I purchased an A frame camper from curren RV. I asked if a roof rack could be installed and was told it can. Had to pay for the brackets to be made and the roof rack itself. I have had to return 5 times for repairs and on this last repair was told the roof racks would have to be removed with no compensation for the purchased roof racks. I have spent close to $800 on the roof racks. Not to mention countless hours and miles driving back and forth to their service center.

Mr. has already received a refund for the racks and we consider this matter resolved.

Pursuant to conversations with Jay F @ dealer my deposit was refundable on a trailer-I requested cancellation of the order and was then told it was non refundable. there was NEVER a signed purchase order which the dealer told me supports non-refundable. In fact I was never given the PO until I requested cancellation. I was never at the dealer, all was done via e-commerce and email. In no communication has the deal ever stated the deposit was non-refundable until I requested cancellation. Had I been told it was, I never would have given my credit card information to them. They offered me a dealership credit toward another trailer which I am not interested in. They also threatened to bill me for "liquidated" damages if I initiate a credit card dispute (which I have done) this threat is in email from Josh C (General Manager/Owner)They refer back to verbal agreement when convenient and written contract when convenient. I was told refundable deposit from Jay, the sales PO states non binding unless signed by both seller and buyer. There is no signed agreement and I was never made aware of any liquidated damage clause or non-refundable position. The matter is quite frustrating to say the least.

This customer contacted us by phone and negotiated a price to purchase this RV and offered to put a deposit on his credit card before we even asked for one. The sales rep told him the deposit would be non-refundable. The customer then asked that it be refundable if there was damage to the camper. The sales rep got the permission of the GM and told the customer we would refund the deposit if there was damage or the camper was otherwise not as represented on our on line listing. The customer agreed to this and then gave his credit card information.

The customer then scheduled his pickup date. We removed the unit from the sales lot, turning away other qualified buyers. We prepped the unit for his pickup, at a cost of over $600 to us. On 9/5 1pm he contacted us to reschedule his pickup due to travel issues (his pickup was scheduled 9/7, less than 48 hours away). At this point his unit was prepared and ready to go. On 9/5 8:30 pm he emailed the sales rep and said he was "going to have to pass on the trailer" due to family medical issues.

In accordance with NY DMV regulations, our postage signage, and verbal communications to the customer we retained the $500 deposit to help cover our costs of prepping the trailer for his pickup, our loss of other potential sales, and re-prepping the trailer for the lot.

The customer called demanding a refund and calling the sales rep a liar. The rep that he dealt is honest to a fault. The fact that the rep also asked the GMs permission to offer a refundable deposit in the case that the customer found the trailer to be damaged upon arrival reinforces to me that the rep did in fact tell the customer that the deposit was non-refundable other than the very specific case of finding damage or the camper not as represented.

I have reviewed the response made by the business in reference to complaint ID, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

The business offered a store credit, they never stated a non refundable deposit was their position or I never would have given my cc information. I was never in their dealership so referring to posted signage is comical. In all the email communication they never stated the deposit was non-refundable until I requested cancellation and a refund. In fact Josh the GM states in email he told Jay they would allow a refund if I didn’t accept the item, which was conveyed to me by the sales rep, Jay. The business in emailmake reference to a purchase order which was never signed and then to verbal agreements. It was verbally agreed that the deposit was refundable.

With regard to dmv regulations, this was an e-commerce purchase and I was not physically at their location at any point in time. Additionally there is nothing noted, shown or stated on their web page about deposits being non-refundable.

at no point have I said the rep was a liar or being dishonest. I did state “there is clearly a misunderstanding of what I was told” the business has taken it to a level of being unprofessional to the highest level possible including threatening me if I set up a Credit Card dispute - which I have done.

I am attaching hereto an email chain with Curren RV. I will asterisk the most important items. I am also attaching a Purchase Order which was ONLY provided to me after I requested cancellation and refund. Additionally, I am attaching the quote which was provided to me which NO PLACE states non-refundable deposit.

Please take notice that not one of the contractual documents were signed/executed either by me or the business, rendering them useless. The business will then rely on a verbal agreement wherein I was told the deposit was refundable with no caveats as they are now attempting to impose. Lastly I asked what the CC deposit amounts they require or request are - if that is taken as "offered to put a deposit on his credit card even before we asked for one" well then I guess asking about how much would be taken before providing my actual CC information is incorrect, then I guess that'd be my fault for making the inquiry.

On Friday 9/6 @ 11:54 am an email from Josh C was recd confirming that he gave Jay permission to make exception to a non-refundable deposit.

This is 100% what Jay represented to me, without caveat, the deposit is 100% non-refundable which is the only reason I gave my credit card deposit. I never would have otherwise.
