C&S Diversified was hired to replace the roof on a house I am renovating at ***. Contract was signed on July 13th, 2020 and subsequent text messaging, which I have, they promised to do roof on Monday July 20. Work was not started until Tuesday July 21. At 10:30am I stopped by the site and the front roof had been torn off down to bare wood. 1/4 of the rear roof had been torn off as well. Shortly after, the roofers walked off the job site. I was informed at 3:02pm my drywall contractor told me the roofers left shortly after I left and had not returned. I arrived back at 3:30pm and had called the owners of C&S. They told me they had another roofer coming and would have the roof at least in the dry. After waiting 2 hours, the owners finally attempted to install tar paper over the bare wood but as it turns out, they did not know how to do it and the next day, Wednesday the 22nd, the tar paper half blew off and it was raining causing water to get into the inside of the house damaging the drywall in several places. That morning I had to work out of town and did not get back until around 2:30 at which time I stopped by the site to find the tar paper torn off and water standing on the floors inside. I called C&S and demanded they have someone come immediately to secure the roof to lesson the damages. They showed up at 6pm to install a tarp on the roof--after it had stopped raining. The roof was finally completed on Thursday. Unfortunately I was out of town and did not return until Sunday. I stopped by the house and by then, the drywall had dried and to my eye, it appeared there was no damage to the drywall, to which I reported that to C&S. I told them it looked like we averted disaster. However, my drywaller inspected the drywall and there are $700 worth of repairs. They also damaged my new gutters, left debris and nails and tar on the siding, causing another $356 in damage. They are denying any of it and harrassing me.

Desired Outcome

Refund I would like C&S to refund to me the amount of the damages they caused when their crew walked off the job leaving my roof open to the elements, and then not properly securing the roof against water intrusion until the job could be completed. They stated the first crew they had walked off the job on purpose to screw them because they were giving work to someone else and not them.

The Revdex.com was advised by the business that the drywall was damaged before the old roof was torn off. When the roof was torn off is when the consumer chose to start the dry wall job. The business states that the consumer would have needed to wait to replace the drywall until there was a roof on the home and will not be issuing a refund.

The drywall was not damaged prior to C&S tearing my roof off and leaving it open to the rain storm. I have photos of the drywall prior. I also have a string of text messages from the guy admitting his subs walked off the job leaving the roof open causing the damages as well as begging me to accept a few hundred dollars as payment for the damages. The last offer he made was for $500 because he was a new business and couldn't afford to pay the whole thing. Yes, I did discover there was a roof issue while we were installing the drywall--there was a leak above two of the front windows--that's why I hired them to redo the roof. The drywall was not totally installed at that point. Yes, we did continue to install the drywall when they agreed to do the roof and scheduled the job. There would have been no issues if they would not have torn the roof off and left it open then came back and improperly installed tar paper which subsequently ripped off allowing water inside the house. The facts are simple. I had a minor roof leak at the front of my house. I hired them to replace the roof. They tore my roof off and walked off the job leaving it open to the elements. It rained. There was damage to my drywall to the amount of $700. They promised to protect my brand new gutters during the roof replacement. They did not protect them and dented my brand new gutters which now have to be replaced. I am prepared to file law suit as of 5 pm today, 8/24/2020 at 5PM. I mailed them a demand letter via certified mail. I then extended the demand for payment until 5pm this evening. Their negligence caused damages to the inside of my house. I will not accept anything less than payment for the damaged drywall and gutters. I have photos and video of the damages. Their insurance company informed me they were not insured to do roof replacements--something they failed to tell me also when I hired them. They did tell me they were insured. These guys are not on the level, have begged me to accept less to cover the damages they caused, have harassed me via text and telephone messages, tried to tell me my contract absolved them of any damages once I paid them in full. (Quote--I had that clause put into my contracts just for people like you) and are not licensed or insured to do this kind of work. I will take them to court.

Thanks for all the help on this. I'm attaching a few screen shots of texts between the principals of C&S and myself. Clearly they admit they were at fault. I did receive payment of $950 to cover the damages they caused. I do think they need to be watched as they do not have the proper insurance and are not licensed. Say hello to Mr Epstein for me. Hopefully he will remember me! Sincerely
