This customer purchased a scooter from us on May 1, We appreciate his business and strive to provide a great customer experienceMany satisfied customers come back to purchase a second and third scooter from us, as well as recommend friends and familyThis customer states that his
scooter was stolen on May 11, although he has not provided related documentation from the policeWhen he contacted us after recovering his scooter, we told him we would be happy to help get his scooter runningWe also informed him that it was no longer covered under warranty for numerous reasons, and that he would have to pay for parts and service.Warranty and required service information is stated clearly in the documents the customer signed at the time of saleThis information is also listed in our “Terms and Conditions of Sale” signage posted at the point of purchaseRelevant Terms and Conditions of Sale and Warranty: IMS warrants this product to be free from defects in material and workmanship, under use and with regular service, for days or miles from time of purchase,whichever comes firstIMS will perform approved warranty repairs at no charge for parts and labor.Customer must operate and maintain the product and adhere to required service intervals as outlined in the Owner’s ManualCustomer voluntarily assumes all risks, hazards, and dangers associated with loss, damage, or injury while operating this product orallowing others to operate it, and agrees to hold International Motor Sports, LLC harmless from all claims, actions, damages, or liability related to use of this product.The Following are Not Covered Under this Warranty Damage due to environmental conditions, such as flood, sun, theft, vandalism, or fire Compensation for un-authorized labor performed by any person not employed by IMS The Following Voids this WarrantyDamage resulting from operator error, neglect, abuse, including but not limited to; racing, off-road use, overloading, improper winterization, or using the product in a manner for which it was not designed, accidents (including scooter falling over), improperly securing during transport, use of non-original parts, use of low grade or contaminated fuel, modifications of any kind Not having mile service performed by IMS or authorized dealer Maintenance performed by anyone other than an IMS technician or certified motorcycle/scooter mechanic at a licensed power sports dealership/service center; failure to provide valid service records Required mile service at IMS ($75)The Sales Invoice, which the customer signed, states:“Refer to warranty documentation for warranty details”“Read owner’s manual before operating the product”This customer states that after riding miles, his scooter was stolenThe warranty clearly states that theft voids the warranty.The thief rode it an additional milesThat is a total of milesTherefore, the scooter is no longer covered under warranty for two reasonsIn addition, themile service interval was not performedThe owner’s manual clearly states that the mile service must be performed in order to preserve the warranty.This service interval is very important to the performance and reliability of your scooterHaving this service done is the responsibility of the owner.Failure to do so voids the warranty on the engine and drivetrainNow the warranty has been voided for THREE reasonsWhile the theft of the customer’sscooter is unfortunate, failure to have it serviced according to the owner’s manual is not the seller’s fault.The customer also reports the thief was chased by two police cars while riding the scooterWhen the police cornered the thief, he jumpedoff the scooter, causing it to crashThe warranty clearly states that abuse, racing, and damage due to a crash void the warrantyIt is the customer’sresponsibility to operate and maintain the scooter properlyNow the warranty has been voided for FOUR reasonsClearly, this scooter has not been properlyoperated and maintainedHowever, this is in no way the seller's fault.These are the facts of the matter; the customer’s scooter was allegedly stolen, raced, crashed, has more than miles, and did not receiverequired serviceThe warranty and sales invoice, which the customer signed, clearly state the warranty is valid for a maximum of miles, and thattheft, damage, abuse, and lack of service void itThis customer does not want to accept responsibilityHowever, the scooter is his personal property.Therefore, what happens to it is his responsibility, including environmental damage or "acts of god".In conclusion, we always try to work with our customers, and we value this customer's businessI have personally called and e-mailed this customer to discuss solutionsWe soldhim a part that he needed on June We told him we are willing to provide repair serviceNevertheless, it is unreasonable to expect us to provide freeparts or reimburse him for repairs performed by another company for a scooter that has been stolen and crashedFurthermore, our terms of sale and warrantypolicy clearly state that we are under no obligation to do soWe decline to comply with the asked-for settlement amount
