Review: On 02/27/2013, I took my 1995 Kenworth Tractor to have a routine PM Service at Cumberland Truck Equipment Co. The service entails draining and replacing all fluids, replacing filters, checks fluid levels and topped off where necessary, inspect and list defects. At the end of the service, I paid for the service and a receipt was provided detailing the procedure. On 03/06/2013, I was not able to operate the vehicle. I took it to a certified mechanic who informed me that no oil was found in my transmission and was the direct reason the vehicle was non-functional. I returned to Cumberland Truck Service because it had been one week since the service and I was assured that all fluids were topped off. I spoke with [redacted] (service manager). After explaining the circumstance to him, he told me that Cumberland would pay for the work in order to fix the damage and give me a 2 year warranty. He would contact the corporate office before proceeding.On 03/12/2013, I received a telephone call from [redacted] (corporate officer) informing me that Cumberland Truck Equipment Co., is refusing to take responsibility for the damage they have caused to my vehicle on the ground that my vehicle was too old.The vehicle sustained considerable damage as a direct result of Cumberlands negligence, now the vehicle is inoperable. Before going to Cumberland Truck Equipment Co., my vehicle was fully operational. Since the incident, I have been out of work. This vehicle is my only means to earn a living.Desired Settlement: Cumberland Truck Equipment Co., had a duty to render service which they negligently fail to complete. I am requesting that Cumberland Truck Equipment Co., pay for all repairs (parts and labor) as compensation for the damage that my vehicle sustained.

Dear [redacted]:

I am a loyal customer at Cumberland Truck. Their record could attest that I routinely service my commercial truck at their facility every 12,000 miles. On this particular service, the truck only drove a total of 1,700 and was inoperable.

The service involved topping all fluid, inspect, etc. (see previous attachment) Cumberland states that their technician inspected and saw that the transmission fluid met specification, which means it was topped off and did not need additional fluid. That is a false statement because [redacted] is willing to attest that there was no fluid in the transmission and had there been fluid 5 days ago, there would have been evidence of that fact. In order to do the diagnostic test, 5 gallons of fluid were placed in the transmission (see attached), as previously stated “there were no fluid found”. When [redacted] examined the truck, he was able to confirm the leak because 5 gallons of fluid were placed in the transmission.

If there was no need for fluid as Cumberland claims, how is it that 5 days later there was no fluid found; yet the 5 gallons of fluid that was placed in the transmission from [redacted] are still evident in the transmission to this day, even though there has been detection of a leak?

The only explanation is that Cumberland truck did not put any fluid in the transmission. Cumberland Truck states that they did not do any work in the transmission that is true because it is evident that they did not topped off the transmission fluid and inspect as is the condition stated in the service agreement. This is a breach of contract.

The assistance Cumberland offered was to pay for the labor to fix the damage and a 2 year warranty. They rescinded that offer on the notion that my truck was too old.

Cumberland Truck was negligent. They did not uphold the service agreement. They are legally responsible for the damages to my truck.
