Review: I signed a lease to rent an apartment on [redacted] from Ken and Linda Cumins. When it was time to move in I noticed safety and health violations within the premises. Water would stand still in the shower for 30-45 mins before a tiny bit went down, tile in the kitchen was cracked in two and pulled away from the other tile and onto the hard wood floor next to it, back door that leads to and from outside to my apartment the hinge at the bottom of the door was loose and easily shaken. Door [redacted] was never fixed which was a requirement before move in date, instead landlord took care of dust behind the refrigerator. Asked them to fix all that was wrong with the apartment and they never sent anyone out to fix anything. In fact I was told to just take a shower in it anyways. My father asked to break even and just get my first months rent and security deposit back and terminate the lease and Linda said fine . Ken showed up with only the first months rent check. I asked where my security deposit was and I was told by Ken they spent a lot of time and money on me and that he didn't have the money. I then asked where the deposit money was again and I was told almost all of that money went to cleaning. Ken said let’s see how it goes tomorrow and he kicked me and my dad out. That was on 10/8/15, today is 10/12/15.Desired Settlement: Just want my Security Deposit back!

We bought this property, 2525 Longview Avenue, SW from the Trinkle Family (C.W. Francis Realty) in 1967 and their relative lived in this Apartment #2 for many years until she needed assisted living.To say we are shocked by this letter is an understatement. Since owning the building we have spent thousands of dollars upgrading the building. This is a lovely apartment in a four unit brick in excellent condition-central air, 54 new windows, new decking, paved parking etc. and many features not available in this charming older residential neighborhood.Present residents of our building include a medical doctor, a graduate student who works in the cultural aspect of the city, five year finance vice president of a major Roanoke company who travels frequently.As you can see this is not a slum-lord property with transient tenants.Not only are the accusations untrue, they may be considered slanderous. We will be glad for any representative of your office to tour the residence. Please contact us at [redacted] if you need any additional information.Upon signing the lease we definitely considered that the apartment was rented and have turned down other great prospects.in answering the above allegations mentioned concerning Apartment #2 at [redacted], as per client [redacted] and mother viewed the apartment and liked apartment.[redacted] came back with boyfriend to view apartment and they approved it.[redacted] came back again to lease apartment on October 7th and paid $509.66 prorated from 8th thru 30th.[redacted] came back for Walk-thru of Apartment & checked every receptacle in Apartment. [redacted] appeared to be pleased the what she found and was ready to move in the next morning on Oct. 8th.At that time she gave the Security Deposit $695. and she was told about the Electric & Gas Deposits and made arrangements with utilities companies. Signed on October 7th, 2015.At this point, we definitely confirmed that the apartment was rented after all the above.NEXT morning on October 8th, 2015[redacted] and father came to move in and we were astounded at their complaints.The entire apartment was thoroughly cleaned and painted prior to their arrival. It is a beautiful apartment.The lower hinge on back door was loose and needed tightening which took two minutes to do.The floor tile ceramic band was cracked from white kitchen tile floor to dining room hardwood floor, but still fastened tightly to the floor. this has been removed and a 46" long hardwood transition board was purchased from [redacted] and installed by [redacted] Hardwood Floors. This was totally unnecessary, but was done.There was absolutely nothing wrong with tub drain as I had checked it. I did install a new showerhead on the tub. [redacted] insisted on having plumbers to come with-in 2 hrs. and we said you can not get a plumber within that period of time except in extreme emergency.The Security Deposit was placed in a bank account. I don't know why she thought it that it was used for cleaning.The closet door handle has since been replaced, but could have been tightened.I try always to be professional when dealing with people. I did not "kick [redacted] and Father out" as she stated. I did tell them to leave if they were not renting the apartment and planned to default a signed lease.As I stated previously, that this is a well appointed Apartment and we were proud to present it to the them.All of their objections were addressed with the exception of obtaining a plumber in 2 hours.Perhaps there are other reasons that this tenant needed to default on the Signed Lease Agreement, however the apartment was cleaned, painted and ready for occupancy.

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

I am extremely offended on what has been said by this business in response to my Complaint. You both know your not telling the truth. I'm not even going to keep going back and forth on this. You both have caused me and my family great stress this is why Legal Action has been sought and the court date has been set. Ken and Linda both should have received that information by now. This has not been resolved, I have not received any attempt to get my security deposit back.
