Revdex.com:I have reviewed the response made by the business in reference to complaint ID 9907019, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Dear Sir or Ms.:I have read Mr. [redacted]'s response.  While his payment of the APS rebate is a good faith effort on his part, it, in no way, addresses the body of our complaint.  First and foremost of our concerns is that we were not given three days (72) hours to consider the contract (opt out clause) as stated by law.  The system was installed fifteen hours following our signing the agreement just prior to a weekend.  Second, National Solar established the credit agreement with an out of state firm, without our agreement or consideration.  We had no say in accepting the terms contained in the financing agreement and were not contacted prior to it's inception and enactment.  I took steps, apparently to no avail, to notify the finance company we were not party to the agreement and wanted no further contact with their company (GreenSky out of Georgia, USA).  They continue to send me correspondence with no regard to our petition to cease and desist on correspondence.  Third, Mr. [redacted]'s assertion that they did not use the Church to sell their contract is not correct.  He may not be aware of it, but his sales representative stated several times that many of their installers were member of our Church.  This had a direct impact on our decision relative to the system and turned out to be false. AAs for being unable to contact us, we are at the same address.  Correspondence takes only 48 hours.  Other than his personal check for the APS rebate, which was sent without any accompanying correspondence, we have not heard from Mr. [redacted] or National Solar. I want the contract revoked or cancelled and will negotiate an honest settlement with Mr. [redacted] directly without the interference of out of state third party's.  I will contact National Solar and provide them with our new phone number. Sincerely, DBA.accompanying correspondence, we have not heard from Mr. [redacted] or National Solar.  My phone number has been changed from our previous residence phone number of [redacted] to [redacted].  We no longer have a land-line.My recent effort at answering your request as to if I was satisfied with Mr. [redacted]'s response and explanation was somewhat truncated by your on-line program and I had to abbreviate some of what I wanted to say. Please add the following to my submission: I am not satisfied with Mr. [redacted]'s response.  I am willing to sit down with Mr. [redacted], at his convenience, to discuss a settlement of this issue.  He has not offered that as an option. I attempted to contact Mr. [redacted] at his number at National Solar this afternoon at 1:00 p.m. I was transferred to an answering machine.  I left a message identifying myself and providing my new telephone  and contact number. It is our understanding (me and my wife) that it is against the law to not give a customer three days to cancel an agreement prior to installation or actual transacting the terms of an agreement or contract. The system sold to us was installed in less than 46 hours following our signing of the agreement.  This was just prior to the weekend and approximately 79 hours prior to a page and a half expose of the solar water heating business in Arizona hitting the streets in the Arizona Republic newspaper. My wife and I clearly did not have seventy-two business hours to consider our decision. Mr. [redacted], Mr. [redacted]'s sales representative that came to our home, clearly stated that many, if not most, members of "their" installation crew were members of the LDS Church (of which me and my wife are members).  He most probably looked at the large library of books I own which he closely passed getting to our dining room table where he went forward with his sale and decided to use his statements to put us at ease with his proposal.  He (Mr. [redacted]) also stated that they would like to start the installation at 7:00 a.m. the following morning since, "their crews were currently doing work in our area out of Queen Creek, where they are based and this would save considerable travel time and costs." Both his claims of the crew members status and their location were false.  Neither crew that showed up the following morning (a plumbing firm and a firm that tested and sealed our heating and air conditioning ducts) were from Queen Creek, nor did they just happen to be "in our area installing systems"; they were sub-contractors from our local area and do not work directly for Mr. [redacted]. It is reasonable to assume that the owner of a solar system installation company would be intimately familiar with the status of solar roof system rebates relative to local electric providers when this impacts on his sales ability relative to those systems.  It is beyond comprehension to think Mr. [redacted] and his associates were not fully aware that APS had stopped providing rebates in September 2013 and had no intention of requesting any further rebates in 2014. Therefore, it is my belief that we were purposely misled on that point. Neither my wife, nor I, were contacted in any way relative to the $14,999. obligation entered into with GreenSky of Atlanta, Georgia. One day I have never heard of them and the next day correspondence arrived saying we were under contract with them for $14,999.  We did not agree to any conditions or contractual commitments entered into by National Solar relative to our contract with National Solar.  I sent correspondence to GreenSky asking them to cease and desist in contacting me and informed them I had nothing to do with the contract they (National Solar) have made me party to and did not want any further correspondence or contact with them.  I sent the letter by Certified Mail, Return Receipt Requested, to be sure they got it ok. I also copied the Attorney General and your Bureau.   In several telephone discussions I informed more than one of National Solar's representatives shortly thereafter that I will not recognize any agreement they entered into with GreenSky:  I will only negotiate and deal directly with Mr. [redacted].  I do not believe that it was some kind of a mistake on the part of Mr. [redacted]'s associates that led them to send me a packet of documents to fill out which represented an electric company that I do not do any business with (SRP). Mr. [redacted] was aware we are with APS and I don't believe there was any confusion.  There are only two electric company's serving Phoenix.  That big an oversight on the part of Mr. [redacted]'s associates is hard to imagine under any circumstances. Had I filled out the paperwork that was sent to me, signed it and returned it to them, I would have been committing fraud and could have been held liable for attempting to swindle SRP out of a substantial amount of money. I would not do that and resent their attempt to insinuate otherwise by stating it was just "an oversight" of some kind. In conclusion, I believe we were falsely and dishonestly coerced into the agreement with National Solar. I strongly believe National Solar is wrong legally and I know they are wrong morally and ethically. I want the arrangement between GreenSky and National Solar revoked and/or cancelled by National Solar.  Any further business or settlement should be between them and not me and my wife. I want the agreement/contract between me and my wife and National Solar revoked, cancelled or declared null and void by National Solar.  I will negotiate an honest settlement for all valid associated costs with Mr. [redacted]. Thank you for your consideration and assistance in this matter. TO WHOM IT MAY CONCERN , I HAVE RESOLVED THIS ISSUE WITH [redacted]. HIS MAIN CONCERN WAS HE CALLED APS TO LEARN THAT THE REBATES HAD RUN OUT FOR HIS SOLAR WATER HEATER. THE REBATES WITH APS RUN UNTIL THE FUNDS RUN OUT AND THEN THEY TYPICALLY COME BACK WHEN THEY GET MORE FUNDS...

IN FROM THE FEDERAL GOVERNMENT. IF THE REBATES ARE OUT OUR COMPANY PAYS THE MONEY UPFRONT AND WAITS FOR THE REBATES TO COME BACK, IF AT ALL WITH NO CONSEQUENCE TO THE HOMEOWNER. [redacted] HAS RECEIVED HIS REBATE CHECK THAT WAS SENT OUT TO HIM JAN 21sT 2014 AND ALL IS WELL. EVERYTHING WAS EXPLAINED CLEARLY TO MR AND MRS [redacted] AND WE FULFILLED OUR CONTRACT AND DID EXACTLY WHAT WE SAID WE WOULD DO. MR [redacted] EXPLAIN ED TO ME THAT ALL THE SUBCONTRACTORS THAT WORK WITH US DID AN EXCELLENT JOB AND HEWAS VERY HAPPY WITH THEIR INSTALLATIONS. VALLEYWID E SOLAR ONEOF OUR SUBCONTRACTORS THAT INSTALLED HIS SOLAR WATERHEATER HANDLESALLTHEPAPERWORKFORTHEREBATESANDIGU        ESSTHEY SENT HIM SRP PAPERWORK INSTEAD OF APS; THEIR MISTAKE.IN NO WAY WAS THEIR ANY MISREPRESENT AION ON OUR PART. BEFORE WE INSTALLED OUR SOLAR PACKAGE ON THEIR HOME MR [redacted] ASKED ME IF I WAS A MEMBER OF THE LOS CHURCH AND I SAID I WAS. THAT WAS NEVER USED ON MY PART TO TRY AND CLOSE HIM ON ANY DEAL. HE ASKED THE QUESTION AND I RESPONDED HONESTLY . I HAVE TRIED TO CALL MR [redacted] AND BOTH THE NUMBERS I HAVE FOR HIM ARE CURRENTLY NOT WORKING . SINCERELY,[redacted]  [redacted]
