On 01/18/2016, *** ** *** ordered his family dinner at our drive through. Along with dinner they also ordered desserts, the total cost was $40.44. At the time the order was made we were informed that one of the family members had a peanut allergy, we properly flagged the
ticket to the order as is protocol. An alert is printed at the top of the order receipt to reflect the allergy along with the allergy alert The allergy alert also appears on our food service screen ensuring that all team members are aware of the allergy. Through our protocols we make every attempt to inform our patrons of allergens and limit the contact of any allergen when informed by our patrons of a susceptible person. These protocols were set up by Culvers corporate and all of our team members are trained to follow all protocol standards of service including the serving of a possible allergen. The order made by the family member included a Peanut Butter Shake. We passed the order on to the family and they left. We have no knowledge of what happened after the order was passed as the family left the premises. The guest called the restaurant shortly after their visit to inform us of the incident. The manager on duty immediately called me, the owner, Amanda ***, I then called the guest and apologized for their discomfort. I also informed the guest that I would contact our insurance company to report the incident. On the morning of 01/19/I called our insurance representative and reported the incident. The insurance company is West Bend Mutual and the claim # *** the claim representative is Karrie ***, phone # ###-###-####. I advised the family that this is now an insurance issue and for them to make any follow up inquiries with the insurance company.I have spoken to the insurance adjuster as well as my agent regarding this incident a number of times. I have been informed that an offer has been made and was verbally accepted by Mr***. The insurance company is waiting for the signed and notarized release from the family in order to release the funds. I have attached correspondence from the insurance company confirming the offer of settlement.I honestly believe I have taken all the prudent steps to resolve this issue. I have great confidence in my team members that all protocols we followed. We also have sticker warning labels at all our serving stations along with the drive through to alert guests of allergens being on our premises as an ingredient There is no way I could make an honest determination of how and when this young man ingested the peanut allergenI would be happy to provide you with any follow up information you may require. Thanks you for your attention and thank you for allowing our side of the incident to be told
