To Whom This May Concern,We have received your letter on 6/25/regarding the concern of Customer [redacted] and his response to our original statement.The customer's response is redundantIn our original response, we stated:"The shopping cart total and payment total authorized by the customer does not reflect the claim the customer has made stating the order was placed with a discount."AS also stated in our original response:"The order total was Sas displayed on checkout and as the customer verified and authorized the payment of $348.95.”We also provided a copy of the [redacted] payment as well as the complete order from our websiteTo this moment the customer's claim that he authorized a lower dollar amount for his order has been unfounded.CULTRAG Performance has provided complete proof in writing and documentation while the customer has not provided any evidence at all regarding this matter.Regarding the customer's concern of "Why does the vendor have a disclaimer for the discount codes in their policy?"When we setup the website, before any business is done, we are required to post our terms andconditions & policies by the credit card companies so that customers can read the terms and conditions & policies and agree to do business with us or they can choose not to.Since our last statement, [redacted] has closed the case and ruled in the favor of CULTRAG PerformanceA Copy of the closed case is providedWe are notable to refund the customer or provide any concessions in this matter.Sincerely,Gene C

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed as Answered] Complaint: [redacted] I am rejecting this response because the vendor continues to not represent what is clearly written in their online policies The most clear example is that the vendor accepts returns and did not allow me to return the merchandise when they wouldn't honor the discount that I submitted This forced me to dispute the transaction with [redacted] .Unfortunately, [redacted] never asked me for any information regarding the investigation and initially ruled in the vendor's favor My assumption from the vendor's response is that [redacted] has released the funds to the vendor and they were informed the case was closed However, the case is still under [redacted] investigation for online merchandise policy violation I will continue to fight this case, even to small claims court, in order to prevent others from getting taken by shady vendors Regards, [redacted]

there were no discount codes applied.Attached is a copy of the payment receipt through *** that confirms the total of $was paid for and authorized by the customer.The shopping cart total and payment total authorized by the customer does not reflect the claim the Customer has made stating the order was placed with a discount.On May at 10:AM the customer was sent a message stating the items were in stock and if all was well we would ship the order the same day and provide the customer with the tracking information at that time.The order was shipped May at 11:AM via USPS tracking number ***A copy of the tracking information is included.On May at 4:PM the customer emailed basically stating a code was input at the time of the order and the order total was $A copy of the email is includedWe cannot verify any codes were applied to the order, or attempted for that matter, as shown in the documentationThe order total was $as displayed on checkout and as the customer verified and authorized the payment of $348.95.In the same email the customer does state the follow up emails from his order does not show any codes were appliedImmediately after order placement a customer is sent all details of the order, including exact items ordered and total dollar amountThe customer did not contact us at that time with any concerns.On May 8th we responded to the customer by stating there was no code input on the order and there were no notes on the order indicating any discounts were applied or asked forIn accordance with our terms and conditions posted on the website we were notable to make any changes to his orderWe then posted the exact policy posted on the website on the terms & conditions page.The following paragraph is stated on our terms & conditions page located at http://www.cultragfactory parts.com/terms-and-Conditions."Promotional CodesIn the event Company is running a promotion and you are provided with a valid promotional code the promotional code must be used at the time of orderingIf you are notable to get the valid promotional code to work please contact Company by phone, Website or email and Company will assist youIf an order is placed without a promotional code Company will not be able to add a promotional Code, discount your order or provide you with any concessions.”As you can see by our posted policy we do not offer any concessions after an order is placedBy using the site the customer agrees to the terms & conditions.We did offer in the email to work with the customer on a future order as an attempt to resolve the matter.On May at 1:PM the customer called asking to return the orderWe stated we would accept the return for a 20% restocking feeThe customer claims in his message this was an attempt by CULTRAG Performance to keep him from returning the order.The 20% restocking fee is addressed at the following link on our website http://www.cultragfactory parts.com/return-policy"Restocking FeeCompany reserves the right to charge up to a 20% restocking fee for parts or orders deemed returnableCompany reserves the right to charge up to 20% restocking fee at Company discretion."We did not attempt to do anything other than reinforce our posted policy with the customerBy using the site the customer agrees to the terms & conditions.On the same day as my email response on May the customer filed a dispute with *** noting the transaction as an "unauthorized charge."Filing a *** dispute as an "unauthorized charge" is noting with *** that you've been charged for Something that you are not aware of and it wasn't authorized by you as an individualWe provided *** with the proper documentation and *** immediately ruled in our favor and closed the case.During the day on May we had another email chain with the customer which is includedIn that Correspondence, we mentioned to the customer since he had opened a *** dispute for an "unauthorized charge" that couldn't be further from the truth, and that we would be unable to Communicate directly with him and that everything had to be documented through ***.On May 9th the Customer stated the case was closed and he wanted a return authorizationWe stated we would no longer assist the customer with any returns he filed a wrongful *** disputeAgain with *** filing a dispute as an "unauthorized transaction' it is an attempt at getting a complete refund with no questions asked since you, as a cardholder, are communicating to *** that you did not authorize the transaction as an individual, which is untruthful and unethical.On May 12, the customer opened another *** dispute now stating the charge is an "incorrect amount.” This is communicating to *** that not only did he order the item and receive it; it is just not the correct priceThe case has not been closed yet with ***.Since the *** dispute is not closed and we followed all the policies posted on our website and the Customer wrongfully filed an "unauthorized charge" dispute with ***, to completely get all his money back and keep the products, we are not offering the customer any concessions.CULTRAG Performance stands behinds all the posted policies on our website and expects customers to adhere to our posted policies on our website.Sincerely,Gene C
