To whom it may concern: We have been in contact with the [redacted] ’s the last several weeksThough meaningful communication has proven difficult we have done what we can to work out a resolution with the [redacted] family Unfortunately we have had quite a wet spring and now summer Central Ohio is now coming to the end of the 10th wettest June on record It has rained days this monthof those days have been consecutive with a total rainfall recorded of 6.72” for the monthNO days in June were recorded as clear making any type of dry out nonexistentThis unfortunate weather pattern has left us unable to establish any type of realistic production schedule or timelineWe have attempted to communicate this inability to create a firm schedule to the [redacted] family on more than SEVERAL occasions but have not been successful At this time we have offered to rework our schedule in an effort to accommodate a large political fundraiser they are havingIt has turned out that this event was the reason for the [redacted] ’s strong desire to have a ‘firm start date.’ Though initially they accepted they have since declined At the [redacted] ’s request we have also agreed to allow them to cancel their contract and have offered to refund them their moneyThis option would involve turning over their approved building permits, selling them the pavers they special ordered at cost, and executing a termination agreementAs of this email we have yet to receive a response from the [redacted] ’s / [redacted] Style Definitions */ Thank you in advance for your time and attention in the matter / [redacted] Style Definitions */

truly timeline has never been an issue....lack of communication and negative communication by Mr. [redacted] was the issue all along. When we tried to discuss the adverse weather and what that meant to the project he completely became antagonistic. Working with contractors means accepting them as the experts....and we've alway differed to any contractor to decide what is in the best interest of the job. This person who wrote the response has never been involved in the communications and has not been privy to the conversations we have had with the owner, [redacted]. We in no way decided not to further our relationship until Mr. [redacted], he decided he didnt want to deal with anybody questioning his authority! Mr. [redacted] and Leisure pools is in breach of contract and we decided to find another contractor

Comments: I have an open complaint against leisure pools of Columbus that has been resolved. How do I get this discharged?

I am writing to reject the response below.  I am attaching below recent correspondence from the pool company so you can put their timeliness in perspective.We did do a final walk-through on 4/26.  It took them from 4/26 until 5/17 to send someone out and start finishing the final list.  On 5/17 they did show up and sent the below email.  They noted that all items were complete with the exception of coping stone grout.  Please note they used the word “grout”.On 5/30 I emailed them asking when they were coming back to grout the coping stones, cap the pipe and fix the visible damage on the pool.  We received no response for nearly 2 weeks and finally on 6/12 [redacted] reached them via phone.  During that conversation with Julie he did tell her that our patio was not level and the water was draining towards our house.  So from 5/17 to 6/12 we had no communication regarding our follow up issues.  The lack of communication/response created much frustration throughout this entire project.Julie emailed me on June 15th and it is attached below.  When her crew arrived that afternoon I did ask them about grouting the coping stones.  That may not be the correct word, however, that was consistently the word they used when explaining the process to us.  That said, the crew had caulk and they showed me what they were going to do – they were going to put a bead of caulk between the auto-cover track and the bottom of the coping stones so that when you were in the pool you couldn’t see the mud holding down the coping stones.  They were not here to fill the seams between the coping stones with whatever they should be filled with.  I told them I’d reach out to Julie and in the meantime they started the process of sanding down the scratches and said they were going to buff it all out.I had an appointment and left around 1pm, when I returned the crew was gone, nothing was fixed and I’ve never heard from them again until this complaint was filed.The bottom line is that we’ve paid $70k+ and the work is not yet complete.  There are many significant scratches in our pool that need properly repaired.  The coping stone joints are empty.  Photos attached.We dispute the fact that we said they could just cut off the gas line pipe and leave it that way – that was never said.  The patio alone was $16,671 and the gas line was supposed to be installed and capped flush with the concrete to be used a future date.  You can see a photo attached.  This has to be fixed.We are highly concerned about the water flow towards the house.  We have had two different contractors look at it who have both said that the pitch will result in foundation issues to our house if not properly dealt with – we have a one year warranty for faulty workmanship and need to present a claim for the patio.We are happy to pay our $1260 balance as soon as the work is complete.Sincerely,[redacted]
