Initial Business Response / [redacted] (1000, 5, 2016/06/27) */ To whom it may concern, We have received a letter in reference to case number #XXXXXXXX describing what we feel are untrue and unfair statementsThe homebuyer had selected this home site on their own, with the developer's sales agent and purchased it outside of Slattery BuildersAs stated in our "New Home Construction Contract" Number Sub-Divide Building Site: In the event unsuitable foundation bearing soil or sub soil conditions are encountered on the site, in connection with foundation and/or installation of septic and laterals, the buyer agrees to pay the builder for any additional cost of the said installation occasioned therebyThis included but does not limited to any tree removal, dirt removal or adding or compacting fill dirtAlso, Number States that Slattery Builders follows the Indiana Assurance Builders Standards BookAs stated in section 2, page in the Indiana Assurance Builders Standards Book under Final Rough Grade, it states that " To level and grade the dirt on the site"Slattery Builders had already hauled in 25+ loads of dirt at our expense from another home site and graded it out on their lot at no additional cost to the buyerWe contacted the developer about the "bad dirt" issue at the time of excavation of the basement, and he said he would cover all costs and soil testing costs and he has done soI had spoken to the homeowner on Monday June 13th at 6:19pm about the conversation that I had with the excavator company that was scheduled and was there earlier that morning to their home site to do a final gradeUpon my conversation with the excavator company later that afternoon, the homeowner wanted him to haul in dirt and follow his grade stakes, which he placed on the property with marks on themThe excavator company said in order to fill the dirt up to his marks that he would need more dirt in the rear of the property and in order to get this in the back of the home, it would need to be bucketed back their as you cannot get a truck between the homesAs I was speaking to the homeowner, I let him know that additional costs will be needed for the excavator company for bucketing the dirt around the home to the rearI clearly stated to the homeowner that getting the dirt trucked in, was not the issue, (with him (homeowner) even stating that he could get free dirt that he was hauling on that side of town, Tuesday June 14th with the company that he works for that the issue is the additional excavation company's time to haul the dirt between the homes to the rear of the property for where they want the additional dirt hauledI told him that we did not have that extra cost figured into the home at the time of purchase prior to constructionSlattery Builders has all intentions of doing a final grade of their lot and to assure that proper drainage around the home is achieved by the excavator company do work for us, but he does work for multiple builders all over the area, and when he is given different directions buy the homeowner and has to pull off, this intern causes a huge scheduling delay on reschedulingOn June 7th I received a text message from the homeowner about the TREX balusters coming out of the slotsI replied that I would be there on the 8th to look at thisWhen I arrived at the home I had spoken to the father of the homeowner and let him know what needed done to repair the issue and that I contacted the deck company and he was to arrive on the 9th to make the repairsI was not informed by either the owner or the contractor that no one has been there until receiving this letterSlattery Builders apologies for this and will have a follow up letter on the repair date and time ASAPWe were contacted only time on this original issue and we personally responded the next dayThere were never numerous timesShortly after the deck on the rear of the home was built, the homeowner had advised that they were going to extend the deck to make it larger by an outside contractorThere was an area about 5' long along the home that the siding installer initially thought was going to be the deck area, and did not put vinyl siding where that ledger deck board goesThe homeowner said not to add vinyl siding on there as they were going to add onWhen our siding installer went back to the home prior to closing we had him install a vinyl fascia board in that area to protect the OSB and the house wrap on the homes structure, and when they were ready to install their deck they would just need to remove this and install there treated ledger boardI received a text message on June 14th that they now want the siding repaired in that area, as they have now decided not to add onto the deckSlattery Builders can contract to add siding to this area, however there will be a cost to sending the guys back, as we completed this as per homeowner's instructions prior to closingThe construction did take longer than originally expected as we hit bad dirt and had to make the repairs per the soil engineer's directions, we had to haul in additional dirt to build up the lot for the garage floors and site (at no additional expense to the homeowner)we had to add and build an additional full bathroom on the second floor (not in the original design of the home plans) after mechanical had already begun and framing was completed, we had to remove framed openings in the nook area and change out at beam so it would open the view into the nook, we had to add additional finished basement space and remove the walls separating these areas just prior to all of the drywall being installedAll of this additional work takes time and unfortunately adds to the timeline of the buildCommunications: Slattery Builders has communicated fully thru the entire process with the homeowner'sWe have meet after hours, and they had all of our cell phone numbers, as well as our emails and online messagingWe have a log of text messages and replies on Saturdays and Sunday numerous times so they could always receive the information needed with a reply Slattery Builders Initial Consumer Rebuttal / [redacted] (3000, 7, 2016/07/07) */ (The consumer Initial Consumer Rebuttal /* (3000, 7, 2016/11/22) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Following the filing of our Revdex.com complaint, most items have now been addressed. Unfortunately the burying of tiling/drainage in yard remains untouched. Further yard repairs are also required following damages resulting from builder equipment in yard.
This has been a very high priority item - I am not sure how grass will grow when the ground is frozen and truly needed completed months ago.
I cannot indicate a satisfactory response until this item has been completed.
We have worked out a game plan for the painting of the side door to the garage, which should take place in two to three weeks.

Yard grading and reseed in rear of home from tile install: Nov 15-21st Harlow Enterprises per recall on 11/14/2016 After a now show by the lawn Installer and multiple phone and email messages to them my last email was November 22, 2016. Asking him to please make the repairs to the yard. Slattery Builders is willing to issue a check in the amount of [redacted] so the homeowner can hire a yard guy of
choice. I contacted the homeowner and he insisted that he still wants it done asap this year. I told him I would continue to reach the lawn installer to get this done.
Painters are to contact us as to when deliver the garage service door to another job to be painted.

Final Consumer Response /* (2000, 11, 2016/12/02) */
(The consumer indicated he/she ACCEPTED the response from the business.)
The proposed solution was not acceptable. The work needed to be completed as opposed to compensation of [redacted] The expectation of work completion seems reasonable considering we are within three weeks of our one year anniversary moving in to the home (Totaling one and a half years since construction began). During such a prolonged timeline, it is incomprehensible that such work would remain incomplete.
Fortunately the builders third party lawn care crew showed up on December 1 and completed the remainder of the work outstanding. This was the final resolution I was seeking.
