I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

The contractor had full knowledge that the [redacted] Pool fell under commercial requirements. That said, the contractor had full knowledge of the fact that they did not have the appropriate license that allowed said contractor to pull the County Permit as required. The contractor, [redacted], advised management that Crystal Clean had the licensing et al appropriate for plastering the pool. Crystal Clean Pools has caused the [redacted] Community Association expenses above and beyond what they were paid for the project. Due to Crystal Clean Pools lack of foresight or lack of contacting the appropriate County Department [redacted] has spent time and money to rectify this situation caused by the contractor.

We began servicing the pool at [redacted] in December of 2012. In February of 2013 the HOA then hired us to replace some of the pool equipment and also replaster the pool. We have resurfaced many residential pools in the past but were not aware of the county requirements for...

resurfacing a commercial pool. We contacted the city of Peoria and they told us that no permit was required. Because of misinformation we neglected to contact the county. We are a small family owned business and unfortunately, we make honest mistakes. We do not feel that we owe the HOA for [redacted] the amount of $1500.00 that they are requesting. Our business is license, bonded and insured as well as having our CPO certification but we have yet been able to receive a contractors license. When we were informed of the inspection and the violation given, we made every bit of effort possible to find a company with an [redacted] to vouch for our work but were unable to do so because it is not something companies typically do. When we looked into the permit we were given price information which is no where near the amount of $1500.00. No matter who applied for the permit, the HOA would have had to pay a fee. We do not feel that we should be held accountable for the decision of who they hired and the unreasonable fee that they charged to get the permit. It appears that our original response to the customers complaint did not result in any sort of resolution. The customer, [redacted], is requesting compensation in the amount of $1500.00 for time and money spent to rectify the situation. [redacted] is considering the customers request for compensation if, [redacted] would provide us with a copy of the invoice from the hired contractor showing the $1500.00 in expenses. Please let me know if this is something we can move forward with. Thank you, [redacted]Crystal Clean Pool Care LLC

Review: [redacted] assured HOA manager that Crystal Clean Pool Care, LLC was able to re-plaster a semi public pool in the [redacted]. Upon completion of the project the HOA was issued a citation by [redacted] due to the fact that permits were not obtained by Crystal Clean Pool Care LLC. Correspondence to [redacted] and [redacted] of Crystal Clean resulted in knowledge after the fact that the company does not have the proper contractors license to allow them to obtain the required county permits.Desired Settlement: The board of directors would like to request recompense from Crystal Clean Pool Care LLC for the costs of $1,500.00 to hire the qualified contractor to complete fufill the county permit requirements.
