To whom it may concern,This letter is in response to case # [redacted] Mr [redacted] did in fact bring his Teryx to our dealership for repairs even though we were not the selling dealer(his dealer) and we advised him from the start that they would be his first and best option for any repairs The machine is not brand new as is stated in Mr***'s claim It, in fact, has hours of hard use Per the manufacturers recommendations in the owners manual, the machine should have had services by this time and is approaching time for the third The first service should have been done at hours and the second and hours The third should be done at hours, which the machine has not quite reached but is getting close We have seen no evidence that any proper maintenance has been performed on this machine at allIf we were the selling dealer, we would have advised him of his responsibility to perform proper maintenance If the selling dealer did not, this is yet another reason he would be best served to take it to them for repairs, to clarify any misunderstanding between Mr [redacted] and the selling dealer(not Crewe Tractor) Due to this lack of maintenance, especially of the machine's air filter, dirt and debris has passed into the engine where it should never be thereby causing damage and likely the issues Mr [redacted] is complaining of In addition to lack of maintenance, Mr [redacted] has made several modifications not approved by the manufacturer We were not the selling dealer of this machine The selling dealer allegedly advised Mr [redacted] that these modifications were ok and would not void his warranty We have advised him on several occasions that, since they are the company that advised him the mods were acceptible, that he would be best served by taking it to said company for any repairs The modifications made, in fact, were not even done properly according to the specs of the manufacturers of those accessories We are well versed with the warranty procedures of our brands and did not need, in fact, to contact them concerning this matter It is clearly stated in Mr***'s owners manual that "if a failure is found to be caused by improper servicing, it would not be covered by the limited warranty." We also believed that it would be in the interest of Mr [redacted] not to contact the manufacturer but to allow the selling dealer to do such We believed, as is still our belief, that he would get the best results working out a deal with his selling dealer and the manufacturer Any contact Mr [redacted] forced between us and the manufacturer has hurt his effort to get his machine repaired under warranty as we can only provide the manufacturer with the facts we have which are that the machine is improperly modified and improperly maintained and misused We felt that the selling dealer may have information to offer the manufacturer that we do not have and that it may be information that could be helpful to Mr***'s cause However, Mr***'s refusal to expend the time and energy to take his machine to the selling dealer has definitely not helped him We did contact [redacted] per Mr***'s insistence regardless of his knowlege that it was not in his best interest They are in a different time zone than are we so if I was mistaken about their hours of operation, I do apologize about that It was not done in malice and did not affect his case in any way [redacted] has advised that they will not make a decision on a warranty claim until the engine is torn down Therefore Mr [redacted] would have to be willing to pay the cost of the teardown in the event that the manufacturer does not He is not willing to do that For all these reasons we are not able to work on his machine and have advised him of this since the beginning of our dealings with Mr*** He is free to, and we have urged him to pick up his machine and take it to his selling dealer He did enter into a contract with his selling dealer(again not Crewe Tractor) and they are certainly his best course of action as we have advised and continue to advise Mr*** Sincerely, [redacted] *** Crewe Tractor

Review: I bought a new [redacted] March 7 2015 @ [redacted], Winston Salem,NC. July 5 2015, I was driving my UTV and it started to blow oil/smoke out of the exhaust. On July 13, I spoke with Will @ Crewe Tractor (which is a dealer of [redacted] and the closest to me) in regards to my 2015 TYREX UTV. I was told not to bring in my UTV until Aug 15. That day I took my UTV to Crewe Tractor, spoke with Chris and was told that my UTV should be covered NO PROBLEM and Crewe Tractor would call me on Aug 17 BEFORE they contacted [redacted]. Also, he said the process should take a week no longer than 2 weeks. Last thing he said Crewe Tractor should call me on Aug 17. Aug 17 Will called and said they were not warranting it because of the dirty air box then I called back to get [redacted]'s phone # and spoke with shop mechanic at Crewe Tractor and he said dirty air box was not the problem. The programmer and exhaust was the problem which Kevin Powell Motor Sports said would not void warranty. I then called [redacted] and was told all modifications would be fine as long it didn't break into the engine. WHICH I DIDN'T GO INSIDE THE MOTOR! Also [redacted] told me that they had never been contacted by Crewe Tractor and [redacted] would get back with me because they needed pictures from Crewe Tractor. I contacted Crewe Tractor MULTIBLE times and spoke with Will and he said that he would take care of it. NO ONE has contacted ME. The last contact was on Sept. 1. I called Will @ Crewe Tractor and he said he had to call [redacted]. Will said they DID NOT OPEN TIL NOON. I said ok and immediately called [redacted] at 10:42. THEY WERE OPEN! [redacted] said they NEVER received pictures from Crewe Tractor and they were WAITING ON PICTURES since AUG 17!! [redacted] said to call them back @ 1:00 and I did. [redacted] said they would call back @ 4:00. [redacted] said they needed picture of inside motor. Said if they do not warranty I am responsible for motor breakdown cost. WHAT WOULD CAUSE ME TO HAVE TO PAY ANYTHING, ITS NEW!??Desired Settlement: I WANT THIS REPAIRED UNDER THE THREE YEAR WARRANTY!! THERE SHOULD BE NO COST TO ME THE CONSUMER!
