CHABECK. INC. JACKWAGON R/C 2102 9th Street, Bldg B Greeley, CO 80631 [redacted] [redacted] *** 10/09/2014 To: RevDex.com 8020 S CR 5, Ste... 100 Fort Collins, CO 80528 CC: [redacted] [redacted] * [redacted] *** RE: [redacted] RC car Unfortunately many of the facts stated in Ms. [redacted] 's letter are not quite accurate to the situation. The [redacted] remote control car was brought in to our store approximately one year ago under the name of [redacted] ***, (Ms. [redacted] 's fiance). To our knowledge, Ms. [redacted] has never been to our store. We offer repair service, and an estimate was prepared for him for parts that were missing, and/or damaged on the r/c car. (see attached estimate.) Mr. [redacted] had purchased some up-graded custom parts from an online vendor and he had tried installing the aftermarket parts himself. He noted he was having trouble installing them. It was made clear to Mr. *** we would attempt the install of the custom, outsourced parts; but we can not guaranty the results. (We believe he brought the rc car in without batteries and this was noted to him at the time, but cannot offer proof of such. Note, it is a large truck and requires two R/C batteries to operate.) We tried to install the custom aftermarket parts sourced by Mr. ***, but discovered they would not work correctly on the R/C truck. We tried to work with the custom parts supplier, but did not get a workable response. Mr. [redacted] was called and informed of the situation. He said he would call the supplier of the parts, and to try to get the correct parts. JackWagon R/C did not hear from Mr [redacted] for a very long time, and the car remained on the repair shelf for a long period of time throughout this entire process. Eventually, Mr. [redacted] was contacted again, and he said the aftermarket parts supplier was not being cooperative in rectifying the situation. It was mutually agreed the r/c car and would be put it back together as best as possible, and he would come in and get the truck. Mr. [redacted] came in and picked up his truck on 09/22/14, and was not charged anything. Again, we believe JackWagon never had his batteries in our possession, but when Mr. [redacted] came in to pick it up, he thought there possibly had been batteries with the truck. It was mutually agreed that we could not prove there were not any batteries; and conversely, Mr. *** could not prove that there were batteries. So a compromise was agreed that we would sell two batteries to Mr. [redacted] at greatly reduced, wholesale price. He agreed to this and paid for the batteries with a Visa card. (Please see attached invoices.) It was only after Mr. [redacted] returned home with the truck that Ms. [redacted] became involved in the situation. A message from Ms. [redacted] was left on our voice message at 1:13am on Sunday September 28 threatening to contact the BBB and engage a lawyer to get the money back for the batteries. Mr. [redacted] was again called to try and resolve the situation on Monday September 29`h. Mr. [redacted] was cooperative and apologetic for his fiance's message. He said she was unhappy with the amount of money he had spent on the remote control car. We agreed to partially refund Mr. [redacted] even further. In effect, one battery was given to him, and the other battery was purchased at wholesale price. Mr. [redacted] was satisfied with receiving 50% of the cost of the batteries as a refund to him. If Ms. [redacted] has further issues we suggest she come in to the store with Mr. ***. Thank you for your help with this matter. [redacted] Vice President [redacted] Secretary/Treasurer Chabeck, Inc.
