[redacted] ***,I am writing in response to the complaint lodged by [redacted] ***Our staff did speak to [redacted] in late January to answer questions specifically regarding the death of his partnerHe was informed at that time that since the mother of the deceased was still living, she would need to sign the cremation authorizations-since there was no appointment-of-agent or statutory durable power-of-attorney signed between the decedent and his partnerWe were not informed of the ailments afflicting the mother of the deceased that would prevent her from signing the cremation authorizationsPer Texas Health & Safety code 711.02, we have to proceed in the order of primacy for the next of kin to determine who will sign the cremation authorizationsSince [redacted] was not the spouse of the deceased and the decedent did not have any adult children, we had to require a surviving parent to sign the formsWe were notified that the mother would not be signing the forms and the brother was requesting to do soAgain, referring to and the Texas & day law(the law reads that if the legal next-of-kin is aware of the death AND is either unable or unwilling to sign the cremation forms, THEN having failed to do so, has forfeited their rights of disposition and we can proceed with the succeeding next-of-kin according to the order of primacyHowever, if the legal next-of-kin is unaware of the death, we must wait days before we can proceed with the legal next of kin's signature.), we were not put in contact with the mother of the deceased and had not had any form of contact with her prior to or after the death had occurredIn such instances, it is the funeral home's policy to adhere to the day ruleAs to the claims of discrimination of any nature, it is not the policy of this funeral home to engage in such practices for any reason and there was no discrimination that was perpetrated against either the deceased or his partner based on any criteria involving the deceased's personal or public lifeUnfortunately, there were delays due to lack of proper paperwork, signed by the deceased, naming either the partner or the brother of the deceased to complete the forms soonerIt is the stance of this funeral home, that with regards to the law, we will follow the law, both in letter and spirit.Respectfully, [redacted] ***

Per Texas Health & Safety code 711.02, we have to proceed in the order of primacy for the next of kin to determine who will sign the cremation authorizations.
