refused to cancel the contract, refused to return my judgment and they have been collecting 50% of payments from the very beginning not 40%. They continue to collect to this day, approx. $4500 so far.

To Whom It May Concern,This is in response to the complaint we received by our client ***. He states in his complaint that we are charging him a commission rate of 50% but that our Collection Agreement stated it would be 40%. He is also stating that he requested we cancel his account and that per the contract he is entitled to do so. He is wrong in both instances.First, regarding our commission rate. I have attached a copy of email correspondence between me and Mr. dated 11/13/17, prior to him assigning the judgment to our office. In the email, I clearly state to him that our rate is 40% but would go to 50% if we have to use our attorney. Also, I have attached a copy of our Collection Agreement that was signed by Mr. and myself. This agreement clearly states the same thing I had indicated in my email-that our rate is 40% and 50% on a legal account. In this instance, we had to forward this matter to our attorney as we were able to track down the defendant's place of employment and served her employer with an Earnings Withholding Order. This was done by our attorney, hence the reason our rate went to 50%. With regards to his statement that our agreement can be cancelled by either party in writing, yes, that is correct as per Section 6 of our Collection Agreement. However, it also states in Section 6(a) and 6(b) that if Agency has initiated any form of litigation or has an agreement for payment of the debt that the account cannot be cancelled or withdrawn. In this instance, we have both initiated litigation (wage levy) AND we have an agreement for payment as we have been levying the defendant's wages since September, 2019.What is happening here is Mr. had a judgment that he could not collect. He assigned it to our office so that we could enforce the judgment and collect the amount due and that is exactly what we are doing. The problem now is that he knows the payments will continue to come in from the wage levy, but he no longer wants us to be paid for our work. As you can clearly see, our office has done absolutely nothing to warrant a complaint. To the contrary, our office has done exactly what we were hired to do so we feel praise is in order, not a complaint. This is a sad example of greed on the part of ***.Kind regards,

To Whom It May Concern,This is in response to the response we received from ***. Mr. states that we forwarded this judgment to our attorney's office for the sole purpose of justifying our rate of 50% rather than 40%. He states that we should know how to execute a wage levy so there was no need for us to send this matter to our attorney. Well, he's right about one thing which is that we do know exactly how to execute a wage levy. The problem is, California Case Law prohibits a Corporation from representing itself in court. Therefore, it is impossible for us to execute on a wage levy without our attorney due to the fact that we are a California Corporation. I am rejecting this response because:
These guys are such crooks and l can't wait to get them in court. THE WAGE LEVY IS NOT SETTING A COURT APPEARANCE OR HEARING. THERE WAS NO COURT REPRESENTATION NEEDED. I COULD'VE DONE THE WAGE LEVY MYSELF! WHAT ABOUT ALL THE OTHER THINGS I BROUGHT UP IN MY RESPONSE. I CAN'T WAIT TO HEAR ANSWER. THEY NEVER HAD AUTHORISATION TO HIRE ATTORNEY EITHER.
