CrossFit Anacapa

Review: Due to a decrease in quality of the gym, as a result of the dismissal of four coaches, all of whom where active coaches when the original membership agreement was signed, as well as the expectation that regional athletes cannot have any workouts outside of the gym with friends, we decided to cancel our monthly recurring membership. Since this occurred on May 6th, and the recurring billing occurs on the 1st of each month, I contacted CrossFit Anacapa to request a pro rata refund for the remainder of May for services unused. At this time, the owners, R[redacted] and [redacted], declined to refund my payment. Upon review of the CrossFit Anacapa Membership Agreement, it clearly states CLIENTS RIGHT TO CANCEL: Client may terminate this agreement with a 14 day notice and if client has pre-paid any sum for services, so much of such sum as is allocatable to services client has not taken shall be refunded. I presented this to the business, stating that, according to their own contract, they need to refund my money for the remaining days of the month since these are services not taken. The business again refused to refund the payment, stating that pre-paid only refers to a 6 month or 1 year contract. Nowhere on the Membership Agreement does it state that this is the case. According to the clients right to cancel, it clearly states that any sum for services be refunded, not only for 6 month and 1 year payments. Please see attached document for additional information in regards to the violation and refund requirements.Desired Settlement: Pro rata refund of $166.94, which equates to the unused services for the 23 remaining days of May after the membership was cancelled.

I am rejecting this response because:

The response from Crossfit Anacapa was not true and not accurate. The coaches did not leave to start a new rival gym. The coaches were forced to leave and started their own gym after that so they could have somewhere to coach at and train. The number of certifications that a coach has is irrelevant in determining a good coach. The coaches that left had years more experience both in coaching and in competition. All that is required to get additional CrossFit certifications is attending a weekend class. A few hours of watching PowerPoint presentations and listening to lectures/demonstrations in no way qualifies someone to be a good coach. It is only through years of practice that this is possible. Unfortunately for Crossfit Anacapa, they are now severely lacking in this regard.
