Dear Revdex.com, Mr [redacted] applied for an apartment on July 30, The application was signed and his deposit and application fee was paid, application was approved and confirmation Welcome Letter was sent to him July The scheduled move in date was for August 6, Mr*** cancelled his move in on August 5, In the application a large area is highlighted in yellow stating: I understand that if this application is approved and applicant fails to move in for any reason, the security deposit paid will be applied to any damages that Owner incurs as a result of the cancellation, which includes, but is not limited to, lost rent on apartment being held for applicantI also understand that if this application is not approved for any reason, or the application is cancelled within after placing the deposit, the $will be returned to applicantThe lost rent on the apartment because it has not been leased yet exceeds the $deposit amountOur application is in line with the Virginia Landlord Tenant Act

I have reviewed the offer and/or response made by the business in reference to complaint ID 11638112, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.I understand the response however; due to life threatening health conditions this should be waived If I was to terminate my lease due to the fact that I have to relocate out of town that would suffice I can provide documentation showing my mother in law being sick and why we had to relocate This just doesn't seem humane to not take this into consideration Can a partial refund be given at all? My mother in law has been given less than a year to live and you guys are not willing to work with me on a deposit refund when te apartment has already been rented with another tenant it just doesn't seem fair You have received your money in two ways now Please reconsider refunding part of my deposit since you are not willing to refund the entire amount.

I also understand that if this application is not approved for any reason, or the application is cancelled within 72 after placing the deposit, the $400 will be returned to applicant. The lost rent on the apartment because it has not been leased yet exceeds the $400 deposit amount. Our application is in line with the Virginia Landlord Tenant Act.
