I am rejecting this response because:While it’s true that Custom Construction initially worked with us to repair thecracked driveway, they never were very cooperative in the processWe had to havethe “representative” come out several times because he would not agree to replacetwo of the sections that had crackedHe finally agreed to replace one of them andwe gave up on the other.Since Custom Construction wants to turn the blame around and put it onto their customers, I will go through all the reasons we had for being extremely cautious when we were working to have the repairs made.We had requested enough notice of the start date so someone could be home when the work was doneThey gave us a week’s notice with a “sometime at the end of the week, beginning of the next.” And then a call the day before saying they would start at 7:00AMThat is not enough time to take off a day from work.Here is a list of our other problems with their work:• They completed the entire tear out, preparation of base material, installed rebar, poured the whole slab, and cut the control joints in one daySeemed too fastDon’t most jobs take at least two?• They went into our back yard without permission to get our hose to wash off their equipment and left cement residue all over the front yard later caused multiple dead spots in the grass.• They told us they don’t pin old and new cement togetherThe result of this is that the old and new driveway is now uneven.• They completely cut our main sprinkler line and never said anything about it.• When removing the old driveway from around the garage, they cracked the brick wall next to the garageThey attempted to conceal the cracks with mortarThey (the representative) said they did not cause the damageIt cost us $to repair it.• They said they were going to “pop out” three sprinkler heads near the drivewayThey actually tore out and broke the headsOne we later found buried.We notified the “representative” in March of the first crack and he told me they weren’t doing anything about repairs yet because it was too early in the season and to fill out the warranty form, which we didThen, a couple weeks later, we had several more cracks and the heaving in our garage, which caused damage to our siding and garage wallWe again filled out the warranty form and sent picturesWe had a total of out of pads crackThat is just under 50%The “representative” finally contacted us near the end of April/beginning of MayThey DID NOT “unsuccessfully contact us multiple times” as they stated in their responseThat is a lieYes, we had him come out multiple times to go over what repairs were going to be made becauseThe “representative” immediately said they should have put a control joint in the garage which they now deny sayingHe also was VERY vague about what they were going to doHe would point and walk around and point again and not write anything downWe honestly did not trust himWe wanted everything in writing and drawn outAs I stated above, we had to fight with them to get two small section replacedWe finally got him to agree on one and we gave up on the otherAt NO POINT did we EVER ask for the ENTIRE DRIVEWAY to be replaced as they stated in their responseThat is a flat out lie.The “representative” offered to “do us a favor” and replace the end of our driveway for an additional $We had not had that part done originally because it was fairly new and in pretty good conditionWe said we would agree to that but then a day or two later, the “representative” called and said his boss would not agree to that price and he would have to charge $or something like thatThat is half of what our whole project costThat is for only approximately four smaller pads when the other section was 20! One-fifth the size of the driveway for almost half the price of the whole driveway? We said no.As for the long delays they mention, there was about a two week delay where I thought I had emailed the “representative” and we were waiting on his reply, and it turns out I hadn’t emailed himThat delay I will take responsibility forThey were never planning on doing our repair in June like they statedFrom the beginning they said it would be in OctoberWe never told them we wanted it done in the fallIf they could have done it in the summer, that would have been perfect for us.Once we signed off on the repairs, we again requested enough notice so someone could be home when they did the work and once again we got the call the week before saying maybe the end of the coming week or beginning of the nextThen a call the day before saying they would be there at 7AM the next dayThat morning, one of the workers was prompt and showed up at 6:The “representative” of course, was notHe was stuck in trafficMy husband wanted to talk to him before he left for work so he waitedAnd waitedWe had recently reseeded our lawn and had new grass growingThe workers began unloading their equipment and put it right on the spot of new grassThey couldn’t move it three feet in any direction and put it on the already established lawnHad to go for the new stuffThis added to my husbands already growing frustrationWe were still waiting for the “representative”My husband asked who was going to be the foreman “onsite” all dayThey said it would be the “representative”Who was still not thereAt this point my husband told the worker to get their” sh*& off our lawn.”The “representative” finally showed up a half hour late which now was going to make my husband late for workHe showed up with an attitude and was obviously not willing to talk to my husbandMy husband was trying to make it clear that we did not want the workers wrecking our lawn againWe did not want them putting their stuff on the new grassWe did not want them going in our back yard again and there is a spigot in the front yard they can useWe did not want them wrecking the wall againMy husband informed him if the wall was damaged again, we might have to sue themThe “representative” kept walking away from my husband and waving the repair change order and saying they knew what they needed to doSo, yes, myhusband did get frustratedHe did not kick them off the propertyHe told them to keep off the grassHe did not void the warrantyThat was the “representative” who did thatThe representative said he was keeping them from doing their job and that the warranty was voidThat is when my husband told him he was going to work and he should just do his jobAt that point, the representative told his crew to load up and that they were leavingWhen the “representative” was in his truck, my husband again tried to talk to him and told him he would be sorry if he leftWe had a binding contractHe was trying to de-escalate the whole thing and the “representative” gave him a smug, “Have a Nice Day” as he drove offThat is when my husband called him a few names and cursed at himTo say we were the ones who told them to leave and voided the contract is ridiculousWe are the ones with the cracked driveway and the damaged sidingThey were going to fix itWhy would we willingly send them away?The next day was the beginning of there “attempt” to resolve the situationI received an email from a generic email address from their company asking how they could make things rightI told them we were fine with what the repairs they were planning on doing, we just didn’t trust their “representative” and wanted someone differentThere was obviously a personality conflict and we didn’t trust himThey waited 3-days and stated that he was the “only one” who did the sales and oversaw repair workReally? Somehow I doubt thatAnyway, they wanted to know how much they could pay us to have us release them from the obligation of the warranty.At this point, we could not get anyone to come out to give us an estimateIt was now nearing the end of SeptemberMost contractors are booked for the remainder of the seasonWe couldn’t get a quote and we knew we needed to have some preventative measures taken before winter hitPlus, we had already spent a lot of money to repair damage from the first time they came out so we gave them a number that was admittedly pretty highThey again waited 3-daysThey said they lost business and incurred expenses coming out the day they tried to do the repairsWe replied (the same day) that we couldn’t get anyone to give us an estimate because everyone was bookedThat we didn’t know what a fair amount would beThat we would be willing to have them do the work and that my husband would agree to be gone before they got there because he and the “representative” are the two that have the conflictWe again wait 3-days for a replyThey reject the offerThey say noThey are not willing to do the workThey ask again how much we wantI again explain that no one is available to do the workThat we need to take preventative action because we can’t get it fixed before winterI again tell them that none of this would have happened if they had done the work correctly in the first placeI give them a number and justify itThey again wait 3-daysThey tell me that companies are not booked for the seasonI could get estimatesThey tell me their “representative” never said they did the job wrongA lieThey now say the damage to the garage was due to a “pre-existing soil condition”This is the first time this has ever even beenmentionedIf that were the case, they should have mentioned that during the prep work and consulted us before they poured the cementThey told us we had agreed to a dollar amount for the repair work and that is what they were basing everything onYes, there was an amount on the repair order but we had agreed to the work, not the dollar amountThe company then decided to take $off of that amount for the expenses they incurred on the day their “representative” decided to walk off the jobThat is the last email we received from themTo say they are surprised to have received a complaint from the Revdex.com is ridiculousI told them we would be filing a complaintI told them I would be looking into our legal options.They say they are a reputable company, however, we feel, if they truly were a reputable company, they would honor their warranty with no argumentsThey would also not turn the blame around onto the customerThey would not send their emails from a generic company email and not sign them so you have no idea who you are communicating withThey would not wait 3-days before they respond to every email you sendA reputable company would take pride in their company and their work and would want to make their customers happyIn addition, we have asked for the bond information twice from this company and they have not even bothered to respond to our requestThis doesn’t sound like a “reputable” company to meThey would not have another complaint with the Revdex.com with the same “representative” with very similar experiences that also appears to have gone unresolvedUnfortunately, that complaint was posted after we hired this “reputable” company.We have since had some of our issues with our driveway fixed by another company who has years experienceThat company has pointed out several issues with the work that was done that we were not even aware ofThe control joints cut into the cement that are supposed to control cracking are going to fail and have failed because they are only ½ inch thick and they should be at least inch thick for a inch slabThat is one of several reasons why our driveway crackedThe lack of the proper control joints and expansion joint between the driveway and the garage was the main cause of buckling and damage to the garage sidingThe fact that they poured in October and did not allow enough time for the cement to cure before the first frost is another issueAlmost every company I have talked to say they stopped pouring in September unless they can tent the area and use heaters.We also have documents, phone logs, and pictures to back up our claimsAll we want is to be done with this nightmare and move onAt this point, we would be happy with the $they mention on their repair order even though we don’t think it will cover the repairs

I am rejecting this response because: My husband raised concerns with Shawn the day of the final payment because things did not look right, and he brushed them off telling us that we were wrong, and everything was fineIf it wasn't, you guys would fix itWe did not bother to take out a level to check the grading because we TRUSTED himHe knew that day that we were very unhappy about the big hump and really did not seem to care muchHe gave us a song and dance without really telling us who changed the plans or why After it rained and we saw the water at the foundation and took out a level and figured out how really messed up everything was, and we realized that what Shawn told us about the way the rain would go was totally incorrectWe were just sick I left a message with Tim that day which was the 24thI had no idea who else to callThen I left a message on the main voice mail on the 25th, because I never heard anythingThen I called Shawn that day and reached himI told him that I had not slept in two nights and that we were really really concerned about what we discovered on the 24th, after the rain on the 22ndI told him about the water going toward the house and that we checked with the level and that the hump was draining more water back to the corner of the house than ever beforeI was really clear with him about the damage that was happeningHe said that he would get back to me with a time to come outI told him that I was off work on Monday and we really needed to resolve this before more rain came I never heard from himI waited over hours and then texted him Sunday night to remind him that I was off Monday the 26th, so that would be a good time to come outHe did not respondI texted and called him early Monday morning, and still no responseAfter waiting days, we were getting very upset and concerned about more possible rainfall You guys were us calling every day including weekends, when you wanted the job, or a paymentNow that we were having a huge issue, we were unable to get any response at allNot even a word text from Shawn saying "working on it." That is why and when we contacted the Revdex.comAny response at all from him would have prevented thatAfter the report was filed, Shawn then contacted me and told me that no one at your company would help us unless we removed the complaintI was totally taken abackIt took that complaint to even get a call at all from anyone at all, and now he was telling us that no one would help us unless we removed the complaintI called the Revdex.com to ask them to remove it, just to get you guys to come out, and was told that is not a possibility Shawn then called my husband that day and that evening, even though he knew that I was off work and I was the one who was calling and texting himIt was a real slap in the faceI wonder how a man would feel if he called a contractor with an issue, and the contractor called his wife back rather than him? working out a resolution with this customerBelow is a detailed dated break down of what transpired in our interaction with the customer on this repairIn March of we received a notice from this didn't even installOur sales rep explained that we would only be able to take care of the sections that are under warrantyOn May 22nd we came to the verbal resolution that the customers would be happy with the replacement of the cracked section of the driveway and that we would also replace part of their siding for no additional costWe sent a repair change order that reflected this on May 22nddays after we sent the repair change order, (May 29th) we received an email from the customers stating that they need to have additional drawings and pictures before they will sign the repair change orderA few days after they brought this new information to our attention we visited the property a third time, providing them with the drawings and pictures they requestedOn June 6th the customer stated once again that they would like to move forward with the repair change order/pictures and drawingsThat day (June 6th) we emailed a signed copy of the repair change order and drawingdays after we sent the repair change order (June 23rd) the customer stated that they wanted to meet a 4th time to sign the change orderThat day (June 23) we met with the customer and signed the repair change orderAt this time we were scheduling into Summer where the customer requested that we commence with the repairs in the fall, as spring had passedOn Friday, September 8th we sent an email to the customers explaining that we would be starting their project towards the end of the following weekOn Thursday, Sept 14th our repair crew showed up to commence the repair work as agreed uponAt that time the husband became very aggressive, cursing and threatening our crew membersHe explained that we would not be allowed to walk on the grass or use his water spigot in the back yardWe tried to resolve the issue by explaining that we were there to do the repairs that we agreed upon in the signed repair change orderHe then stated that the change order was voided and he threatened to sue our companyAt that time our crew had no option but to leave the jobsite as the customer would not allow us to complete the repairsThe day after the attempted repair (Sept 15th) we reached out to the customer via email in an attempt to resolve the issue that they were having regarding their repair projectWe have kept up communication with the customer over the last few weeks to come up with a resolution that I would never agree to nor be satisfied with the fact that my new patio is flooding and the lawn on the side of my house is complete dirt. Their email states that they made numerous calls to me and that I did not respond, when in fact I never received any voicemails or missed calls from them, I certainly would have called them back had I received a call from them, and I did speak with them the couple times that they did in fact call me. In May I called CCS and talked to Tim at which point I voiced my concern of the flooded patio, Tim had told me to take pictures of the patio and contact the office regarding the situationI proceeded to take the pictures and emailed them over to the office on June, 16th A few hours after sending my email I received a response from Nicole asking me to please fill out the warranty request form on their website and that somebody would be contacting me for the next stepsIn June after filling out the request form Sean came out to the house to look at the patio, in which he told me that we will watch it and see what happens with itWhen he was at the house I let him know that I was unhappy with the lawn, and he had told me that we would take care of it in the fall, because that’s when seeding is doneCome November of and I had not yet heard back from CCS about the seeding or the patio, I contacted them yet again voicing my concerns and what we had discussed back in June. On November 8th I received an email from Sean asking for me to contact him at the number he provided, I contacted him and at that point Sean told me that I would have to contact a landscaping company as CCS doesn’t do any type of re-seeding, I had said to him that this is not what we discussed in June when he was at the house, and then he had offered to drop off a bag of grass seedAt this point I was so overwhelmed and frustrated that I had just basically said “whatever, or fine” and hung up the phoneNot by any means completely satisfied with the outcome of the situation as they have stated. work on a retaining wall and paver patio project for this customerThis project included spreading black dirt and seeding over that access area we worked inThis was an extensive job that was very detailedWe were able work efficiently and quickly and completed the project in only daysOn October 13th we completed the projectWe did a final walkthrough with the customerAt that time she paid us in full and stated that she was completely satisfied with the projectIn December she called and expressed concern with the drainage of her paver patioWe explained that it is winter time and we will keep this information in her file and contact her in the spring when we can properly assess the patioShe informed us that she was ok with thisIn April we made two attempts via phone to reach out to this customer to address her patio drainage concernsWe were unsuccessful in reaching herIn June the customer sent an email stating how she was concerned about the drainage in her patioWe made numerous phone calls to reach out to her to schedule a meeting to discuss her drainageWe were unable to contact herOn July 26th, we received a warranty request form stating that she would like someone to contact her regarding the drainage in her patioAfter a few weeks of us trying to contact her we were able to set up a time to meet in August At our meeting in August she was concerned about the drainage of her patio as well as any structural issues this may causeWe explained to her that the patio and the yard were graded properly, and that the minimal pooling only happened during isolated events where the water dissipated very quicklyWe explained that she has a warranty that will cover any potential structural issue that she may be concerned about and that we feel the drainage is correctWe told her that if she has any future concerns feel free to contact usShe explained that she appreciated us coming out and that she was satisfied with this outcomeNovember 6, we received a new warranty request form stating that her project was supposed to be reseeded this fallThis was a surprise to our company because we were not informed about this concern previouslyNot only did this issue not come to our manager's attention when working directly with the customer, it was not included in any past emails or past warranty request forms she had filled outAt this point it was very important to us to reach out to this customer to try to clarify this issueOn November 8th we spoke to the customer and explained that her project included an initial seeding of her access but did not include yard maintenanceWe explained that when growing grass there is regular maintenance that should be done to ensure that it grows properlyThe maintenance included watering, fertilizing, aerating, and potential reseeding of the spaceIt is important that our customers are happy so we offered to deliver her seed at no additional chargeShe stated that she understood the process and was satisfied with the solutionNovember 14th we had a company representative deliver the seed to her houseShe did not voice any other concerns for her project and thanked him for delivering the seedOn November 29th we received the Revdex.com complaint from this customerOverall, this customer had two concerns with this projectWe communicated information to her regarding her questions in a timely mannerOnce we went over her concerns and resolved the issues together she stated both times that she was satisfied with the outcomeIf at any time during or after we resolved these issues she had voiced that she was unsatisfied with the outcome we would have worked out a different resolution that worked for both parties

Our company representative ran levels on the pitch of the driveway to ensure proper water flow. It has been determined that the drain system installed is draining correctly, and the driveway is sloping the way it was initially designed. We also inspected the walkway and it has proper pitch, sloping away from the house. With our findings we do not believe that there is an issue with water drainage, nor is the foundation at risk to any structural damage due to water runoff from the driveway or walkway.

Then I called Shawn that day and reached him. I told him that I had not slept in two nights and that we were really really concerned about what we discovered on the 24th, after the rain on the 22nd. I told him about the water going toward the house and that we checked with the level and that the hump was draining more water back to the corner of the house than ever before. I was really clear with him about the damage that was happening. He said that he would get back to me with a time to come out. I told him that I was off work on Monday and we really needed to resolve this before more rain came. 
 
I never heard from him. I waited over 24 hours and then texted him Sunday night to remind him that I was off Monday the 26th, so that would be a good time to come out. He did not respond. I texted and called him early Monday morning, and still no response. After waiting 3 days, we were getting very upset and concerned about more possible rainfall. 
 
You guys were us calling every day including weekends, when you wanted the job, or a payment. Now that we were having a huge issue, we were unable to get any response at all. Not even a 3 word text from Shawn saying "working on it." 
 
That is why and when we contacted the Revdex.com. Any response at all from him would have prevented that. After the report was filed, Shawn then contacted me and told me that no one at your company would help us unless we removed the complaint. I was totally taken aback. It took that complaint to even get a call at all from anyone at all, and now he was telling us that no one would help us unless we removed the complaint. I called the Revdex.com to ask them to remove it, just to get you guys to come out, and was told that is not a possibility.  
 
Shawn then called my husband that day and that evening, even though he knew that I was off work and I was the one who was calling and texting him. It was a real slap in the face. I wonder how a man would feel if he called a contractor with an issue, and the contractor called his wife back rather than him? It is the year 2016 and women not have jobs outside of the home, and we do things like hire contractors and make decisions other than what is for dinner. We can certainly take our own return phone calls.
 
All we want is to have the driveway fixed and done the way that we hired your company to do. I can not possibly imagine taking money from a family and then doing the opposite of what was agreed on and then refusing to fix the issue or respond to major concerns that will ruin our foundation. 
 
We really really can not want to wait until more damage is done, and we need a new foundation. Please fix this.
My husband raised concerns with Shawn the day of the final payment because things did not look right, and he brushed them off telling us that we were wrong, and everything was fine. If it wasn't, you guys would fix it. . We did not bother to take out a level to check the grading because we TRUSTED him. He knew that day that we were very unhappy about the big hump and really did not seem to care much. He gave us a song and dance without really telling us who changed the plans or why. 
 
After it rained and we saw the water at the foundation and took out a level and figured out how really messed up everything was, and we realized that what Shawn told us about the way the rain would go was totally incorrect. We were just sick.
