I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
As explained to Mr [redacted], I placed silicone on grout in an effort to avoid moisture build up. I affirmatively state that I attempted to contact Mr [redacted] beginning March 2014; initial calls regarded the shower doors loosing their alignment (prior to the tiles lifting). Additional cash payments can be identified taking total job to $67k. Once tiles were removed by licensed contractor (9/2014) it was obvious that original installation performed by Mr. [redacted] was not in compliance with DenShield requirements which Mr [redacted] purchased from Arizona Tile in February 2013. Company specifications  are available for reference. All DenShield and other material under the tile curb were found to be wet and spongy. As a result of improper installation I contacted new licensed installer and licensed general contractor both of whom have provided written summaries of what was found. Entire showers have to be replaced. Work is completed on first shower and clearly shows mold building behind the tiles on the walls due to improper installation of DenShield. The California State Contractors License Board has given Mr [redacted] 7 days to contact us (which ends today)  in an effort to reach a mutually satisfactory settlement without proceeding to arbitration. As of this email, we have received no such contact. 
Mr [redacted] has taken the position that he only provides a one year warranty. Not only was this not stated in his contracts but he is failing to acknowledge that contractors must perform their functions in a non-negligent manner and failure to do so carries a different statute of limitations of up to 10 years; additionally he has not acknowledged that there was an implied warranty against negligence.

Review: Total job including contractor expense, parts and materials apron $67k. Work performed Jan/Feb/March 2013. Began calling [redacted] March 2014 regarding tiles separating in both showers. Contractor denies receiving calls till July 2014 but finally emailed me back late August 2014. Learned that contractor never pulled required permits and told me that it was our responsibility to pull permits. City states that the reason you go to a licensed contractor is that they have responsibility for permits. Nr [redacted] provided estimate for repairs without knowing what was creating problem. Refused to investigate, repair, and replace. States that work is only warranty for 1 year but this is not a warranty issue it is defective materials. Installers used unacceptable material in both showers and tiles need to be removed. Used some kind of soft clay material, similar to drywall, that is absorbing water and swelling and will eventually lead to mold. No cement was used as is standard with showers. This has been confirmed by independent licensed contractor.Desired Settlement: Since Mr [redacted] refuses to repair/replace defective construction we are requesting a refund for his labor charges for the showers. We will apply funds to correcting the problem and attempt to use the same tiles.

I gave the Condercuris a proposal to do the repair for $650. A substantial savings below their verbal quotes to me.

They requested I split the $650 of the proposal I gave them.

I refused since I was already giving them a discounted rate.

They then proceeded to falsely accuse me with false information as stated in their letter to you.

These are the facts and as I stated before I can prove them in the Court of Law.

I have been a licensed General Contractor for 30 years and this is my first complaint ever. You may want to check my record.
