Review: Refund due for services not received.

I paid $175 for the entire month of June for services. As of June 19th I was no longer allowed to use the services and no refund has been given. Also in June 2013 I paid $65 to compete with a team witch I was removed from without consent and no refund has been given. Desired Settlement: I am seeking $135 refunded. I paid $175 for the month of June that has 30 days in it. By dividing the $175 by the 30 days I get $5.83333 per day. I lost 12 days of services so I 5.8333 X 12 =$70

The competition cost me $65 and I was not refunded after the removal.

Bringing the total to $135 due.

Business' Initial Response

CrossFit West Sacramento offers the ease of month to month billing after an initial 3 month commitment to our program. Each member of our gym signs a billing agreement when joining the gym that states he/she will give at least 14 days' notice prior to the next billing cycle when terminating his/her membership with CrossFit West Sacramento.

We received an email from a now former member on 6/18/2013 stating that she wished to cancel her membership. The email was received exactly 14 days before her next billing cycle - very strong evidence that this member was well aware of the cancellation policy she has signed. Per our policy, we will not issue a refund for the partial month this member has chosen to not use. We will uphold our contractual obligations and honor the 14 day cancellation. The person who filed this complaint has already been advised via email that she will not be billed for any additional services from CrossFit West Sacramento.

Matter 2:

The person in question registered as a part of a team for an upcoming CrossFit competition in Santa Clara, CA called the Legendary Competitor Northern California Affiliate Showcase. This competition involves teams of 4 athletes and will take place on June 28th. This person voluntarily tried out for a spot on the team and ultimately decided to accept the spot she earned on the team by paying to reserve this spot.

Upon receiving this person's cancellation email which stated, "I am no longer going to be a member of CrossFit West Sac.", we were placed in a very tight spot to either find another athlete to fill this athlete's spot or forfeit our team registration at the upcoming competition.

Legendary Competitor's website clearly states that there are no refunds for this competition.

Having to find a replacement athlete with such short notice has not only placed a logistical burden on our coaching staff and athletes, but also a potential financial loss for all other parties involved. We were able to find an athlete to fill the vacant spot, but this athlete has already informed us that she is unable to afford the cost of the event due to the short notice. We feel it is only fair to kindly point out to the person who filed this complaint that she chose to voluntarily sign up for this event and that she also voluntarily pulled herself out of said event with only 10 days' notice to her coaching staff and fellow team mates. For these reasons we will not offer a refund for the Northern California Affiliate Showcase event.

I wish to revoke this complaint against crossfit west sacramento. All issues were resolved and any mark on the company should be erased.

Review: This business required a mandatory training class which I paid in full and completed prior to joining the regular fitness program. Prior to starting the regular fitness program, I paid for the next months classes in the amount of $140.00. I utilized their online scheduling to reserve my first class time. After showing up for the first class I decided that their business had problems that I did not want to involve myself with any longer. I did not sign any contract or cancellation policy. I requested my money back for the classes I did not attend and I was told in an email that they would not refund my money simply because I was upset with their program. I requested they provide me their cancellation policy and show how I understood and agreed to said policy prior to committing payment. I did not hear back from them so I wrote one more time and still have not hear back in nearly a month.

The client in question, Mr. [redacted] participated in a 1 month series of classes in the month of July, 2011. During this series of classes, Mr. [redacted] was given initial instruction over the course of 8 sessions. Included in this initial instruction was our gym policy regarding tardy attendance. Our instruction is centered around group classes; all participants are aware of and benefit from our policies surrounding tardiness. Mr. [redacted] entered a monthly billing agreement during the month of August, 2011. Mr. [redacted] paid $140 in exchange for a 3 visit/week membership. On Mr. [redacted] initial visit to the gym under this monthly billing contract,he was asked to abide by the policy we have in place for arriving tardy. Upon his refusal, we informed Mr. [redacted] that his only option was to come back during the next class time we offered and arrive to class on time. Mr. [redacted] submitted a cancellation email on 8/8/2011 to which we responded that we would not refund his money for the month of August. We immediately cancelled all future automatic billing occurrences in Mr. [redacted] client profile. Mr. [redacted] was not billed for any services after the month of August, 2011.

I am rejecting this response because:

The statement that I received information about a tardy policy is untrue. I did in fact attend a months worth of instructional classes during July. During this months worth of classes, [redacted] was co-owner and also a trainer. [redacted]'s attitude was very poor and we did not get-along. I explained my concerns to ** (Co-owner with [redacted] at the time) that I wash't sure [redacted] and I were a good fit and I wasn't sure about continuing to train at Crossfit West Sacramento. ** assured me that I could train with other trainers and that he would talk with [redacted] and share my concerns. Friday August 5th, 2011, I completed the last instructional class and ** asked if I wanted to pay for the next months classes. I verbally agreed to pay and ** went into the other room and charged my credit card $140. The following Monday, August 8th, 2011, I showed up for class 10 minutes late. There were no other participants in the class. [redacted] was the trainer and was laying on the floor stretching when I walked in. He spoke to me in a condescending manner and told me to walk back into the lobby and read the gym's tardy policy. I came back and explained I had never seen the document which called for 10 burpees (a strenuous movement in significant quantities) for every minute of tardiness. [redacted] told me I was lying and then interrupted my next response and answered his cell phone. I decided at that time that I should not be paying for a service where the staff berates me, treats me poorly, and talks down to me. I emailed later that day and asked for them to cancel my membership and refund my money. The email correspondence with ** is attached as a Microsoft Word file.
