Initial Business Response / [redacted] (1000, 5, 2015/06/13) */ This unfortunate incident dates back to December 7, when [redacted] 's son [redacted] was involved in the theft of $at a team meeting in a restaurant that is also a sponsor of the teamWithin three days of becoming aware of this situation, the executive board of Creek Flash Baseball had fully investigated the incident in a good faith manner and levied appropriate consequences to all three players who were involved (see attached documentation)During our investigation, the only adult who refused to speak with us about the matter was [redacted] , and to this day he insists only to email us about the money he claims he is owedHe seems to believe that his son [redacted] was completely innocent and did not deserve any of the consequences imposed, despite the fact that the restaurant was considering filing criminal charges against his son as the only person caught on surveillance taking the moneyBut despite our intervention to save his family that embarrassment, [redacted] still decided to pull his son off the team without ever speaking with us about it, and in direct opposition to what his son and ex-wife wanted (many tears were shed around the holidays about ***'s decision) [redacted] took this unilateral action despite the fact that he was informed he would only be entitled to a partial refund since many baseball-related expenses have already been committed by late DecemberHe also fails to realize that our partial-refund policy is generous as compared to other organizations who provide no such money back if a player quits To this day [redacted] seems unable to comprehend the serious nature of his son's offense, as is evidenced by the fact that he conveniently omitted it from this Revdex.com complaint [redacted] has also failed to realize that the restaurant was considering pulling their sponsorship of the team and only agreed to stay on after Creek Flash Baseball offered them advertising benefits that are far above and beyond what they were otherwise entitled tojust to keep them onboard for the benefit of the other players who needed that financial sponsorship [redacted] has also not cashed the refund check we sent him via certified mail, which he received on December 23, And perhaps most sadly, [redacted] seems unable to understand that other players were involved in this incident and both of them accepted their consequences, even though [redacted] was the only one who actually stole the moneyInstead [redacted] has consistently refused to engage in a good-faith discussion, then he threatened legal action, and now he has filed this complaint in an attempt to tarnish the reputation of our organization and force us to release funds that we simply do not have To provide some context, please be aware that Creek Flash Baseball is a 501(c)(3) non-profit organization which exists to serve the SE Aurora community, specifically families who want to have their kids play tournament baseball but can't afford to do so through traditional avenuesWe offer both scholarships and business sponsorships to help families afford the year-round competitive baseball experience at a fraction of the cost of other for-profit organizations including Bardo's, Slammers, and HitStreakIn fact, the player who replaced [redacted] 's roster spot on the team came from a disadvantaged family and fortunately was able to quickly obtain a business sponsorship for his basic expenses, but not enough to cover the full cost of tournaments, extra team uniforms, and team liability insurance which are the most expensive itemsThis is the reason that Creek Flash Baseball is unable to provide [redacted] with the additional refundIf the extra money had come into us from the replacement player in January, we would have been able to provide [redacted] an additional refund; but since the replacement player was only able to afford his basic expenses, there is simply no money available to give back to *** Attached to this response is a document with scanned images that detail the entire history of this unfortunate situation, in chronological order dating back to December 13, and going forward to May 28, 2015, the day that [redacted] filed this Revdex.com complaintAlso attached to this response is a copy of our old by-laws which were in effect at the time this incident took placeSince this incident, we have created a new parent/player handbook which spells out specific consequences for criminal behavior such as what [redacted] did on December 7, and there are NO REFUNDS AT ALL! The above statement is so delusional and ridiculous it does not merit a lengthy response except to say that the money clearly due to us was given to another familyWe are entitled to these funds as per all the emails we have provided and we would SIMPLY like to donate the funds to a charity of our choice(The email dated 5/@ 12:53pm clearly states the refund amount of $435.40) we were due until Creek Flash Baseball took it upon themselves to grant a scholarship to another player As a side note, I was going to file harassment charges against Ms [redacted] but decided against doing so and informed Ms [redacted] to cease and desist contacting me in the futureDid she provide those emails? This organization already has a bad reputation within the Colorado Baseball community and you will undoubtedly be receiving further complaints about Creek Flash Baseball in the future Final Business Response / [redacted] (4000, 10, 2015/06/24) */ Since [redacted] is unwilling to acknowledge the factual sequence of events in this case that began with his son's behavior on December 7, 2014, it seems unlikely that we will be able to reach a "middle ground" resolutionCreek Flash Baseball stands by the initial response submitted to Revdex.com: that we communicated in good faith with all parties involved in this matter and resolved the situation by promptly levying consequencesWhen [redacted] found the conditions unsatisfactory and threatened to quit, we informed him that he would only be entitled to a partial refund of "uncommitted expenses."
