Crescent Bank (Crescent) is in receipt of Ms*** complaint regarding an account with Crescent. Ms*** purchased a Mitsubishi on 7/8/2008. The account went
into default and subsequently was charged to Profit & Loss on 4/27/Ms*** later made arrangements to pay on this debt. The debt was settled for less than was owed on 3/5/2012.
Ms*** called our office on 4/9/and advised us the account was showing a balance on her credit report. Our records indicated we were not reporting the account to the credit bureaus and we have no explanation as to why it showed up on her TransUnion report. An update was submitted to the credit reporting agencies on 4/9/requesting to delete the trade lineThe reference number for this submission is AUD Control Number: *** TransUnion, Experian and Equifax verbally advised Crescent on 4/27, that the account is not reporting on Ms*** credit report

3/17/The payment was posted that day with an
effective date of 2/8/2015, which was the date of the accident. The amount received was not enough to pay
the entire balance on the account and the deficiency balance is due.
Ms***’ contract, which
she signed on 3/7/clearly states; “I agree that loss, damage to or
destruction of the Vehicle shall not affect my duty to make payments under the
ContractThe Contract disclosure stated the amount financed and the Annual
Percentage Rate that would be charged By signing the contract Ms*** agreed to
pay the total amount due

am in receipt of Mr***’s complaint rejection to our response regarding his account
with Crescent Bank (Crescent)Crescent tried to work with Mrand Mrs***
but they have not made an effort to pay on this debt. The last payment was received on 10/10/
Since that date we have left many messages for them but the calls were not
returned until 12/5/when Mrs*** called and said she could pay some of
what was past due. When an account is
seriously delinquent Crescent representatives cannot accept partial
payments. The account is now months past
due

For your reference, details of the offer I reviewed appear belowCrescent Bank states that we signed a contract on 3/1/that our payments of $are due on the 15th of each month, which I concurWhat the issue is here is that on Dec 5th when my wife tried to call in a $payment, which is the amount with the late fee they stated we were months behind and are sticking to thisOn Dec 5th we were only months behind paying one of those months in fullAs by the contract which Crescent is basing their side of the situation on we were not due to pay said 3rd month until the 15th of DecTo add to that Crescent gives you a day grace period before the late fee is added on the 25th of each monthThis is our stance on the situationThey are trying to change how the months of our contract our readIf our payment is due on the 15th, not by the 15th but on the 15th then our month runs from the 15th of the month due to the 14th of the following monthOnly when it hits the 15th of the next month are we one month behind, not on the the 1st or even the 14thSo as stated in our contract we were only months behind paying one month, and my wife kindly tried to pay an extra $toward the 2nd month, while making arraignments for making paying on the 19th of Decand the 2nd of Jan to be caught up in fullGoing by what Crescent bank has stated we were only two months behind by the language of our contract, and we were trying to make a FULL one month payment as they do not accept partial payments while trying to set up future payments to be up to date with themAs we still would like to due business with Crescent bank and put this behind us, what we would like to do is make a payment of $on Monday the 22nd of December to pay the two months we are admittedly behind, and has our vehicle returned to us without any additional feesThen we would like to make a payment of $on the 2nd of Janas we will be out of the grace period and have the late fee for Decembers payment, as to the language of the contractWe stated this on the phone to those we spoke to that the contract states due on the 15th, not due by the 15thWhich again only put us behind two months, and we were trying to make a full month payment to be only one month behindThis is all by the language of the contractThank you

complaint regarding her account with Crescent Bank (Crescent) and a payment to the accountCustomers can make payments on accounts through a link on Crescent’s website. The link takes the customer to our payment vendor, ORCC. We have investigated this matter through our vendorMs*** went to our website and accessed the link to ORCC on 4/28/at 11:AM. Once on ORCC’s website she set up a payment to be charged to her credit card ending in in the amount of $She set the payment to be charged on 4/28/The payment was processed on the date requested (4/28/2015) at 2:PM. Ms*** phoned our office at 6:PM and advised us a payment was scheduled for 5/4/but it was charged to the account on 4/28/2015. By the time Ms*** phoned us the payment had already been processed. Crescent cannot alter payments made by customers through our website; that would be a security violation. We also could not call her bank and make changes on her accountA bank would not make changes on a customer’s account from an outside source. We advised Ms*** to dispute the transaction through her bank since only they could resolve the issue

Thank you for letting us know about the issues that you are having with Crescent Bank.   Before responding to your complaint, I wanted to better understand the history of your account.  I reviewed our call history for your account, because it would be quite unusual for us to call...

the co-borrower before calling the borrower.  I found that we tried to reach your son 62 times from January 17, 2014 to June 23, 2016.  Unfortunately, he did not answer or return any of those calls.  The call history shows that we called you seven times, from February 24, 2016 through June 23, 2016 and only one of those calls was not precipitated by a call to your son.  We do appreciate you taking our phone calls and calling us back.  That has been very helpful in keeping the account on track.  However, we certainly understand that you do not want to be called by us and we placed a “do not call” flag on your phone numbers on June 23, 2016.Your June 22nd payment, submitted through our telephone payment system, was processed and posted on June 23, 2016.  Our system does not advance the next due date until payments post and it did not post until after we called you.  I can understand your frustration because you had already authorized a payment but still got a call from us.  I do apologize for that and would like to thank you for bringing this to our attention.   We are going to look into improving that process.Again, I would like to thank you for bringing these issues to our attention.

Several payments received were notated to apply any extra funds to the principal of the loan.  Those payments were posted in 2 different transactions to show the extra amount that was posted to principal only. Crescent Bank (Crescent) is in receipt of [redacted] complaint regarding an account with Crescent. Ms. [redacted] purchased a 2006 Chevrolet Malibu on 8/30/2008. The account was originally...

assigned to Independent Dealers Advantage (IDA). It was then assigned to Crescent Bank (Crescent) on 12/30/2008. On 7/8/2011 an impound notice was received stating the 2006 Chevrolet had been abandoned at a dealership; the vehicle was then repossessed and sold. The proceeds of the sale of the vehicle were applied to the principal balance of the account but it was not enough to pay off the entire amount due. The deficiency balance is still due. Crescent has not received any payments since the sale. Interest has been accruing at the contractual rate since July 2011. This is provided for in the contract. The contract does not end after the sale of the vehicle if the balance is not paid in full. The contract allows for interest to continue accruing until the loan is paid in full. This is a valid debt; Crescent would be happy to work with Ms. [redacted] to help her resolve this issue.
 
A copy of the contract, assignment and payment history will be sent to Ms. [redacted].

that were included when he purchased a 2010 Nissan Altima.  The   policies were sold by the dealership, Landers Dodge Chrysler, 2701 Benton Road, Bossier City, LA 71111.  GAP and Warranty policies sold by the dealership can only be cancelled through the dealership.  I apologize for any confusion in this matter.

Thank you for contact us regarding the problems you have had with your vehicle.  I researched your account to better understand its history.  Our notes indicate that on December 31, 2015, the vehicle would not start, resulting in your request that Mazda Roadside Towing bring it to Mazda...

for repairs.  The towing company was not able to deliver the vehicle to Mazda because there was no “night drop”.  You never received a call from Mazda, to let you know that they did not receive your vehicle and then the towing company assessed a storage fee for storing the vehicle.  I am sorry that you have had such a hard time with Mazda Roadside getting your vehicle to its intended destination.  Unfortunately, we are not in a position to help you with the towing company or Mazda.  We fulfilled your request to voluntarily surrender the car, retrieved it and sold it at auction.  There was a deficiency balance because the amount owed was more than the funds received at auction.  Our agreement with the Credit Reporting Agencies requires us to report accurately and, at this point, your account remains deficient.  If you wish to pay off the account, please contact us, toll-free, at ###-###-####.  We would be pleased to report your balance as paid in full, once you pay the outstanding balance.

am in receipt of Mr. [redacted]’s continuing rejection to our response regarding his account
with Crescent Bank (Crescent). On December 5, 2014 the account was past due for
the 10/15/2014 and 11/15/2014 payments plus late charges that were due.  Payments are due on the contractually
scheduled due date. The grace period determines at what point a late fee may be
assessed.  The account is now 3 months
past due and the vehicle securing the contract has been repossessed.  Mr. [redacted] can get the vehicle back and
reinstate the contract by paying all past due payments, late charges and
repossession costs.  In order to
reinstate the contract Mr. [redacted] will need to contact our office for the total
amount due.
