trim excess composition shingles at all eaves and gables prior to roof installation. There is no mention of a tear off of existing roof or a new wood decking installation anywhere in the contract. After my foreman arrived and performed an inspection of the existing roof he discovered that it was not composition shingles as I had thought and had stated in the contract. He called and notified me that the existing roof was metal instead of composition shingles. His crew would now have to perform a complete tear-off and installation of new decking prior to installing the new metal roof. My foreman told the client that a complete tear-off and re-decking was required before the work stated in the contract could begin. He told the client that it was going to cost $5,500.00 in materials and labor but the client said that they didn't have the money to do that. My foreman called me and put the client on the phone. He inquired as to what would then happen with the roof if they couldn't afford the cost of the tear-off and re-decking? I told him that I was sorry that we could not install the roof the way I had proposed in the contract and that I would give him his $2,350.00 deposit back and we would pick up the material two days later on July 2, 2015. The client agreed that I would return his deposit and pick up the materials on that date. Later that day I received a phone call from the client's wife stating that it was unacceptable. She threatened that I do the additional work and provide additional materials without them paying for the additional material, labor, and dumpsters or she would contact the Revdex.com and an attorney. The next day I received notice of her complaint from the Revdex.com.
It is impossible to perform this roof installation without performing a tear-off and re-decking so my preferred resolution is to return their deposit of $2,350.00 if they are unwilling to pay the added expenses.

Your claim that you didn't know our roof was metal and the original zinc from when the house was built in 1881 is totally untrue! We told you last year when you came to give an estimate that the roof was the original zinc. You walked outside and looked around and seen it for yourself. You obtained an aerial view of our home. I reminded you again that the roof was original zinc just ONE day before you had the guys come drop off material and you assured me it would be no problem going over the existing roof. You totally miscalculated the materials, the job and the cost and it's Your foreman that told us that and you actually admitted that over the phone when you said "I made a mistake, I'm sorry." The contract states that Custom Construction Systems will provide ALL LABOR AND MATERIALS NEEDED. A man is only as good as his word and your word means nothing. You never returned to get the materials or to pay the deposit back to us. You stated that you would be here on July 2, 2015? I have not been able to move my car in the garage since the supplies were left in front of the garage door. The cost of you storing your supplies at my home is $15.00 a day. You left them here on June 28, 2015. So far that's 13 days as of today (July 10, 2015) which means a total of $195.00 in storage fees. You broke the contract and your resolution is to come pick up your supplies and give us back the deposit whenever you feel like it? I don't think so. Our resolution is that in addition to our original deposit of $2,350.00 being returned is that you add the cost of storage to it. It's $195.00 extra as of today. Each day you wait, it's an additional $15.00 a day.

In an effort to resolve this matter, I have returned the original deposit along with $15 per day for storage as requested by the homeowner. The materials have been removed from the premises.

We received our deposit back and the storage fee as requested when they came to pick up the materials. We accepted the resolution because it was obvious they would not honor the original contract. It's a shame because we had several other people ask us who was putting on a new roof and they ultimately could have had several jobs in our area. We will not recommend this business to anyone we know.
