First I think I paid more than he quoted my sister for the carpet. Second the wrong color carpet was delivered.My sister and I went looking for carpet on the 07-06-15 from the business,she was picking it out and I was paying for it, and I told her to get good carpet so it will last. [redacted] the owner measured the area and quoted her a price for the carpet sample that we seen, and I asked him how do we pay and he said after the job. I went back to his office to fill out the paper work that afternoon close to closing and he quoted me a price about $1400.00 to do the job, and at the time I agreed to it. I showed it to my sister and she thought it was too high and wanted to look around, so she called him the next morning as soon as he opened and said she wanted to cancel that order and he said that it had already been order and didn't want to cancel talking about a restock charge. My sister said we had 3 business days to cancel the transaction. He then asked she how much did she wanted to pay and she said no more than $800.00, and she picked from the sample he gave her and said it will be $780.00 to do the job. I went back on 07-07-15 to take him the samples and do the paper work and he told me it was $880.00 and he would $440.00 down payment, I tried to call my sister to verify that he quoted her $780.00 and not $880.00, but couldn't get in contact with her so I paid the $440.00 down payment that he didn't quote her. We told him we wanted the carpet to be delivered on 07-20-15, because that was when we was having the new furniture delivered. His crew came on the 07-20-15 and pulled up the old carpet and when they got ready to put down the new carpet we told them that wasn't the color we picked out and when back to the office to tell [redacted] he said that what I signed my name to and wouldn't take it back. When I talked about the color I referred to it as Butter Pecan the name on the sample and he didn't put the name on the paper work, just a code and it was the wrong code. I think he is a crook.Desired SettlementWe had to tell them to put down the wrong carpet, because the old was already up and we was having new furniture delivered that day and plus my mother is 91 years old and we thought it would be a hazard for her.Business Response Thank you for your letter of Wednesday, July 22, 2015 regarding Case # [redacted] We understand this is a difficult situation.The customer's sister came to our showroom 0n 7/6/2015 and selected four (4) carpet sample borads that she liked and asked us to come to her mother's house and give the estimate. When I got to the house the same day with the sample boards, the customer was there with two (2) sisters and their mother. I measured the area they wanted carpeted and they chose the best and costliest of the four (4) carpet samples for installation.I gave them the estimate and they accepted and signed the contract. They asked me about payment and I told them to pay us at the completion of the job.They said they needed the carpet installed on 7/10/2015 and asked me to order the carpet the same day to beat the three (3) days it takes the carpet to get to us which I did. The next day the customer's sister called me and asked me to cancel the order for they could not afford to pay the amount contracted. I told her that the carpet had been ordered and cut by the carpet mill and I will have to pay a restocking fee to the mill which I eventually did and paid for since we did not collect any deposit from them. The carpet mill does not give lenience for cancelled orders that have been processed. How they got the three day cancellation period reference, I don't know. Even, the contract she has states "ALL SPECIAL ORDERMERCHANDISE IS NONCANCELABLE".The same sister came to the showroom again on 7/7/2015 and said she needed another carpet, less in price than the previous carpet order. I told her this time I will ask for a down payment before I order another carpet for them and she said fine. I asked her budget and she said around $800.00. I brought out two (2) carpet sample boards and told her that one (1) was $880.00 and the other one (1) was $780.00 and that she should take the two (2) sample boards to her family and make a selection and get back to me.On the evening of the same day 7/7/2015, the customer came back himself with the two (2) sample boards and told me that they had selected the sample that cost $880.00. I asked him for the deposit of $440.00. He told me to wait, he left and came back with $440.00 for the deposit. He brought the selected carpet sample board inside my office, sitting in front of me with the sample board in his hand while I was preparing the new contract for him. I asked him to tell me the style and color numbers he had chosen, just as we ask all customers. He told me the style and color numbers and pointed at them. I recorded the selection and printed the contract, gave it to him and asked him to go through it and make sure that was what he selected before signing. He told me everything was fine, gave me the deposit, and signed the contract. I gave him a copy of the contract and he left the office.The next morning 7/8/2015, he called and said his sister told him that the price should have been $780.00 not $880.00. I told him that was not what I told her. However, I had not ordered the carpet again since this time it would be installed on 7/20/2015. I told him, if he does not want the carpet I can give the deposit back because I had not ordered the carpet yet. He told me to go ahead and order it this time, he will not change his mind. I waited another two (2) days, did not hear from the customer again, and I ordered the carpet.On 7/20/2015 our installers went to the customer's house with the carpet. The customer said it was not the color they wanted. That I should reduce the price to them since it was not the color they wanted. I asked our installers to come back with the carpet but the customer insisted on getting the carpet installed. After the carpet installation, the customer and his sister came to our office asking that I reduce the price of the carpet for them. I told them we do not do business that way, renegotiating on a contract after we have done our part. I did not make the style nor color choices for them and was not among them when they made their choices. They told me that they will hire an attorney, sue us and will destroy the name of our business if we refuse to give them some of the money back. I refused to entertain their threats. In my more than twenty (20) years in business I have treated my customers with respect and honesty and will continue to do so. I will not succumb to a threat like this.Consumer Response We did not tell him we needed it on 07/10/15, we said the 20th of July, the same day we was ordering the furniture, so he had time to cancel the first order, it wasn't even a day from that evening around 5:00 pm to the first start of the business day the next day. I didn't leave and come back with the deposit, I had it on hand that day and when I was in his office ordering the carpet, he didn't ask me for a code, but I pointed out the color which was Butter Pecan and I said Butter Pecan, I don't even know the name of the carpet that he installed. When we told him that he ordered the wrong carpet, he wouldn't listen and said my signature was the proof that we ordered what he putted down and that was it.That's when I said I needed to talk to someone about my rights.Final Business Response When you order merchandise and it has been processed, you cannot cancel the order. It is also written in all capital letters, ALL SPECIAL ORDERS MERCHANDISE IS NONCANCELABLE", in their copy of the contract. No. The customer left the office to go to the bank to get the money for the deposit. When he returned I was not in the office and the door was locked. He was waiting with another customer and told the other customer that I was coming back and he was waiting for me too. The other customer could not wait and left before I returned. When I returned he told me about the customer that could not wait. Later that afternoon the other customer that could not wait called and told me he said I was coming back and he was waiting for me also. I prepared the contract for the carpet with the selection made from the carpet sample board he held in his hand. I gave him a copy of the contract and asked him to verify the selection. He verified it and told me it is correct. He gave me the deposit in cash and signed the contract. I gave him a copy of the contract and he left the office.
